1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CAL!FORNIA, APPROVING THE ANNEXATION OF
~ CERTAIN UNINHABITED TERRITORY, DESIGNATED "SAN JUAN-
UTT ANNEXATION NO. 98" TO THE CITY OF TUSTIN,
~ CALIFORNIA.
4 The City 'Council of the City' of Tustin, California,
5 does ordain as follows:
6 WHEREAS,' pursuant to the orovisions of the Government
Code of the State of California, application was made to the
~ Local Agency Formation Con~ission to annex to the City of Tusti~
all thatf territory situate in the County of Orange, State of
8 California, hereby designated as "San juan-Utt Annexation No.
98", and described in Exhibit "A" attached hereto and incorpo'c-~
9 ated herein by this reference as though set forth herein in
full; and

WHEREAS, the Local Agency Formation Co~umission, in
11 session duly assembled., on July 28, 1976, did adopt the negati
declaration and approve said proposed annexation; and

WHEREAS, the City Council hereby finds and determines
15 that all of the territory is uninhabited within the meaning of
Government Code Section 35303, and that said territory is con-
14 tiguous to the City of Tustin; and
15 WHEREAS, on 'the 2nd day of August, 1976, the' Counc.~
of the City of Tustin did pass and adopt Resolution No. 76-7~
16 giving notice of the proposal to amnex certain uninhabited
ritory to the' City of Tustin, said territory being therein
1~ designated as "San Juan-Utt Annexation No. 98", said Resolution
describing the boundaries of the territory 'proposed to be
18 annexed; and
19 WHEP~AS, said Resolution Contained a notice of the
day, hour and place when and where the Council of' the City of
~0 Tustin would hear protests made by any person owning real pro-
~! perty within the territory proposed to be annexed, the time of
said hearing being prescribed by law; and
2~ WHEREAS, on the 20th day of September, 1976, at the
hour of 7:30 o'clock, P.M., in the Comncil Chambers, Centennial
~5 at Main in the City of Tustin, County of Orange, State .of
California, said time and place being the day, hour and place
24 fixed in said Resolution for hearing protests to the said annex-
ation, the said City Council did hear and pass upon any and all
25 protests made to the proposed annexation and did determine that
insufficient protests had been made by the owners of the
~6 privately and publicly owned territory proposed to be annexed
as determined by said legislative body; and

WHEREAS, said terrftory is contiguous to the City c
~8 Tustin, and is uninhabited territory in the County of Orange;

WHEREAS ~ the property within the annexed territory
~0 shall be taxed to pay the indebtedness and liability of the
City contracted to or existing at the time of annexation

1 MOW, THEREFORE, the said Council of the City of
Tustin, does hereby approve the annexation of the territor~
~ hereinafter described to the City of Tustin, and does hereby
further ordain that said territory be and it is hereby annexed
5 to the City of Tustin.
4 That said .territory, 'the annexation of which to the
City of Tustin is hereby approved, is all the territory situate
5 in the County of Orange, 'State of California, more particularly
described in Exhibit "A" 'attached hereto and made a part hereof
6 by this reference.
~ That-the property within the annexed territory shall
be taxed to pay the endebtedness and liability of the City
8 contracted to or existing at the time of annexation.
9 PASSED AND ADOPTED at a regular meeting of the City
10 Council of the City of Tustin, California, held on the- 4th day of October, 1976.
