PUBLIC HEARING - None CONSENT CALENDAR ( ITEMS 1 THROUGH 11 ) At starl's request, Items No. 5 and 7 were removed from tho Consent Calendar by Mayor Thomas and continued to a future meeting. It was moved by Wodoy, seconded by Kawashima, to approve the remainder of the Consent Calendar as recommended by staff. Motion carded 5-0. RESOLUTION NO. 02-27 A RESOLUTION OF THE CITY COtJNCIL OF THE CITY OF TUSTIN. CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE JAIvlBOREE ROAD REHABILITATION PROJECT BE'T'WEEN 1350 FEET AND 2750 FEET NORTH OF TUSTIN RANCH ROAD (CIP NO. ','171) Recommendation: Adopt Resolution No. 02-27, accepting the Jamboree Road Rehabilitation Project between 1350 ~eet and 2750 feet nodh of Tustin Ranch Road (CIP No. 7171 ) and authorizing the re~x)rdation of tho Notice et Completion, and direct the City Clerk to: 1 ) Release the Labor and Materials Bond not sooner than 35 days aitor the date of recordation el the Notice of Completion: and 2) Release tho Faithful Performance Bond not sooner than one year after tho date o! recordation of the Notice of Completion; and assuming no claims or stop notices are filed, 35 days after the date of recordation of the Notice of Completion the City Council authorize payment of tho final 10% retention in tho amount of S76.484.45 to Sequel Contractors. CALIFORNIA, APPROVING PARTICIPATION IN THE COUNTY OF ORANGE COOPERATIVE PURCHASING PROGRAM UTILIZING '1 HE U.S. COMMUNITIES PROGRAM Recommendation: Adopt Resolution No. 02-28, approving participalion in tho County of Orange Cooperative Purchasing Program utilizing the U.S. Communities program as recommended by the AssisL.']nt City Manager and tho Chief Deputy City Clerk. ITEMS REMOVED FROM CONSENT CALENDAR INVESTMENT OPTIONS Council unanimously concurred to continue this item to a future Council meeting. AWARD OF CONTRACT FOR THE PURCHASE OF TWO EMERGENCY PORTABLE GENERATORS (ClP NO. 6140) Council unanimously concurred to continue this item to a future Council meeting. REGULAR BUSINESS ( ITEMS 12 THROUGH 14 ) 12. GRAD NITE FUNDING Councilmember Bone stated ho opposed using tax money to supped a program that was a party. It was moved by Kawashima. seconded by Wodey, to approve a donation of $2,500 to Foothill High School and S2.500 to Tustin High School for Grad Nite. Motion carried 4-1. Bone opposed. 13. ORDINANCE NO. 1248 - PUBLIC EMPLOYEES' RETIREMENT SYSTEM CONTRACT AMENDMENT It was rnow;d by Wodey. seconded by Bone. to adopt the following Ordinance No. 1248: ORDINANCE NO. 1248 - AN ORDINANCE OF TI IE Cl'] Y COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN ] HE CITY COUNCIL OF THE CITY OF TUSTIN AND 'l HE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM Motion carried 5-0 (roll call vote). 14. SECOND PUBLIC INPUT Councilmembor Doyle hoped everyone had a great St Patrick's Day. SALES TAX REVENUE Councilmerrlbor Doyle encouraged the community to purchase items to help increase sales tax revenue. EAGLE SCOUT, ALEX BAKER Councilmember Bono spoke on his attendance at a Court of Honor for Eagle Scout, Alex Baker; stated approximately 200 scouts were at tho ceremony; and that ho was honored to bo a part of the celebration. ARBOR DAY Councilmember Bono noted his attendance at tho Arbor Day ceremony and said the City had received a Tree City USA flag. EVERY 15 MINUTES PROGRAM Councilmembor Kawashima stated that Tustin High School would bo conducting the bvery 15 Minutes program on March 19. 2002. CURRIE MIDDLE SCHOOL Councilmember Kawashima said ho would be Currie Middle School's principal for a day en March 19, 2002. GOAL Sb ITING WORKSHOP Councilmember Kawashima inquired when the Goal Setting workshop would be hold. William Huston, City Manager. responded in May. APRIL 1. 2002 COUNCIL MEE'f lNG Mayor Thomas stated he would not tie in attendance at the April 1,2002 City Council meeting. LITTLE LEAGUE Mayor Pro I'em Wodoy road a newspaper article on baseball and she stated that little league baseball helped to bdng communities together. PROPOSED LIBRARY Mayor Pro Tern Worley spoke on the proposed library: the City was hoping Io receive Proposition 14 funds: the library would include a largo children's lit)raw, homework centers, a reference section, reading rooms, patios, a library plaza and a conforonce,'community room; and Council welcomed comments and support from the community. COMMI'FI-EE REPORTS SOU I'HERN CALIFORNIA ASSOCIATION OF GOVERNIVIENTS (SCAG) Councilmembor Bono repealed on Assembly Bill 2333: explained that it could authorize withholding interregional funds from a county within SCAG jurisdiction if that county was not consistent with tho aviation elements of 4o long range plan developed by the Association; and stated that Council should take a position on AB 2333 because it was an intrusion on local agencies. CLOSED SESSION Mayor Thomas announced that tho City Council would convene in closed session to confer with the City Attorney regarding (1) Pending litigation to which the City is a party: 1. Garcia v. City of Tustin, Case Number 01CC02149 (state court matter): 2. Santa Aria Unified School District, et al. v. City of '1 ustin, et al., Case Number 01 CC02595 (state court matter); 3. Santa Aha Unified School District. et al. v. City of Tustin. et al., Case Number CV-01-3426 W JR (CTX) (federal court matter); (2) Conforom:o with Real Properly Negotiator (Government Code Section 54956.8). Properly: former Marine Corps Air Station. Tustin. Negotiators: Department of Navy and City Manager or Designee (City). Under negotiation: Price and terms of payment: and (3) To confer with tho City Attorney regarding significant exposure to litigation pursuant to Government Code Section 54956.9(b) (claim of Charles Drees: the Claim No. 02-04 may bo reviewed in the City Clerk's Office). ADJOURNMENT - Mayor Thomas adjourned the meeting at 8:08 p.m. The next regular meeting of the City Council was scheduled for Monday, April 1, 2002, at 7:00 p.m. in the Council Chamber at 300 Centennial Way. CLOSED SESSION STATEMENT Council voted 5-0 to deny all throe or tho claims of Chados Droos and to send notice thereof to the claimant and tho claimant's attorney.
