The Pledge of Allegiance was led by Commissioner Curtis. The Invocation was given by Commissioner Edelstein. MOTION CARRIED 5-0 Moved by Mr..Curtis, seconded by Mr. Edelstein, that the order of bus'hess be. suspended to consider The Tustin Elementary School application as the first item of business. MOTION CARRIED 5-0 UP-70-351- THE TUSTIN ELEMENTARY SCHOOL DISTRICT Authority is requested for approval of a Use Permit to establish an elementary and intermediate school facility, to be accomplished in two phases. Location: Site'fronts approximately 654 feet on the northwest side of Red Hill Avenue and approximately 1235 feet on the southwest side of Sycamore Avenue. 'Mr. Fleagle stated that the proposed structures would be located on Sycamore Avenue frontage with development being in two phases- elementary school to be completed by September, 1972, and the intermediate school to be finished in September, 1973. He further went on to say that several departments of the City had school use of interior road system, limitation of pedestrian and vehicular access on Red Hill Avenue, protection of adjacent single- 9/: ":/70 -1- PC .~.~nf~t~.~Scptember 14, 1970 family residential areas, pedestrian and vehicular safety, and on-site parking accommodations. It was a consensus of opinion that considerable study and redesign be accomplished which would benefit'all concerned. Chairman Larnard declared the public portion of the hearing open at 7:40 p.m. Mr. Archie Currie, Deputy Superintendent of The Tustin Elementary School District, stressed the importance of this proposed school. It is the first project in which there will be both the kindergarten (1-6) grades (elementary school) and a 7-8 grade (intermediate school) on one site. Mr. Currie went on to say that the intermediate school will serve the area south of the Santa Ana Freeway and from the western boundary of the school district which is Lyon Street on east. The chief problem is the provision for getting traffic in and out of the school site from both the east and the west. MOTION CARRIED 5-0 ZC-70-216-COVINGTON BROTHERS, ON BEHALF OF MARVIN L. AND WANDA L. BOSE. Authority for a Zone Change (ZC-70-216) of subject property from the PC-R-3(1750) (Planned Community Multiple Family Residential, 1750 square feet of lot area per dwelling unit) District to the PC-R-3 (1350) District (Planned Community Multiple Residential, 1350 square feet'of lot area per dwelling unit). Location: Site fronts approximately 214 feet on the west side of Williams Street and is located approximately 774 feet north of the centerline of McFadden Street. Mr. Fleagle stated that this application has been continued from the July 13, August 10, 1970, and August 31, 1970, Planning Commission meetings in order to'permit the applicants time to submit revised plans. He went On to say that the revised plans indicate 120 units with a density of 28.2 units per net acre and land area per unit of 1542 square feet. Parking ratio would be 1.5 parking spaces per dwelling unit. The structures would be two-story in height and are proposed for Spanish type architecture. The Development preview Commission expressed concern for the parking which they felt to be inadequate. They recommended 1% spaces per one bedroom unit and two spaces per two bedroom unit be provided on-site. Chairman Larnard declared the public portion of the hearing open at 8:05 p.m. ~ Mr. Gared Smith, architect for ~he ~ro~ect,2043 Westcliff Drive, Newport Beach, stated that he felt the property to be very unique ~n that it is extremely narrow for its depth and has ~ery little frontage. He felt that the density they are proposing basically conforms to the average density of the area which is around 1~00 square feet. . 9/14/70 -2- PC Minutes-September 14, 1970 Mr. GeorQe Argyros, 17291 Irvine Boulevard, Tustin, stated that this proposed development was similar to his Villa Viento development on First Street in Tustin, in which they have the single driveway apRroach and 1% parking ratio. Mr. Argyros reiterated that parking has not been a problem in his development. The public portion of the hearing was closed at 8:20 p.m. by Chairman Larnard. Moved by Mr. Edelstein, seconded for purposes o.f.discussioq b~ Mr. Sharp, that ZC-70-216 be denied. Mr. Curtis expressed concern over the size and shape of the property and felt that more amenities would make this parking area more acceptable to both the Planning Commission and the City Council. He also pointed out that there was doubt in his mind as to the Fire Department being able to serve them in the event of an emergency particularly in the rear portion of this proposed development. Mr. Edelstein amended his original motion, seconded by Mr. Sharp, to include and~ read as Staff has recommended to the City Council that this application be referred back to the Planning Commission in order that revised plans would include a parking ratio of 1% parking spaces per one bedroom unit, two spaces per two bedroom