SHINGLETON, ASSISTANT CITY MANAGER SUBJECT: STATUS REPORT ON REDEVELOPMENT AGENCY PROJECTS SUMMARY: Redevelopment Agency staff provides on a monthly basis an update of redevelopment related projects. RECOMMENDATION: Receive and File. FISCAL IMPACT: There is no fiscal impact associated with this agenda item. BACKGROUND: The attached status report focuses on the status of projects that Agency staff and Board members are working on and other Agency items of interest. March 2011 Status Report on Redevelopment Agency Projects Tustin Community Redevelopment Agency March 2011 Status Report Town Center & South Central Redevelopment Project Areas ACTIVITY STATUS Prospect Village Project • The Agency has awaited information from the Developer (Prospect Village LP) required to issue a Partial Certificate of Compliance on the Live/Work portion of the project in accord with the DDA. Applicant has informed staff that they will not provide the necessary information in order for the City to issue the Certificate of Compliance. • Prospect Village LP and the new owner of the Main Street commercial building have executed an Assignment and Assumption Agreement on the DDA. The new owner has fulfilled the obligations under the Assignment and Assumption Agreement and the City issued a Certificate of Compliance on the two-story commercial building. The last available retail space in the Main Street commercial building has been leased and is undergoing tenant improvements. Newport Avenue Extension • Continued coordination with Public Works on completion of the Phase I Newport Avenue/SR-55 Ramp Reconfiguration Project and Phase 2 design work, including a property acquisition strategy. • The Agency continues to manage two occupied fourplexes at 14741 and 14751 Newport Avenue that were purchased for required right-of--way in Phase 2. The three bedroom unit has been rented, leaving two vacant units. Units have been repaired, painted and, where necessary, new flooring was installed. Vacant units are being marketed for month-to-month rental. Tustin Library The Library CIP Project has not been completely closed out yet pending additional work not part of the gkkworks' contract, including, but not limited to, IT connections and installations. City also continues to work on a number of warranty issues with the architect, including but not limited to HVAC issues. The American Public Works Association (APWA) has awarded the project the "2010 B.E.S.T. APWA Project of the Year Award." Neighborhood Improvement Agency staff continues to participate in these Task Forces on an ongoing basis. Task Force & Tustin Against Graffiti Commercial Rehabilitation An update to the Program is currently being reviewed. Modifications include revised boundaries for the Program program to provide flexibility to utilize RDA funding for RDA Project Areas and also CDBG funding within CDBG Target Areas. Page 1 Tustin Community Redevelopment Agency March 2011 Status Report Town Center & South Central Redevelopment Project Areas ACTIVITY STATUS Town Center Refunding Agency staff has been working with Finance and a fmance team on the potential refunding of the 1998 Town Center Bonds. Project could be impacted by Governor's budget proposal. Tustin Town Cuter -New • Staff is working with City Departments to finalize a more defined schedule for prioritizing General Plan and Beginnings Study major zoning modifications, including preparation of new development standards and any necessary environmental impact analysis and documentation. • Letters have been prepared and mailed out to all property owners living in the three neighborhoods, notifying them of the City Council's endorsement of the "Strategic Guide for Development" and the City's desire for the continued involvement of the property owners in the process. • Staff partnered with Public Works to submit three (3) proposals for FY 2011-2012 Community Development Block Grant (CDBG) funding. CDBG funding is recommended by Public Works/RDA to prepare an engineering Project Study Report for certain right-of--way and gateway improvements in the Center City Neighborhood and two engineering Project Study Reports for the West Village Neighborhood (Tustin Village Way and McFadden Avenue). These reports will include specific design and evaluation of installation of improvements and amenities in these Neighborhoods as recommended under Short Term Actions in the Implementation Plan of the "Strategic Guide for Development". Page 2 Tustin Community Redevelopment Agency March 2011 Status Report Town Center & South Central Redevelopment Project Areas ACTIVITY STATUS Pacific Center East • Staff continues to field numerous broker and developer calls and inquiries regarding the former AAE properties and potential interest in development. • Preliminary discussions with Schools First Federal Credit Union ("Schools First") have occurred regarding its interest in purchasing a vacant parcel next to its property at 15442 Newport Avenue. A draft Exclusive Negotiation Agreement ("ENA") with Schools First was transmitted to Schools First, and subsequent issues have developed which are in review by the Agency. This item has been placed on hold pending resolution of Del Amo right-of--way issues. • On November 2, 2010, an Exclusive Negotiation Agreement ("ENA") was approved with R.D. Olson Development for development of 2 hotels (300 rooms) and approx. 