SUBJECT: PARKING CITATION SURCHARGE
SUMMARY
The State of California, pursuant to Senate Bill 857, has imposed another parking
citation surcharge, effective December 06, 2010. The new fee is an additional $3.00.
The last Courthouse Construction surcharge of $4.50 was imposed in 2009. Including
other fees assessed by the State, the total amount of $12.50 per paid parking citation
will be collected monthly by the County Treasurer.
RECOMMENDATION:
1. Open and Close a Public Hearing
2. Approve a parking fine increase of $3.00 on all Tustin City Code parking violations
as a State Pass-Through Fee, effective immediately.
FISCAL IMPACT:
The Police Department issues approximately 800 parking citations per month. Failure to
approve the increase would result in a loss to the General Fund of approximately $2400
per month.
BACKGROUND:
The recently adopted FY 2010-2011 California State budget included a trailer bill that
increases various court fees to address funding shortages in the State court system.
Specifically, Senate Bill 857 authorizes the State to levy an additional $3.00 penalty on
all parking citations issued by cities and counties, per Government Code section
76000.3, to be deposited in the State Trial Court Trust Fund. This penalty is in addition
to the $4.50 surcharge imposed in 2009 to support courthouse construction and
remodeling. This new fee will raise the total surcharge on paid parking citations to

$12.50, which is collected monthly by the County Treasurer. The surcharge outlined in
SB 857 takes effect on December 06, 2010 and sunsets on July 01, 2013.
During the first 10 months of 2010, the Police Department issued 8140 parking citations,
an average of just over 800 per month. If the fines for parking violations are not
increased by $3.00, the City of Tustin will lose approximately $2400 per month in
General Fund revenue.
