The Pledge of Allegiance was led by Councilmember Ports. The Tnvocation was given by Mr. Steve Garrison. ROLL CALL Council Present: Tracy Wills Worley, Mayor 3effery M. Development Beverley White, Deputy City Clerk Bettie Correa, Senior Personnel Analyst 3oe Meyers, Senior Management Analyst Approximately 100 in the audience PROCLAMATIONS TUSTIN PRIDE SCHOOL POSTER CONTEST WINNERS Mayor Worley read and presented proclamations to Tustin Pride School Poster Contest first place winners: Cody Calcaterra, Kindergarten category, Peters Canyon Elementary School; Adriana Razo, 5t~ grade category, Lambert Elementary School; Monissa Wong, 2"d grade category, Peters Canyon Elementary School; and Sherrie Yu, 3rd grade category, Peters Canyon Elementary School. KIWANIS CLUB OF TUSTIN, 40TH ANNIVERSARY Mayor Worley read and presented a proclamation honoring the 40~ Anniversary of the Kiwanis Club of Tustin. YOUTH ACTION TEAM Mayor Worley read and presented proclamations to the following Youth Action Team (YAT) members for service to the community: Donato Alvarado, Carlos Alvarado, Martha Harrison, Lori La Riva, Erika Lemus, Christian Morales, Myle Nguyen, 3amie Rapalo, Grant Saltarelli, Khai Tang, Cecilia Torres, Rueben Villalobos, and Peggy Wang. A YAT member thanked Council for the proclamations; noted how hard the Team had worked in the community; and was hopeful YAT membership would continue to grow. Council/YAT member discussion followed regarding the success of the recent teen dance sponsored by YAT, and the number of Tustin and Foothill High School students who attended. CITY COUNCIL MINUTES Page 2, 5-17-99 OLDER AMERICANS MONTH Ivlayor Worley read and presented a proclamation declaring May as Older Americans Month. Margarete Thompson, representing the Tustin Area Senior Center, thanked Council for the proclamation; invited the community to the Senior Center's 10m Anniversary on 3uly 28, 1999; and presented Council and staff with Tustin Area Senior Center 10m Anniversary pins. Council/Mrs. Thompson discussion followed regarding the numerous activities available at the Senior Center. TUSTIN HIGH SCHOOL UNITED NATIONS DELEGATION TEAM Mayor Worley read and presented proclamations to the following Tustin High School Model United Nations Team members for winning the Best Delegation Award at the annual Bath, England, Model United Nations Conference: Mustafa Umar, Cheyne Blair, Elizabeth Muro, Alecia Amthauer, 3essica Cooper, Ainsley 3oily, Stewart Shikai, Valiant Yan, Tiffany Bennett, 3ohn Chung, Eliana Arinez, 3ean Plimpton, My Le Nguyen, Shivani Chopra, Tshchuna McDonald, Cyndee 3enkins, .lennifer Flint, Elizabeth Burr, Devon Nixon, Michael Yang, and advisors Linda Levine and Mimi Kroll. Michael Yang, Model United Nations (MUN) team member, thanked Council for the proclamations; explained that many of the proclamation recipients were not in attendance because they were studying for Advanced Placement testing; described the Bath Conference and the number of participants; the Tustin MUN team continued its past success at the Conference by winning the top delegation award; and encouraged everyone to attend the November MUN Conference to learn about the program. Council/Mr. Yang discussion followed regarding all students were allowed to participate in the MUN program; more than 11% of the Tustin High School student body were MUN members; and junior and senior students were eligible to attend the Bath, England, Conference. PUBLIC INPUT SYCAMORE AVENUE SPEED LIMIT/RAIL SYSTEM Anthony Trujillo, 2001 Kingsboro Circle, Tustin, reported he had recently read a newspaper article that the speed limit on Sycamore Avenue, be~veen SR-55 and Red Hill Avenue, had been reduced, however, speed limit signs had not been installed on Sycamore Avenue to indicate the change; and noted his attendance at a recent Orange County Transportation Authority (OCTA) meeting on the proposed rail system, remarked on OCTA's support of the system, and he encouraged opposition to a light rail system. VEHICLE SPEED ON MAIN STREET Lou Allard, 425 W. Main Street, Tustin, reported the number of vehicles exceeding the speed limit on Main Street and requested mitigation measures be implemented to reduce traffic and excess speed. PUBLIC HEARING - None CONSENT CALENDAR ( ITEMS I THROUGH 12 ) Zt was moved by Potts, seconded by Thomas, to approve the Consent Calendar as recommended by staff. Motion carried 4-0., Saltarelli absent. 