8,000 sq. ft. of restaurant/retaiUconference space on the west side of Newport Avenue, north of the new SR-55 eastside ramps, south of Edinger Avenue. At Developer's request, a 60 day extension of time has been granted under the ENA. A preliminary DDA draft is in circulation at the staff level and will be transmitted later in the month for City Attorney review. In accord with the ENA, an opinion of the market value of the property has been completed by an independent third party appraiser, Pacific Real Estate Consultants, and is under review. Preparation of a parcel map for the former AAE property is nearing completion. • Lee & Associates is marketing the approx. 85,000 square foot facility at 15171 Del Amo Avenue for short term uses only. An offer has been received to rent a 28,000 sq. ft. portion of the building for a term of approximately 18 months. A rental agreement will be subsequently brought to the City Council for approval. Staff continues to work with Public Works and the Police Department to keep the property maintained and secured while vacant. • RBF Consulting has begun design services of a comprehensive Gateway and Landscape Concept Plan that will enhance the streetscape within the Newport Avenue/ SR-55 Freeway northbound ramp area including landscape, hardscape, landscape signage, irrigation systems, lighting, and gateway monumentation within the median islands, corner cut out areas, and the Caltrans ramps along Newport Avenue between Edinger Avenue and Valencia Avenue. Staff has met with Public Works staff and RBF to discuss scope and schedule of the project. Page 3 Tustin Community Redevelopment Agency March 2011 Status Report Town Center & South Central Redevelopment Project Areas ACTIVITY STATUS Stevens Square Pay^king • Agency staff has been contacted regarding development on an underutilized property fronting on Main and Structure El Camino Real (the Radars property) which is adjacent to the Stevens Square Parking Structure. The development would provide an opportunity to facilitate improved access to the Stevens Square Parking Structure. Staff is exploring options for facilitating the proposed construction. Staff has completed title work and a record constraints map to determine the property ownership and easement interests in the alley behind the commercial business along Main Street to facilitate coordination of any development proposal on the Radars property with other commercial uses that utilize the adjacent alley and Steven Square Parking Structure. In discussions with the property owner's architect, the applicant is exploring his financing options to determine whether to move forward. No change in status. • Staff is working with Community Development and the City Attorney to address the current condition of the parking structure as well as on-going maintenance issues. The City Attorney has prepared a draft Participation Agreement that will identify how costs addressing the current condition are to be shared by the property owner and the Agency since the Agency has a 1/3 ownership interest in the parking structure. The City Attorney will also work with the property owner to revive the required Community Association for the structure that will be responsible for collecting association fees and overseeing on-going maintenance. After staff has met with the property owner and obtains their support for the Participation Agreement, it will be brought to the Agency for approval In addition, a Consultant Agreement will be prepared to procure the services of a structural engineer who will develop a report identifying any immediate repairs and associated costs necessary to bring the structure into compliance with City Code as well as the ongoing maintenance needs and associated costs. Page 4 Tustin Community Redevelopment Agency March 2011 Status Report MCAS Tustin Redevelopment Project Area ACTIVITY STATUS The Dish^ict at Tustin Legacy . Vestar continues to work with the Army on short term solutions for continued use of the surface parking area adjacent to the Lifestyle Center and has asked that the City not assist or participate in these discussions. • Reviewed entitlement applications for uses and special events at The District and provided comments to Community Development. All requests were reviewed for conformance with the DDA and the Redevelopment Plan for MCAS-Tustin. No change