STACK, DIRECTOR OF PUBLIC WORKS /CITY ENGINEER SUBJECT: APPROVAL OF AMENDMENT NO. 2 TO CONSULTANT SERVICES AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES FOR TUSTIN LEGACY BACKBONE INFRASTRUCTURE BETWEEN THE CITY AND HUNSAKER & ASSOCIATES SUMMARY Approval is requested of Amendment No. 2 to a Consultant Services Agreement for Tustin Legacy backbone infrastructure between the City and Hunsaker & Associates to provide additional engineering services related to infrastructure design requirements for Tustin Ranch Road roadway improvements, Valencia Avenue traffic signal and sewer line modifications, and Park Avenue roadway, storm drain, water, and sewer improvements. RECOMMENDATION It is recommended that the City Council: 1. Approve Amendment No. 2 to a Consultant Services Agreement for Tustin Legacy backbone infrastructure between the City and Hunsaker & Associates, increasing the not to exceed amount by $282,800 to $622,750, and authorize the City Manager to execute the document on behalf of the City. 2. Appropriate $282,800 from unappropriated funds in the MCAS 2010 Tax Allocation Bond Proceeds Fund (561) to the Tustin Ranch Road Extension Project Capital Improvement Program Fund (CIP No. 70100). FISCAL IMPACT The consulting services will be compensated on a time and material basis with a not to exceed budget of $282,800. The Scope of Services will require an appropriation from unappropriated funds in the MCAS 2010 Tax Allocation Bond Proceeds Fund to cover the additional engineering services related to additional infrastructure design requirements for Tustin Ranch Road roadway improvements, Valencia Avenue traffic signal and sewer line modifications, and to future Park Avenue and Legacy Road roadway, storm drain, water, and sewer improvements. Out of this amount, it is expected that $44,300 would be reimbursable from IRWD for design of their capital facilities pursuant to a future Capital Facilities Reimbursement Agreement between the City and Hunsaker & Associates Contract Amendment No. 2 February 1, 2011 Page 2 IRWD which will be brought back to the council at a future meeting. An itemized list of approved Tustin Legacy agreements for professional consulting services, including pending approvals, is attached for reference. DISCUSSION On September 7, 2010, the City Council approved a Consultant Services Agreement with Hunsaker & Associates to provide engineering services at Tustin Legacy related to the City's Disposition Strategy and Business Plan, aerial mapping, and improvements related to Tustin Ranch Road and Valencia Avenue. On November 2, 2010, the City Council approved Amendment No. 1 to the Consultant Services Agreement for engineering services related to preparation of a final tract map for conveyance purposes. Subsequently, the City requested and received a proposal for additional engineering services, specifically related to changes to the Tustin Ranch Road graded area, wall alternatives, preparation of the SWPPP, and Park Avenue and Legacy Road improvements, from Hunsaker & Associates based upon its familiarity and experience with the work required. Due to its vast knowledge of the project and its current working relationship with the City, Hunsaker & Associates was determined to be the most qualified to provide the required services at this time. WHEREAS, City and Consultant entered into a Consultant Services Agreement on September 7, 2010, to provide consulting services to the City for engineering services for the Tustin Legacy Disposition Strategy and Business Plan; and WHEREAS, the City requested certain additional engineering services related to additional infrastructure design requirements for Tustin Ranch Road roadway improvements, Valencia Avenue traffic signal and sewer line modifications, and Park Avenue and Legacy Road roadway, storm drain, water, and sewer improvements; and WHEREAS, Hunsaker & Associates submitted an authorization request for additional engineering services dated January 20, 2011, attached hereto as Exhibit "A"; and THEREFORE, it is agreed that the Original Agreement be amended as follows to reflect the modifications requested by Hunsaker & Associates and authorized by the City of Tustin: 1. Modification of Compensation. Section 2 entitled "Compensation" is amended to provide additional engineering services as identified in Exhibit "A" of this Amendment No. 2 up to an additional amount not to exceed $282,800. 