HUSTON, INTERIM CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: FINAL PARCEL MAP 2008-136 SUMMARY: Agenda Item 7 Reviewed: City Manager Finance Director Final Parcel Map (FPM) 2008-136 is a request to subdivide an existing office building for condominium purposes. The proposed subdivision would result in a total of eleven (11) units within the existing 43,967 square foot two story building. On May 25, 2010, the Planning Commission recommended that the City Council approve Tentative Parcel Map (TPM) 2008-136. On July 6, 2010, the City Council approved TPM 2008-136. The property is located at 2492 Walnut Avenue. (Applicant: Robert L. Balmes). RECOMMENDATION: That the City Council adopt Resolution No. 11-25 approving Final Parcel Map 2008-136. FISCAL IMPACT: FPM 2008-136 is an applicant-initiated project. The applicant has paid applicable fees for the processing of this project. BACKGROUND: On May 25, 2010, the Planning Commission held a public hearing and adopted Resolution No. 4147, recommending approval of Tentative Parcel Map 2008-136 to the City Council, and on July 6, 2010, the City Council approved Tentative Parcel Map 2008-136 by adopting Resolution No. 10-71. DISCUSSION: The project site is 2.35 acres in area and located at the southwest corner of Walnut Avenue and Franklin Avenue, also known as the Tustin Corporate Center, within the Irvine Industrial Complex and the City's Planned Community Commercial (PC-COMM) zoning district (Attachment A -Location Map). The site is developed with a 43,967 square foot two-story office building. FPM 2008-136 would subdivide an existing office building into eleven (11) office suites. The project includes a Conditional Use Permit request to increase the maximum square footage of medical uses and a joint use parking with Final Parcel Map 2008-136 April 5, 2011 Page 2 adjacent parcel. The City Council approved the Conditional Use Permit on July 6, 2010. Minor exterior improvements are also proposed in conjunction with project which includes constructing trash enclosures to comply with City requirements and upgrading handicap accessible parking spaces to comply with State requirements. As a condition of approval to create condominium offices, a Covenants, Conditions and Restrictions (CC&Rs) must be prepared and approved prior to recordation of FPM 2008- 136. The proposed CC&Rs have minor outstanding issues and is currently under review by the City Attorney and staff. The City Attorney and staff will work with the applicant to finalize the documents prior to recordation the subject Parcel Map. The Public Works/Engineering staff has reviewed Final Parcel Map 2008-136 and has determined that the map is in substantial conformance with the City Council's approval of Tentative Parcel Map 2008-136, the City's Zoning Code and Subdivision Code, and the State Subdivision Map Act. ENVIRONMENTAL: This project is categorically exempt pursuant to Section 15315, Class 15 of Title 14, Chapter 3 of the California Code of Regulations (Guidelines for the California Environmental Quality Act). ~~~ ,(~„rEd lynne V. That Final Parcel Map No. 2008-136 was submitted by Robert Balmes, the property owner, requesting approval to subdivide an existing office building for condominium purposes on a property located at 2492 Walnut Avenue; B. That on May 25, 2010, the Planning Commission adopted Resolution No. 4147 recommending that the City Council approve Tentative Parcel Map 2008-136, and the City Council approved Tentative Parcel Map 2008-136 on July 6, 2010, by adopting Resolution No. 10-71; C. That the proposed subdivision is in conformance with the Tustin General Plan land use designation of Planned Community Commercial/Business and Planned Community Commercial (PC-COMM) Zoning District, and the Irvine Industrial Complex Planned Community District Regulations in that these designations provide for the development of office, research and development, and warehouse uses; D. That the proposed subdivision is in conformance with Tentative Parcel Map 2008-136, the Tustin Area General Plan, Tustin Zoning Code, State Subdivision Map Act, the City's Subdivision Code, and has been determined to be consistent with the Air Quality Sub-Element; E. The final parcel map is Categorically Exempt pursuant to Section 15315, Class 15 of Title 14, Chapter 3, of the California Code of Regulations (Guidelines for the California Environmental Quality Act). II.
