STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 11-10 ORDERING THE PREPARATION OF THE ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT LEVY OF ANNUAL ASSESSMENTS FOR FISCAL YEAR 2011-2012 SUMMARY State law requires an engineering analysis each year to identify property benefits and to levy assessments in the Tustin Landscape and Lighting District. Resolution No. 11-10 orders the preparation of the Engineer's Report for the Tustin Landscape and Lighting District Levy of Annual Assessments for Fiscal Year 2011-2012. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 11-10 ordering the preparation of the Engineer's Report for the Tustin Landscape and Lighting District Levy of Annual Assessments for Fiscal Year 2011-2012. FISCAL IMPACT Sufficient funds are budgeted and appropriated in the Tustin Landscape and Lighting District Account to cover this work, which is to be performed for a fee not to exceed $12,000. Additionally, the costs for operating and maintaining the District are offset through the levy of the annual assessments for the District. DISCUSSION The Tustin Landscape and Lighting District provides funding for the maintenance of perimeter landscaping on the arterial highways and for the operation and maintenance of street lighting on public streets within the Tustin Ranch area. This action is the initial phase of the process to determine district expenses and to levy annual assessments for Fiscal Year 2011-2012 in the Tustin Landscape and Lighting District. Adoption of Resolution No. 11-10 formally orders the preparation of the Engineer's Report. Three future City Council resolutions will be required to complete the assessment process: Adoption of a resolution approving the Engineer's Report is tentatively scheduled for May 3, 2011. Tustin Landscape and Lighting District February 15, 2011 Page 2 Adoption of a resolution declaring the City Council's intention to provide an annual levy of assessments is also tentatively scheduled for May 3, 2011, along with a resolution setting the date for a public hearing on June 7, 2011. Adoption of a resolution ordering the levy of annual assessments outlined in the Engineer's Report for the 2011-2012 Fiscal Year. This resolution will be considered for City Council action after the public hearing tentatively scheduled for June 7, 2011. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that the Director of Public Works/City Engineer is hereby ordered to prepare and file, through Harris and Associates, the Engineer's Report for the Tustin Landscape and Lighting District Levy of Annual Assessments for Fiscal Year 2011-2012.