2. Update all existing individual homeowner's disclosure exhibits based on the most current design to show vertical and horizontal locations of all proposed improvements adjacent to the rear property lines. (Improvements include TRR, sound wall, retaining walls and both Verdura walls). An overall plan view will be prepared to show all proposed improvements in relationship to the rear property line, individual exhibits will be prepared for each of the homeowners. This is an additional proposal under Task 2.1 item 2 .............. $ 5,900 4. Provide an interim hydrology report that is reflective of the proposed grading design. This interim report will respect the previously approved overall drainage reports by bath the City of Tustin and City of Irvine. The hydrology analysis will extend to Peters Canyon Wash and will include a unit hydrograph and basin routing analysis to detain the upstream flows, as well as in the interim condition. Provide structural engineering services for the completion of the reinforced concrete storm drain box culverts far Lines A, C and M. Engineering services and preparation for two (2) Verdura retaining walls, as depicted on the rough grading plans prepared by H&A. Review of available geotechnical information to identify engineering properties of onsite and/or import soils for retaining wall design, including #oundation, retained backflll and reinforced soils in the wall. Review of site geometry, topographic maps, wall profile, and other data made available to SRD for the purpose of determining backfill suitability, surcharge conditions, and developing structural design. Engineering analyses for the structural design of the Verdura Retaining Wall System, including analyses for internal, external, and seismic wale stability, presented within one report for submittal to the jurisdiction. H&A to provide coordination with the soils engineer of record, as well as Soils Retention Design's Inc. and the landscape architect of record. D. Preparation of the SWPPP by a Qualified SWPPP Developer (QSD) as required by the CGP. The SWPPP will be designed to address the following objectives. A. Alt pollutants and their sources, including sources of sediment associated with construction, construction site erasion and al! other activities associated with construction activity are controlled; B. Where not otherwise required to be under a Regional Water Board permit, all non-storm water discharges are identified and either eliminated, controlled, or treated; C. Site BMPs are effective and result in the reduction or elimination of pollutants in storm water discharges and authorized non-storm water discharges from construction activity to the BATBCT standard; D. Calculations and design details as well as BMP controls for site run-on are complete and correct, and E. Stabilization BMPs installed to reduce or eliminate pollutants after construction is completed. F. Provide the QSDIQSP state mandated training for up to three (3) City representatives. B. Revise plan and profile and structural talcs to reflect above changes. C. Revise overall and individual lot disclosure exhibits identifying location of proposed sound wall to reflect above changes. Following a plan check review of the initial tentative map and final map submittal, H&A has been instructed by City staff to revise both maps to add back in most of the lettered/open space lots that were previously shown. Sewer force main abandonment. • H&A to include specs and design for the abandonment of the existing sewer force main from the existing location of the sift station to an existing manhole approximately 600' west of the centerline of Kensington. A detail far the reconfiguration of the manhole will be included. This is an additional proposal to Task 3.4 ................................ $ 3,200 2. Modify Traffic Signal at Valencia Avenue and Kensington Park. • Prepare plans for modified traffic signal at Valencia Avenue and Kensington Park. • Obtain the existing Vaffic signal plan from the City of Tustin. • Field review the existing conditions at the protect site. The findings would be incorporated into the design. • Prepare a traffic signal plan for the intersection of Valencia Avenue and Kensington Park at a scale of 1" _ 20'. Schematic traffic signal interconnect details would be added to the Traffic Signal plans, as needed. • Provide a title sheet showing the notes and details as appropriate for the design plans. Street Improvement and Striping Plan • Revise median and curb alignment at the westerly intersection of Valencia Avenue and Tustin Ranch Road in order to accommodate 2 left pocket lanes as well as 2 thru lanes as requested by City traffic engineer, revise street improvement plans and profile far the revised curb median alignment. • Revise ultimate striping plan to reflect changes above. Invoicing will be on a monthly basis and payable within 30 days after receipt of our invoice. Should payment not be received within thirty (30} days, a one and one-half percent (1'/z%} per month late fee will be charged on any unpaid balance. Our standard hourly rate is subject to an increase on July 27, 2011.