in status. • Coordinated with Public Works on status of public improvement obligations, Vestar/Kimco obligations and City reimbursement obligations under the DDA and Infrastructure Construction and Reimbursement Agreement. • Agency staff continue to explore options that might facilitate land exchange between the Army and Vestar and/or the City on the 14.5 acre Army Reserve site adjacent to the District. County of Orange • The County has retained a consultant (Tait and Associates) to review the preparation of a Concept Plan for the urban regional park and the feasibility of retaining and reusing the blimp hangar for public use. Agency and City operational departments met with the County and its consultant, and have responded to requests for copies of various City documents to support the City's planning efforts for future park programming anticipated for the regional park site and in developing a cooperative agreement with the County for this planning process. Local Agency Military Base • Provided a monthly status report to the California Department of Housing and Community Development Recovery Area (LAMBRA) (HCD) and continue to respond to periodic inquiries from tax consultants representing potential and existing businesses. An updated and revised LAMBRA policies and procedures manual and updated LAMBRA marketing plan are currently being reviewed. The Governor's proposed 2011-2012 state budget recommends eliminating LAMBRAs. Tustin Unified School District . Awaiting direction from City CounciUAgency Board on quitclaim deeds and conveyance agreements previously transmitted to TUSD in June 2008. No specific modifications provided to date from TUSD. No change in status. • Staff completed review of the Final Draft of the TUSD 2010 School Facilities Needs Analysis; comments were incorporated into the City's response to TUSD and TUSD's attorney has provided a response currently under review by the City Attorney. Page 5 Tustin Community Redevelopment Agency March 2011 Status Report MCAS Tustin Redevelopment Project Area ACTIVITY STATUS Lennar/Marble Partners/Meta The City Council approved the entitlements necessary. Staff will be meeting with Meta Housing to review the Housing responsibilities and requirements outlined in the Regulatory and Supplemental Agreements for the Coventry Court 240 unit project. No change in status. Fire Station 37 Relocation Continued Fire Station design process with design consultant, City, and Orange County Fire Authority staff. Design Development Drawings have been approved by the City and OCFA, and the City and OCFA completed reviewing the 90% Construction Documents and Specifications and provided comprehensive comments to the design consultant on February 9, 2011. Property Management Continued to perform property management oversight at City owned properties (approximately 46 acres) outside of the former Master Developer footprint. No change in status on the 46 acres; however, the City Council on December 7, 2010 approved a Consultant Services Agreement for permanent property management and caretaking services for the former Master Developer footprint. The new caretaker, So Cal Sandbags, Inc, assumed caretaking services beginning January 3, 201 L No change in status. Legislation Federal • The Association of Defense Communities (ADC) has commented on proposed legislation by Governor Brown to abolish redevelopment agencies throughout the state and the negative impact such legislation would have on the redevelopment of former military bases in the creation of jobs. • New Economic Development Conveyance (EDC) rules were published by the Department of Defense (DoD) on December 10, 2010 in the Federal Register. The amendments could have impacts on any future amendments to the City EDC Agreement with the Navy and staff transmitted comments to DoD based on feedback from our special base closure counsel in Washington. Page 6 Tustin Community Redevelopment Agency March 2011 Status Report MCAS Tustin Redevelopment Project Area ACTIVITY STATUS Navy (DoN) Reviewed, disseminated to applicable stakeholders, and followed-up with the City's special Washington D.C. counsel, including: the DoN, the Environmental Protection Agency (EPA), the Department of Toxic Substances Control (DTSC), and the Regional Water Quality Control Board (RWQCB) on the following documents, as needed: o Draft Finding of Suitability to Transfer (POST) #9: RDA staff and special counsel, in cooperation with representatives from the County of Orange and South Orange County Community College District (SOCCCD), are nearing resolution of outstanding issues. Issuance of a Final POST #9 would facilitate conveyance of certain properties to various parties, including the City, SOCCCD, and County of Orange. RDA staff has been working with engineering consultant, PSOMAS, in preparation of required legal descriptions. o Final 2010 Third