unit and density factor not to exceed 27 units per acre subject to stipulated Staff requirements and Development Preview Commission approval of design plans. At the request of the applicant a substitute motion was moved by Mr. Sharp, seconded by Mr. Mahoney, that ZC-70-216 be continued to the next regularly scheduled Planning Commission meeting referring it to the Development Preview CommissiOn in the interim for their report on any revised plans to be submitted. MOTION CARRIED 5-0 ' UP-70-347 - R. B. HORNE ON BEHALF OF G. L. A. DEVELOPMENT COMPANY Authority is requested for approval of a take-out restaurant with outdoor patio eating facilities. Location: Subject property fronts approximately 90 feet on the southeast side of Ngwport Avenue, approximately 240 feet northeast of the centerline of Walnut Avenue. Mr. Brown stated that the property is zoned R-3(1750) and that in conjunction with this particular use permit was a Zone Change (ZC-70-218) which was approved by the City Council at their September 8, 1970 meeting. The Development Preview Commission expressed no objections to the style of the building as per the plans, but did feel that the site could be redesigned to provide more adequate parking and landscaping. He went on to point out that plans submitted with this application indicate a 900 square foot take-o~t restaurant with an outdoor patio eating facility adjacent to the main structure. Eleven parking spaces have been shown with two access drives to Newport Avenue. Chairman Larnard declared the public portion of the hearing open at 8:50 p.m. Mr. R. B. Horne, 1482.~._HillsborO_Pl.ace, T~stin, stated that their restaurmat would s~r~m a high quality ~roduct and would be compatible to the surrounding area. Mr. Horne replied that there would be a street sign and that their sign has already been designed by the Federal Sign and Signal Corporation. The total sign square footage of all the signs involved in the building do fall well under the square footage allocation. Moved by Mr. Mahoney, seconded by Mr. Edelstein, that Resolution No. 1176 be adopted a~provin~ UP-70-347 subject to: Adoption of the ordinance establishing C-1 zoning for subject parcel. Compliance with stipulated requirements of the City Eng'ineer to include street improvements along the Newport Avenue frontage; installation of street lighting and street trees; submission and approval of a parcel map; and, necessary arrangements with Santa Ana Valley Irrigation Company for relocation of irrigation faci%ities involved in street improvements. Compliance with the stipulated requirements of the Fire Chief including a 10 lb. dry chemical extinguisher. 0 Hours of operation shall be limited to the period between 8:00 a.m. and 11:00 p.m. Subject operations sh~ll be conducted so as not to be a nuisance to adjacent residential properties and surrounding area by the reason of noise, smoke, odor and litter, and in furtherance of this objective, commercial trash collection shall be limited to the hours of operation .specified herein. Review and approval of Final Development Plans by the Development Preview commission including lighting, walls, tree-screen landscaping, parking, and vehicular circulation design. MOTION CARRIED 5-0 UP-70-350-MILDRED R. BROWN AND BENJAMIN D. BROWN, ON BEHALF OF RALPH'S MARKET, INC. Authority is requested'for a Use Permit to permit a retail pet store and grooming parlor. Location: Property is located within Ralph's Shopping Center (the subject shop address is 17321-17th Street), which is located at the northeast corner of the intersection of 17th Street and Carroll Way. Mr. Brown stated that the applicants are proposing to utilize a vacant store space in the eastern portion of the main shopping center.. Mr. Benjamin Brown, ~3562 Sussex Place, Santa Aha, stated that he was in agreeance with' the 'stipulations as set forth in the Staff report· Mr. Mahoney inquired as to what was termed an "exotic" ~nimal. Mr. Ben3amin Brown replied that these animals were imported snakes, alligators and otters. He went on to say that very few animals would be kept in the shop. The major pet sales would be strictly on a brokerage basis where they are obtained and delivered the same day. Mr. Curtis asked if Mr. Brown intended to sell animals that are not authorized under the City Code of Tustin. Mr. Brown replied "no". The public port$on of the hearing was closed at 9:05 p.m. by Chairman Larhard. Moved by Mr. Mahoney, seconded by Mr. Curtis, that Resolution No. 1177 be adopted approving UP-70-350 subject to: The stipulated requirements of the Fire Chief to include a 10 lb. ABC type dry chemical extinguisher. Animal sales shall be limited to those domestic animals authorized by Tustin City Code to be maintained in the City. e Animal boardin9' facilities, veterinarian services and/or kennels shall not be permitted on the premises. 