STACK, DIRECTOR OF PUBLIC WORKS /CITY ENGINEER SUBJECT: APPROVAL OF AMENDMENT NO. 1 TO CONSULTANT SERVICES AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES FOR TUSTIN LEGACY BACKBONE INFRASTRUCTURE BETWEEN THE CITY AND NMG GEOTECHNICAL, INC. SUMMARY Approval is requested of Amendment No. 1 to a Consultant Services Agreement between the City and NMG Geotechnical, Inc. for Tustin Legacy backbone infrastructure. The Amendment will provide additional engineering services related to infrastructure design requirements for Tustin Ranch Road roadway improvements and rough grading design work. RECOMMENDATION It is recommended that the City Council: 1. Approve Amendment No. 1 to a Consultant Services Agreement for Tustin Legacy backbone infrastructure between the City and NMG Geotechnical, Inc., increasing the not to exceed amount by $68,500 to $117,200, and authorize the City Manager to execute the document on behalf of the City. 2. Appropriate $68,500 from unappropriated funds in the MCAS 2010 Tax Allocation Bond Proceeds Fund (561) to the Tustin Ranch Road Extension Project Capital improvement Program Fund (CIP No. 70100). FISCAL IMPACT The consulting services will be compensated on a time and material basis with a not to exceed budget of $68,500. The Scope of Services will require an appropriation from unappropriated funds in the MCAS 2010 Tax Allocation Bond Proceeds Fund. An itemized list of approved Tustin Legacy agreements for professional consulting services, including pending approvals, is attached for reference. DISCUSSION On September 7, 2010, the City Council approved a Consultant Services Agreement with NMG Geotechnical, Inc. to provide geotechnical engineering services related to various roadway improvements at Tustin Legacy including Tustin Ranch Road, Armstrong Avenue, Valencia Avenue, Warner Avenue, and Barranca Parkway. Subsequently, the City requested and NMG Geotechnical, Inc., Amendment No. 1 February 1, 2011 Page 2 received a proposal for engineering services specifically related to wall and bridge foundation designs as well as further geotechnical investigations and design for the entire proposed Tustin Ranch Road rough graded area from NMG Geotechnical, Inc. based upon its familiarity and experience with the work required. Due to its vast knowledge of the project and its current working relationship with the City, NMG Geotechnical, Inc. was determined to be the most qualified to provide the required services at this time. WHEREAS, City and Consultant entered into a Consultant Services Agreement on September 7, 2010, to provide consulting services to the City for engineering services for the Tustin Legacy Disposition Strategy and Business Plan; and WHEREAS, the City requested certain additional engineering services related to additional infrastructure design requirements for Tustin Ranch Road roadway improvements and rough grading design work; and WHEREAS, NMG Geotechnical, Inc. submitted an authorization request for additional engineering services dated November 23, 2010, attached hereto as Exhibit "A"; and THEREFORE, it is agreed that the Original Agreement be amended as follows to reflect the modifications requested by NMG Geotechnical, Inc. and authorized by the City of Tustin: 1. Modification of Compensation. Section 2 entitled "Compensation" is amended to provide additional engineering services as identified in Exhibit "A" of this Amendment No. 1 up to an additional amount not to exceed $68,500. 2. INTRODUCTION AND PROJECT SUMMARY NMG Geotechnical, Inc. (NMG) has prepared this cost estimate for geotechnical design services for the expanded development associated with the Tustin Ranch Road improvements within the Tustin Legacy development. The expanded development was not part of the original scope of work in the prior proposal prepared in July 2010. The additional scope of work is based on current project design information and our preliminary review of the expanded grading plan for the road and associated building pads prepared by Hunsaker and Associates. The expanded project now includes Neighborhood B, the land parcel north of the loop ramp, four building pads in Neighborhood G north of Warner Avenue, numerous detention basins, the pedestrian bridge embankment, extension of Park Avenue, and a segment of Legacy Road, and other design items described below. At this time, NMG has performed an initial review of the temporary shoring proposed for the Tustin Ranch Road bridge adjacent to the existing railroad easement and provided recommendations for design (of soldier piles and tie-backs), provided geotechnical review and input for the alternative CIDH pile foundations for the bridge, performed geotechnical review for a new Verdura retaining wall, and ongoing meetings and communication with the project design team. Some of the expanded project azea extends into areas of the site that had have no or little prior work and thus will require additional field exploration to identify the subsurface conditions and geotechnical constraints. 17991 Fitch • Irvine.
