ORDINANCE NO. 687
1 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
RELATING TO THE DISPOSITION OF UNCLAIMED PROPERTY.
The City Coun'cil 'of the City of Tus.tin does hereby
ordain as follows:
"1o A~ticle 1, Chapter 6, Section 1626 (b) of the Tustin

City Code is hereby amended to read as follows:

(b) DISPOSITION OF UNCLAIMED PROPERTY
(1) Unclaimed Property Defined -- "Unclaimed

.property" is all personal property, the title of which is not

vested in the. City of Tustin~ which property has come into the
10
possession of the City of Tustin' as lost property, property which
11
has been confiscated or impounded by the City' as being in vio-
lS
lation of law or any other personal property coming into possessio
'~t of the City of Tustin which is not specifically provided for by
any other provision of lawo

(2) Procedure

(a) If the estimated value of the unclaime
property exceeds Ten Dollars (10o00) the Polfce Department or
18
the administrative official who obtained possession of the
19
property shall~ within ten (10) days of receipt of the property,
notify the owner~ if his identity is reasonably ascertainable,
that it possesses the property amd w~ere it may- be obtaineS,j
The Police Department or the administrative official may require
payment by the owner of a~-reasonable charge to defray costs of
25 storage a~d' care of the property..
(b) If the owner appears .~ithin ninety
days of the notification given in subparagraph (b) (2) (a) ,

proves his ownership of the property, and pays. all reasonable '

charges~ the Bolice Department or the administrative 6fficial
shall restore the property to him.

1 (c) After retention of the property for four
Z (4) months, the property may be:
~ (i) sold at public auction to the
-- 4 highest bidder,
5 (ii) retained by the City of Tustin if
6 it is determined that the property is needed for
~ a public use. '
8' (3) Public Sale
9 (a) When it is determined that unclaimed
10 property shall be sold at public auction, the Police-De
11 or the administrative official, shall cause notice of such
1Z sale to be published at least five (5) days before the time
13 fixed therefor once in a newspaper of general circulation
14 published in the count~ in which such pr'operty was found or
15 confiscated, or otherwise in Orange County.
_, 16 (b) Such notice shall. contain the time and
17 the place of the sale.
18 (c) Any property remaining unsold after
19 being offered at such public auction may be destroyed or
~0 otherwise disposed of by the City.
~1 PASSED AND ADOPTED at a r~gular meeting of the City Council,
~2 City of Tustin, California, held on the 2nd day of August, 1976.