4. The property and business shall be maintained and operated so as not to constitute a nuisance to the adjacent business establishments and surrounding properties - by reason of noise, odor or sanitary conditions. MOTION CARRIED 5-0 Parcel Map - PM-70-41 - R. C. AND B. J. KRUPPE To create four parcels in order to facilitate the development and sale of property. Location: South side of Main Street, east of Pacific at 440 West Main Street. Mr. Fleagie presented the City Engineer's report which stated that the developer proposed to serve all parcels from a 20 foot wide "private" driveway which would be much below the City minimum standard of 60 feet of street frontage on all parcels in the R-1 District. Mr. Kruppe , 12312 Newport Avenue, Newport Beach, stated that he-had previously submitted this property for R-3 Zoning. PC Minutes-September 14, 1970 He stated that this lot split, .excluding the drive area would be above minimum City requirements as far as square footage (7200 square feet) is concerned. Mr. Kruppe further pointed out that in order for him to develop this lot and use it, he would have to have (4) R-1 lots out of it. Mr. Flea~le stated that it was the thought of the Engineer to bring a public street in that area with a cul-de-sac. By dividing all of the lots in the area, changing lot line configurations, there are 27 lots in the general area that could be developed. He went on to say that he felt a letter should be directed to all the property owners within the area asking them to attend a special workshop to discuss the design plan for that block. Mr. Kruppe requested a 60 day continuance of his Parcel Map - PM-70-41. Moved by Mr. Curtis, seconded by Mr. Sharp, that the Planning Commission acce~t the request for a 60 day continuance of PM-70-41 §ub~ect to: Scheduling of a workshop with the property owners in the area on October 12th to review the Precise Street Plan for the area. Authority to permit a 50 foot high, 520 square foot free-standing sign exceeding the maximum Code permitted height and display area, and two wall signs for one business establishment.. Location: Site fronts approximately 176 feet on the southeast side of Newport Avenue and approximately 308 feet on the northeast side of F'ir~t Street. 3. V-70-273-EDMUND C. GAULDEN AND JAMES A. PADOVA, ON BEHALF OF SUNSET BUILDERS Authority to establish an office structure with less than the minimum requi~ed side and rear yard structural setbacks. ENDERLE Request for.rezoning of an approximate 10.5 acre parcel from the R-1 (Single-Family Residential) District to the PC-R-3 (Planned Community Multiple- Family) District. Location: Site fronts approximately 355 feet on the east side of Yorba Street, approximately 735 feet south of the centerline of 17th Street. 5. ZC-70-219 - R. T. FRENCH DEVELOPMENT COMPANY, ON BEHALF OF }~RRIET O. ENDERLE Request for rezoning of an approximate 4.3 acre parcel of land from the R-1 (Single-Family Residential) and R-3 (Multiple-Family Residential) Districts to the PC-C-2(Planned Community Central Commercial) District. Location:~ Site fronts approximately 585 feet on the east side of Yorba Street, approximately 214 feet south of the centerline of 17th Street. PZ-70-122 - R. T. FRENCH DEVELOPMENT COMPANY, ON BEHALF OF HARRIET O. ENDERLE To consider prezoning of an approximate 27.6 acre parcel of land from Orange County AC-PA (Architectural Supervision Professional and Administrative Office) and AC-CN (Architectural Supervision Commercial Neighborhood) Districts to the City of Tustin P-C (Planned Community) District. Location: Site fronts approximately 1731 feet on the south side of 17th Street and approximately 506 feet on the west side of Prospect Avenue. CONCERNS OF PLANNING COMMISSIONERS Council Action ZC-70-218 Mr. Fleagle stated the City Council on September 8, 1970, reversed the action of the Planning Commission in the recommended denial of ZC-70-218 from R-3 (1750) to C-1 for the property located on the northeasterly corner of Walnut and Newport Avenues. Moved by Mr. Mahoney, seconded by Mr. Sharp, that the Planning Commission send the report as recommended by Staff to the City Council pertaining to the ZC-70-218 a~lication. MOTION CARRIED 5-0' The City Council would like to have a workshop with the Planning Commission and City Council to discuss the Zoning Administrator Ordinance to be tentatively set up for November 30, 1970. Mr. Larnard read a memo to Richard Edgar, Parks and Recreation Commissioner, from Mayor Co~o, asking for a representative from meetings relative to the Santa Ana River Study. 9/14/70 -7- PC Minutes-September 14, 1970 Mr. Mahoney nominated Mr. Sharp to attend these proposed meetings if to be held in the day time, and Mr. Larnard will be the alternate if the meetings will be in the evening. Mr. Fleagle discussed a proposed amendment to the Zoning Ordinance relative to "Massage parlors'' being permitted subject to a Use Permit. Moved by Mr. Curtis, seconded by Mr. Mahone~, that a Massage Parlor be compatible, subject to a Use Permit, in the C-1 and C-2 District as recommended b~ Staff.