1. APPROVAL OF MINUTES - MAY 3, 1999 REGULAR MEETING Recommendation: Approve the City Council Minutes of May 3, 1999. CITY COUNCIL MINUTES Page 3, 5-17-99 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $2,625,680.97 and ratify Payroll in the amount of $375,598.66. 3. PLANNING COMMISSION ACTION AGENDA- MAY 10, 1999 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. "". Recommendation: Ratify the Planning Commission Action Agenda of May 10, 1999. 120-50 4. NISSON ROAD/NEWPORT AVENUE LANDSCAPE INSTALLATION Recommendation: Receive and file subject report as recommended by the Public Works Department/Field Services. 950-10 5. DENIAL OF CLAIM NO. 99-16, CLAIMANT: PAUL PINTO Recommendation: Deny subject claim and direct the City Clerk to send notice to the claimant and the claimant's attorney as recommended by the City Attorney. 6. AWARD CONTRACT- DOCUMENT IMAGING SYSTEM, ARCHIVE AND RETRIEVAL Recommendation: Authorize the City Manager to execute an agreement with RT Lawrence Corporation, La Mirada, California, for the purchase of a Laserfiche Document Imaging System, Archive and Retrieval, Phases I and II, for a not-to-exceed amount of $72,800 upon review and approval of the City Attorney as recommended by the City Clerk's Office. 400-10 7. CONTRACT RENEWAL FOR LANDSCAPE MAINTENANCE SERVICES WITH PLANT CONTROL LANDSCAPE MAINTENANCE, INC. Recommendation: Approve the third and final amendment to the contract between Plant Control Landscape Maintenance, Inc. and the City for landscape maintenance services ,-.- subject to City Attorney approval as recommended by the Public Works Department/Field , Services. 400-45 8. CONTRACT RENEWAL FOR LANDSCAPE MAINTENANCE SERVICES WiTH ACCURATE LANDSCAPE AND MAINTENANCE, INC. Recommendation: Approve the third and final amendment to the contract between Accurate Landscape and Maintenance, Inc. and the City for landscape maintenance services subject to City Attorney approval as recommended by the Public Works Department/Field Services. 400-45 9. APPROVAL OF A CONSULTANT SERVICES AGREEMENT WITH HILTON, FARNKOPF AND HOBSON, LLC TO PREPARE SOLID WASTE COLLECTION AND RECYCLING SERVICES BID DOCUMENTS Recommendation: Approve a consultant services agreement with Hilton, Farnkopf and Hobson, LLC of Newport Beach to prepare the necessary bid documents for the City's solid waste collection and recycling services contingent upon the approval of the agreement by the City Attorney as recommended by the Public Works Department/Engineering Division. 400-10 10. RESOLUTION NO. 99-36 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15681 TO SUBDIVIDE A 71.8 ACRE SITE INTO 114. NUMBERED LOTS AND 34 LETTERED LOTS FOR THE PURPOSE OF DEVELOPING 114 SINGLE FAMILY DETACHED RESIDENTIAL UNITS ON LOTS 9 AND 10 OF TRACT 13627 GENERALLY LOCATED WESTERLY OF THE INTERSECTION OF PIONEER ROAD AND PATRIOT WAY Recommendation: Adopt Resolution No. 99-36 approving Final Tract Map 15681 subject to completion of Conditions, including but not limited to, 1.6, 1.7B, 2.21, 3.1, 3.3, 4.1, 5.4, 6.1, 6.3, 6.5, 8.1 and 10.2 of Resolution No. 98-115 to the satisfaction of the Community Development and Public Works Departments and the City Attorney prior to recordation as recommended by the Community Development Department. TUSTIN LANDSCAPE AND LIGHTING DISTRICT LEVY OF ANNUAL ASSESSMENT FOR THE 1999-00 FISCAL YEAR RESOLUTION NO. 99-31 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT LEVY OF ANNUAL ASSESSMENTS FOR FISCAL YEAR 1999-2000 Recommendation: Adopt Resolution No. 99-31 approving the Engineer's Report for fiscal year 1999-00 as recommended by the Public Works Department/Engineering Division. RESOLUTION NO. 99-35 - A RESOLUTION OF THE CITY COUNCIL OF THE C1TY OF TUSTIN, CALIFORNIA, DECLARING ITS INTENTION TO PROVIDE FOR AN ANNUAL LEVY OF ASSESSMENT FOR FISCAL YEAR 1999-00 FOR THE IMPROVEMENT, MAINTENANCE, AND SERVICING OF PUBLIC LANDSCAPING AND LIGHTING FACILITIES IN THE TUSTIN RANCH AREA WTTHIN THE BOUNDARIES OF THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND TO LEVY AND COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND PROPOSITION 218 AND GIVING NOTICE THEREOF Recommendation: Adopt Resolution No. 99-35 declaring its intention to levy assessments for fiscal year 1999-00 and setting a public hearing for 3une 21, 1999 as 'recommended by the Public Works Department/Engineering Division. 