Quarter Groundwater Monitoring Data Summary (OU-IA/-1B) o Fina12010 Third Quarter Groundwater Monitoring Data Summary (UST 222) o Draft 2010 Annual Groundwater Monitoring Report OU4B o Draft Pre-Remedial Design Pilot Study Report OU4B Tustin Legacy Website Staff is finishing the work on updating the website. The structure, navigation, and content of the draft site is also about 90% complete and it is expected that the website will go "live" to the public in mid March 2011. The new website will include information for the general public related to current and future residential developments, public services and utilities, business opportunities, leisure activities, educational institutions, and relevant news, documents and plans impacting Tustin Legacy. The website will continue to be updated on an as-needed basis. Page 7 Tustin Community Redevelopment Agency March 2011 Status Report MCAS Tustin Redevelopment Project Area ACTIVITY STATUS Former Master Developer . Continued to coordinate with the Department of Navy (DoN) on its review of a Project Environmental Footprint (820 acres) Review Form (PEKE) for mass grading, utility and building demolition, and erosion control on Navy-owned property within the Master Developer Footprint, and continued to coordinate response to the Base Cleanup Team (BCT) with the City's special Washington D.C. counsel, including: the DoN, the Environmental Protection Agency (EPA), the Department of Toxic Substances Control (DTSC), and the Regional Water Quality Control Board (RWQCB). The 11"' version of the PERF was resubmitted on January 31, 2011, reflecting all outstanding Navy, DTSC, RWQCB comments; final approval is forthcoming. Authorization from the BCT is one of the few outstanding requirements prior to issuance of a rough grading permit for the Master Developer footprint. No change in status. • City staff has completed an inventory and index of all hardcopy and electronic documents and plans submitted to the City by TLCP with the reconveyance of the property, and is coordinating with former TLCP consultants on retrieving all undelivered editable electronic documents. Staff is finishing a tracking table of all documents obtained to date. • City and Agency staff and select subconsultants (engineering, land use planning, market analysis, and financial) continued work on preparation of a proposed framework revising the City's disposition and business plan strategy for the site. • Coordinated with Public Works and Irvine Ranch Water District (IRWD) for the installation of a new well (Well TL-1) at the northeast corner of Barranca Parkway and future Aston Ave. RDA staff has prepared an access and construction license and exclusive easement for well purposes. The license has been tendered to IRWD for execution and a draft exclusive easement has been transmitted to IRWD for review. The exclusive easement will require approval by the City Council once accepted by IRWD. Page 8 Tustin Community Redevelopment Agency March 2011 Status Report MCAS Tustin Redevelopment Project Area ACTIVITY STATUS 25-Acre Community Park Site . Agency staff continued to work with the Parks and Recreation Department and design consultant to finish master park design of the future 25-acre community park site, including resubmitting the required "Project Environmental Review Form" (PEKE) to the Navy for approval of geotechnical investigation in response to comments received from the Navy. The PERF was resubmitted to the Navy on January 27, 2011; final approval is pending. • Agency staff worked with the Parks and Recreation Department in drafting a revised "Federal Lands to Parks" application and environmental screening form to the National Park Service as required prior to receiving conveyance of the future community park site from the Department of the Navy. The draft application is an update to the initial application prepared and approved in 1994-1996. South Orange County • Staff continued to monitor SOCCCD compliance with the Conveyance Agreement and Sublease in Community College District coordination with Public Works, Community Development, the City Attorney and the City's Washington (ATEP Campus) D.C. special legal counsel, Kutak Rock. Staff continues to meet and discuss potential future amendments to the Conveyance Agreement with SOCCCD. • Coordinated with SOCCCD on insurance renewals pursuant to the LIFOC. • Staff is coordinating with SOCCCD and the Navy on the demolition of existing structures on the SOCCCD properties and the LIFOC property. Demolition is nearing completion on the deeded property; demolition on the LIFOC properties is expected to commence in Spring 2011. • The County and SOCCCD entered into a Memorandum of Understanding regarding a potential land exchange and the City will work to support implementation activities necessary for the success of the proposed exchange. RDA staff worked