' City Manager Finance Director ~''~ ~~;^ .~ ~ SUBJECT: SUBDIVISION 2011-02 (FINAL PARCEL MAP 2010-127) SUMMARY: Final Parcel Map (FPM) 2010-127 is a request to subdivide a 33.549-acre site into six (6) parcels for conveyance and establishment of right-of-way purposes only for the properties generally bounded by Newport Freeway (SR 55) to the west, Valencia Avenue to the south, portions of Del Amo Avenue and Newport Avenue to the east, and Edinger Avenue to the north. RECOMMENDATION: That the City Council adopt Resolution No. 11-30 approving FPM 2010-127, a subdivision of 33.549-acre site into six (6) parcels for conveyance and establishment of right-of-way purposes only. FISCAL IMPACT: This is aCity-initiated application. Fees related to the preparation of FPM 2010-127 have been appropriated in the current budget. BACKGROUND: The proposed project is a request to process Parcel Map 2010-127, a subdivision of a 33.549 acre site into six (6) parcels, as a Final Parcel Map only. Pursuant to Tustin City Code (TCC) Section 9312, division of land into five (5) or more parcels requires the approval of a Tentative and Final Parcel Map. However, TCC Section 9313b3 exempts the filing of a Tentative and Final Tract Map when the land involved consists of a parcel or parcels having approved access to a public street or highway, zoned for industrial or commercial development, and which has the approval of the City as to street alignments and widths. Instead, a Tentative and Final Parcel Map are required unless waived pursuant to TCC Section 9314a. Waiver of subdivision requirements is allowed in whole or part by the Community Development Director after consultation with the City Engineer when division of real property is created by eminent domain among other criteria. Final Parcel Map 2010-127 April 19, 2011 Page 2 The parcels involved are zoned for commercial development consistent with the General Plan and the Pacific Center East Specific Plan; have approved access to a public street; and, have the approval of the City Engineer as to street access, alignments, and widths. Accordingly, Tentative Tract Map and Final Tract Map are not needed as may be traditional. The parcels involved were created via Order of Condemnation by eminent domain procedures and court order; therefore, waiver of the Tentative Parcel Map requirement is allowed in whole or part under TCC 9314a1. DISCUSSION: Site and Surroundings The project site is generally bounded by the Newport Freeway (SR 55) to the west, Valencia Avenue to the south, portions of Del Amo Avenue and Newport Avenue to the east, and Edinger Avenue to the north (Attachment A -Location Map). The project site is vacant, except for an existing industrial building located at the northeast corner of Del Amo Avenue and Newport Avenue, and surrounded by other existing industrial, offices, and commercial establishments (Figure 1). The properties involved were acquired via Order of Condemnation in which the court allowed the City to proceed with the construction of the "New" Newport Avenue and "New" Del Amo Avenue and the Newport Avenue/SR 55 northbound ramp reconfiguration while the case was considered. As the case has been concluded, Parcel Map 2010-127 would establish right-of-way lines and clean up any underlying obsolete easements. Final Parcel Map 2010-127 April 19, 2011 Page 3 The Community Development Director has analyzed FPM 2010-127 for conformity with the Pacific Center East Specific Plan, applicable City of Tustin guidelines and standards, and applicable mitigation measures identified in the Final EIR 90-1 and its Supplemental #1. The Public Works Department have reviewed the map and determined that the map is in substantial conformance with the City Subdivision Code and State Subdivision Map Act. The City Attorney has reviewed the findings for consistency with the Tustin Subdivision Code. That the parcels involved are comprised of land zoned for industrial or commercial development and that the parcels involved, as determined by the City Engineer, have approved access to a public street and have the approval of the City as to street alignments and widths. Accordingly, Tustin City Code Section 9313b3 requires a Tentative Parcel Map and Final Parcel Map be processed in lieu of Tentative Tract Map and Final Tract Map unless waived in compliance with Tustin City Code Section 9314. 