340-60 12. SENATE BILL 23, ASSAULT WEAPON BAN ' Recommendation: Continue this item to the 3une 7, 1999 City Council meeting as recommended by the Police Department. 270-20 REGULAR BUSINESS (ITEMS 13 THROUGH 17 ) 13. ORDINANCE NO. 1214- UNIFORM CONSTRUCTION CODES Tt was moved by Thomas, seconded by Doyle, to have second reading by title only and adoption of Ordinance No. 1214. The City Clerk read the following Ordinance No. 1214 by title only: ORDINANCE NO. 1214 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED CHAPTERS OF ARTICLE 8 OF THE TUSTIN CITY CODE TO ADOPT THE 1997 EDITIONS OF THE UNIFORM CODES AND THE 1996 NATIONAL ELECTRICAL CODE WITH APPENDICES AND AMENDMENTS THERETO Motion carried 4-0, Saltarelli absent (roll call vote). 460-50 14. ORDINANCE NO. 1216 - CURFEW FOR MINORS It was moved by Doyle, seconded by Thomas, to have second reading by title only and adoption of Ordinance No. 1216. The City Clerk read the following Ordinance No. 1216 by title only: ORDINANCE NO. 1216 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 6102 OF THE TUSTIN CITY CODE RELATING TO A CURFEW FOR MINORS Motion carried 4-Q, Saltarelli absent (roll call vote). 270-05 15. CHAMBER OF COMMERCE - REQUEST FOR FUNDING Eddie Burch, Chamber of Commerce Executive Director, stated that the Chamber of Commerce was in the process of working with staff to construct a quality map of Tustin; the extensive development changes in Tustin since the issuance of the last City map; and requested the City appropriate $5,000 for the map. CITY COUNCIL MINUTES Page 5, 5-17-99 Ceil Kirby, Chamber of Commerce, reported the new maps would be digital computer- generated; remarked on the inaccuracies of the previous City map; and requested Council support the project. Council/speakers discussion followed regarding the City would receive 1,000 maps; the Chamber was currently selling advertising for the map; 5,000 maps would be printed; and the maps would be distributed to the public at no charge. " It was moved by Potts, seconded by Thomas, to appropriate $5,000 to the Chamber of Commerce for the 1999-2000 City map. Motion carried 4-0, Saltarelli absent. 330-20 16. STATUS REPORT OF THE TUSTIN COMMUNITY FOUNDATION It was moved by Potts, seconded by Thomas, to continue this item to a future Council meeting. Motion carried 4-0, Saltarelli absent. 125-45 17. TUSTIN MILLENNIUM EVENT COORDINATION Patrick Sanchez, Director of Parks and Recreation Services, reported that Council had requested staff form a Tustin Millennium Committee of volunteers to plan a community millennium event for December 31, 1999; the committee met twice; and upon analysis of available resources for the event and Y2K preparation, staff recommended the event be deferred to 2000. ,.-. Councilmember Doyle stated that because of the number of people who may attend the ! event, possible consumption of alcoholic beverages, and the potential for violence, he supported deferring the event. Mayor Worley said that many people in the community were supportive of conducting a millennium event, but she believed it was in the best interest of the City to delay the party until 2000; and staff would continue further study of the event. It was moved by Ports, seconded by Thomas, to defer the "First Night" New Year's Event to December 31, 2000. Motion carried 4-0, Saltarelli absent. 160-70 PUBLIC INPUT- None OTHER BUSINESS/COMMITTEE REPORTS SANTA COP PROGRAM Councilmember Doyle thanked everyone who sponsored the Santa Cop Program at the recent Casino Night. DINNER EVENTS Councilmember Doyle noted his displeasure with a Tustin philanthropic organization conducting dinner events in the city of Orange. NISSON ROAD LANDSCAPING Councilmember Potts remarked on the Nisson Road landscaping and was pleased it was scheduled to proceed. CITY COUNCIL MINUTES Page 6~ 5-17-99 TRAIL UPDATE Councilmember Po~ requested a trail update. CEDAR GROVE PARK Mayor Pro Tem Thomas noted concern regarding the number of people picking flowers from the Cedar Grove Park landscaping. SHOPPING CART LOCKING DEVICES Mayor Worley reported on a new device grocery stores were utilizing that locked shopping cart wheels when customers attempted to remove the carts from market parking lots. CLOSED SESSION Mayor Worley announced the Closed Session had been cancelled. ADJOURNMENT Mayor Worley adjourned the meeting at 7:56 p.m. The next regular meeting of the City Council was scheduled for Monday, 3une 7, 1999, at 7:00 p.m. in the Council Chamber at 300 Centennial way.
