STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 11-11 APPROVING LOT LINE ADJUSTMENT NO. 2010-03 SUMMARY A lot line adjustment has been requested by the property owner to merge the three (3) existing parcels into one (1) parcel at 200-220 EI Camino Real. The merger is required to ensure that the existing building meets the current California Building Code (CBC) requirements. The proposed lot line adjustment application has been submitted by Robert Douglas Feinstein, successor trustee of the Nancy F. Feinstein Trust established January 11, 2002. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 11-11 approving Lot Line Adjustment No. 2010-03. FISCAL IMPACT There is no fiscal impact associated with this item. DISCUSSION The California Subdivision Map Act allows a local agency to approve lot line adjustments and parcel mergers. Currently, the building at 220 EI Camino Real is located on a property line (see attached Exhibit C). However, the CBC does not permit a building wall with an opening to be located less than three (3) feet from a property line. Therefore, in order to comply with the current CBC the property owner is requesting approval of a Lot Line Adjustment which will remove the common property lines between Lot 4 (APN: 402-572- 01), Lot 5 (APN: 402-572-02), and Lot 6 (APN: 402-572-02), resulting in the building on a single parcel in compliance with the CBC. Lot Line Adjustment 2010-03 March 15, 2011 Page 2 The Lot Line Adjustment Application has been reviewed by the Community Development Department, Redevelopment Agency, and the Public Works Department. The proposed adjustment has been determined to be in compliance with all zoning requirements of the City, the provisions of the California Subdivision Map Act, and the California Environmental Quality Act. Biggs ity Manager S:\City Council Items\2011 Council Items\LLA2010-03 & Reso 11-11.docx RESOLUTION NO. 11-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 2010-03 WHEREAS, Section 66412(d) of the California Subdivision Map Act makes provisions for a local agency to approve lot line adjustments where the land taken from one parcel is added to an adjacent parcel and where no additional parcels are created; and WHEREAS, the City Council of the City of Tustin has reviewed Lot Line Adjustment No. 2010-03 and has made findings that the real property, described in Exhibit "A" and shown on Exhibit "B", comply with the provisions of the California Subdivision Map Act and applicable City of Tustin Ordinances and Regulations including the requirements for building sites; and WHEREAS, the City Council of the City of Tustin has made the following findings: 1. That the proposal is eligible for processing as a lot line adjustment pursuant to Section 66412(d) of the California Subdivision Map Act; 2. That the requirements of the California Environmental Quality Act have been met; 3. That the proposal is consistent with the City of Tustin General Plan; and 4. That the resultant parcel will meet the requirements of the City of Tustin Zoning Code. NOW, THEREFORE, BE IT RESOLVED that proposed Lot Line Adjustment No. 2010- 03, as shown on Exhibits "A" and "B", is hereby approved and that the resulting parcel be considered a building site, subject to the following: The applicant shall prepare and record a new deed reflecting Lot Line Adjustment No. 2010-03, as shown on Exhibits "A" and "B"; and 2. This Resolution shall become null and void if the deed reflecting Lot Line Adjustment No. 2010-03 is not recorded with the Recorder's Office of Orange County, California within six (6) months of the date this Resolution is adopted.