with the engineering consultant, PSOMAS, to revise a detailed land swap exhibit; the revised exhibit has been forwarded to SOCCCD for review. Page 9 Tustin Community Redevelopment Agency March 2011 Status Report Housing ACTIVITY STATUS Affo~^dable For Sale Housing Resales • There are currently twelve (12) affordable re-sale homes on the market: six (6) moderate-income homes at Tustin Field I, one (1) moderate-income home at Tustin Field II, one (1) moderate-income home at Clarendon in the Villages of Columbus, one (1) moderate-income home at Camden in the Villages of Columbus and three (3) moderate-income homes at Arbor Walk. Staff is working with existing homeowners to process paperwork as needed. Staff will continue to review the documentation submitted in order to verify buyers' eligibility to participate in the affordable housing program as we receive it. Lenders • Staff has been working with eight (8) lenders who have knowledge of the documentation and requirements related to the program. A list of eight (8) lenders can be found on the City's website and is intended to be used only as a resource document by potential buyers and is not meant as a recommendation or endorsement by the Agency or City. Staff will continue its outreach efforts to additional lenders that maybe interested in being added to the list as well. Staff is also working with the Neighborhood Housing Services of Orange County (NHSOC) to identify lenders who support their program and who would be interested in working with the City's Affordable Housing Program. To date, one lender has reviewed and approved the program documentation. Staff will continue to work with NHSOC in its efforts to reach out to additional lenders. No change in status. Mortgage Credit Certification In December 2009, the California Debt Limit Allocation Committee (CDLAC) awarded Orange County an (MCC) Program additional $14,000,000 in mortgage credit certificates. The National Homebuyers Fund, Inc. (NHF) is now administering the program for the County. Only NHF-approved lenders can participate in issuing mortgage credit certificates to qualified first-time homebuyers. Staff has submitted a list of lenders who currently work with the Agency for NHF to contact. To date, three (3) lenders have been approved by the NHF to participate in issuing mortgage credit certificates. The Agency website has been updated with the new administrator's (NHF) MCC program information. No change in status. Page 10 Tustin Community Redevelopment Agency March 2011 Status Report Housing ACTIVITY STATUS Monitor Foy^eclosure Activity . Assembled, prepared and submitted the monthly foreclosure report to the City Council. The reports are used to monitor trends and spot potential issues regarding pre-foreclosure and foreclosure activity among residential and commercial uses. • In response to potential foreclosure activity against two (2) City of Tustin affordable housing units, the City Council authorized the City Manager on December 7, 2010 to execute any required documents, as may be necessary, recommended by the City Attorney that will insure these units remain part of the City's affordable housing inventory. There is still one (1) unit at risk and staff continues to work with the City Attorney's office to monitor the situation and will proceed with Council-approved actions if necessary. In January, the Agency received a Notice of Default for another City of Tustin affordable housing unit and, on March 1, 2011, the City Council authorized the City Manager to execute any required documents, as may be necessary, recommended by the City Attorney that will insure the unit remains part of the City's affordable housing inventory. Preservation of At-Risk Initiated discussions with Tustin Gardens and Irvine Company Apartments: Rancho Alisal, Rancho Maderas; Affordable Housing Units and Rancho Tierra, regarding the extension of affordability restrictions as part of Housing Element implementation activities. Neighborhood Stabilization The Agency is monitoring the County's application with the State and will retain the right to participate in the Program (NSP) county-wide program once additional information is made available from the County. No change in status. Homeless Prevention and The County awarded funds to Families Forward, Mercy House and Friendship Shelter to administer this county- Rapid Re-Housing Program wide program. Funded under the American Recovery and Reinvestment Act of 2009, the program provides financial assistance to households at risk of becoming homeless and who need temporary rent or utility assistance. Staff meets bi-monthly with TEAM to insure Tustin residents, who risk eviction, access the program. No change in status. Page 11 Tustin Community Redevelopment Agency March 2011 Status Report Housing ACTIVITY STATUS Orange County The Agency continues to participate in an ongoing basis with these programs and initiatives. Staff worked with Homeownership Preservation the Tustin Effective Apartment Managers (TEAM) to identify apartment complexes willing to lease to families Collaborative (OCHOPC) & who have gone through a foreclosure and provided that information to OC HOPC. No change in status. OCBC Workforce Housing Committee Residential Rehabilitation Rehabilitation work has been completed on a fourplex in the South Central Project Area. Staff has prepared and Program the City Attorney's office has reviewed a comprehensive update to the City's Housing Rehabilitation Program. The revisions to the Rehabilitation Program will be brought forward in the future for City Council review and approval. Affordable Homeowners • One (1) refinance transaction was approved by the Agency on behalf of affordable owners. Refinancing . Five (5) additional refinances were transmitted with final documentation which staff is currently reviewing. It is expected that these refinances will be approved very soon. • Initial documents for three (3) refinance transactions from lenders on behalf of affordable owners have been submitted. Staff expects to receive final documents in the near future. Housing Section on the City The Housing Section on the City's website has been expanded and updated. The new information includes fact website sheets for potential buyers and lenders, a preferred lenders list for potential buyers, refinance information, re-sale report of current available properties in the City, details regarding our residential rehabilitation program as well as other useful information. Reimbursement Agreement The Agency approved a Second Amendment to the Reimbursement Agreement, identifying an additional $195 between the City and million dollar obligation on behalf of the Redevelopment Agency to the City for the provision of four hundred Community Redevelopment fifty-three (453) affordable housing units to be built at Tustin Legacy. Agency Page 12 Tustin Community Redevelopment Agency March 2011 Status Report Economic Development/ and Other Miscellaneous Administration Topics ACTIVITY STATUS Legislation • On August 30th, the California Redevelopment Association (CRA) submitted its opening brief on appeal with the Third District Court of Appeal to overturn a $2.05 billion raid of redevelopment funds by the State. CRA is appealing a May 2010 Sacramento Superior Court decision by Judge Lloyd Connelly which upheld the legality of Assembly BillX4-26. ABX4-26 was passed in July 2009 as part of the 2009/10 state budget and authorized a total of $2.05 billion in local redevelopment tax revenue shifted to fund the state's obligation to schools. In requiring this transfer of redevelopment funds from local communities ultimately to fill state budget holes, ABX4-26 violates the State Constitution. Although CRA expected the Attorney General to file a response to CRA's appeal by November ls`, there has not been any indication the Attorney General has filed a response. CRA hopes the Court of Appeal will rule by May 2011 before the next payments are due. Agency staff will continue to monitor. • On January 10, 2011, Governor Brown proposed a complete elimination of redevelopment in California as part of his 2011-2012 budget proposal. The Assembly and Senate Budget Committees voted on February 18, 2011 to support the Governor's proposal. The Assembly Budget Committee voted to take $1.7 billion in local redevelopment funds with "Placeholder Trailer Bill Language" which recommends redevelopment reform in lieu of elimination. The Senate Budget Committee's vote was completely in line with the Governor's proposal to completely abolish redevelopment. Both Budget Committees voted on the proposal without seeing the actual bill language from the Governor's office. On February 23, 2011, the Governor released the proposed bill language. The Conference Committee is currently working to resolve the differences between the Senate and Assembly Budget Committees' passage of the Governor's proposal. Governor Brown is also proposing the elimination of enterprise zones, which could include the elimination of the Tustin Legacy LAMBRA. Page 13 Tustin Community Redevelopment Agency March 2011 Status Report Economic Development/ and Other Miscellaneous Administration Topics ACTIVITY STATUS Tools for Business Success Agency staff has reviewed and is procuring "Tools for Business Success", a California Association for Local Economic Development (CALED) endorsed website resource, which has an array of information and services for businesses and potential entrepreneurs. Visitors to the site can learn about the forms needed to comply with federal and state laws, loans and financing programs, how to market globally, disaster planning and recovery, making sustainable business decisions, and much more. It is anticipated that the site will be functional on the City website by the middle of March. Other Financings Agency staff approved the City joining the Joint Powers Authority for the California Municipal Financing Authority (CMFA), and also as a conduit, the City approved issuance by CMFA of tax exempt financing for the expansion/rehabilitation of the Red Hill Lutheran facility on Red Hill Avenue. Economic Development • Collateral materials, including a marketing brochure and revisions to website materials are currently being Material/other Marketing and reviewed for updates. These materials will be used to support the Agency's outreach efforts for business Information retention and expansion, respond to questions on the status of the Tustin Legacy Project and provide additional updated information on the City's housing programs. • The City is also receiving questions regarding the status of Tustin Legacy related infrastructure projects and services funded by several of the Tustin Legacy related Community Facilities Districts. Responses to most commonly asked questions was completed for use by first responders and is currently accessible on the city website. Mayor's Letter to New Mailed ten (10) Mayor's letters to new businesses. Businesses Page 14 Tustin Community Redevelopment Agency March 2011 Status Report Economic Development/ and Other Miscellaneous Administration Topics ACTIVITY STATUS Wireless Master Plan Staff is currently working with the City's consultant, ATS Communications, in securing additional carriers for Implementation locations identified in the Wireless Master Plan as being deficient in terms of coverage. Staff is currently reviewing proposed carrier proposals at Citrus Ranch Park, Pine Tree Park, Heritage Park, and Cedar Grove Park. The City Council on February 1, 2011 approved a license agreement between the City and MetroPCS for the location of a new wireless antenna to be located on a new light standard, installed by MetroPCS, at the Tustin Sports Park. The light standard will be located adjacent to a walking trail. The initial term of the license is for 10 years and will yield $259,332; the license can be extended by MetroPCS for two 5 year terms. The carrier located at this site will be MetroPCS. The City Council on February 15, 2011 approved a license agreement between the City and STC One (Sprint), currently located at the Tustin Sports Park. The STC One antennas are currently located on three light standards adjacent to the existing sports fields; the equipment supporting the antennas is located behind the existing scoreboard. The license agreement allows for the location of two carriers, Sprint and Clearwire. Sprint is currently operating as carrier; Clearwire is the proposed carrier for collocation at the same site and on the same light standards. The initial term of the license is for 10 years and will yield $259,332 for the primary carrier, Sprint; this license can be extended at the option of STC One for two 5 year terms. The initial term for the proposed collocation carrier, Clearwire, is 10 years and will yield $133,458; STC One has the option of extending collocation of Clearwire at this site for two five year terms. On January 25, 2011, the Planning Commission meeting continued the Agenda item regarding a proposed cell site to be located at Cedar Grove Park; the applicant is T-Mobile. Recently, the applicant requested to withdraw its plans for the proposed site at Cedar Grove Park. Staff expects the applicant to submit new plans for a different site at Cedar Grove Park in the future. All proposed license agreements will be brought to the City Council for consideration. Continued to participate in the Chamber's Business and Economic Development Council (BEDC). Staff met with the Business Outreach Program chair to review past business outreach efforts and to provide recommendations for future visits with businesses. Staff is working with the Chamber to calendar the Business Outreach visits, which will begin in March. • In response to the City's comments about the "Totally Tustin" program, the Chamber is working with its business partners to begin phases 1 and 2 of the "Totally Tustin" program. No change in status. Commercial Leasing The Commercial Property Search feature on the City's website is now operational. Users can access the Availability Commercial Property Search feature by clicking on three different areas on the left hand column of the website: 1) under "City Departments, Redevelopment Agency"; 2) a stand-alone button entitled "Commercial Property Search"; and 3) under "For Businesses". Users will be able to define search parameters to distinguish between office, retail, and industrial properties and "For Sale" and "For Lease" properties. Design Reviews Staff reviewed a Conditional Use Permit for ground water remediation at 13891 Red Hill and provided comments on the First Street Specific Plan. Page 16