2. That the parcels involved were acquired by the City via Order of Condemnation through an eminent domain procedure in which the Tustin City Code Section 9314a1 allows for a waiver of the requirement for filing a Tentative Parcel Map. 3. That the proposed subdivision is in compliance with the Subdivision Map Act, Tustin Subdivision Code, Tustin General Plan, and Pacific Center East Specific Plan. Future development of the project site will be subject to approval of a Concept Plan and Design Review which will facilitate the development on the proposed lots consistent with the Pacific Center East Specific Plan and the Mitigation Measures of Final EIR 90-1 and its Supplemental #1. 5. That the proposed project is located within an urbanized area, and the proposed subdivision for conveyance and establishment of right-of-way purposes only and will not be likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 6. That the City determines that the geotechnical analysis for the Newport Avenue/SR 55 northbound ramp reconfiguration project on file with Public Works/Engineering is adequate to satisfy the requirement of a preliminary soils report pursuant to Section 66491(a) of the Subdivision Map Act. 7. That the establishment of the "New" Newport Avenue and "New" Del Amo Avenue are consistent with the Tustin General Plan and Pacific Center East Specific Plan. 8. That the City Attorney has reviewed the findings for consistency with the Tustin City Code. Environmental Review Section 15268(b)(3) of the California Code of Regulations, Title 14, Chapter 3 (Guidelines for California Environmental Quality Act) consider the approval of final subdivision maps as ministerial projects; therefore, Final Parcel Map 2010-127 is exempt from the requirements of CEQA. ~~ Elizabeth A. The City Council of the City of Tustin does hereby resolve as follows: The City Council finds and determines as follows: A. That a proper application to process Parcel Map 2010-127 as a Final Parcel Map only was initiated by the City of Tustin to subdivide a 33.549- acre site into six (6) parcels for conveyance and establishment of right-of- way purposes only. The site is bounded by Newport Freeway (SR 55) to the west, Valencia Avenue to the south, portions of Del Amo Avenue and Newport Avenue to the east, and Edinger Avenue to the north. B. That the parcels involved are comprised of land zoned for industrial or commercial development and that the parcels involved, as determined by the City Engineer, have approved access to a public street and have the approval of the City as to street alignments and widths. Accordingly, Tustin City Code Section 9313b3 requires a Tentative Parcel Map and Final Parcel Map be processed in lieu of Tentative Tract Map and Final Tract Map unless waived in compliance with Tustin City Code Section 9314. C. That the parcels involved were acquired by the City via Order of Condemnation through an eminent domain procedure in which Tustin City Code Section 9314a1 allows for a waiver of the requirement for filing a Tentative Parcel Map by the Community Development Director after consultation with the City Engineer. D. That the proposed subdivision is in compliance with the Tustin General Plan and the Pacific Center East Specific Plan. E. That the proposed subdivision is for conveyance and establishment of right-of-way purposes only. Future development of the project site will be subject to approval of a Concept Plan and Design Review which will facilitate the development on the proposed lots consistent with the Pacific Center East Specific Plan and the Mitigation Measures of Final EIR 90-1 and its Supplemental #1. That the proposed project is located within an urbanized area, and the proposed subdivision for conveyance and establishment of right-of-way purposes only and will not be likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. G. That the City determines that the geotechnical analysis for the Newport Avenue/SR 55 northbound ramp reconfiguration project on file with Public Works/Engineering is adequate to satisfy the requirement of a preliminary soils report pursuant to Section 66491(a) of the Subdivision Map Act. H. That the establishment of the "New" Newport Avenue and "New" Del Amo Avenue are consistent with the Tustin General Plan and Pacific Center East Specific Plan. That the Public Works/Engineering Department has reviewed the map and determined that it is technically correct and is in substantial conformance with the Pacific Center East Specific Plan, City Subdivision Code, and State Subdivision Map Act; J. That the City Attorney has reviewed the findings for consistency with the Tustin City Code. K. That Final Parcel Map 2010-127 is considered a ministerial project and exempted from the requirements of CEQA pursuant to Section 15268(b)(3) of the California Code of Regulations, Title 14, Chapter 3 (Guidelines for California Environmental Quality Act). II. The City Council hereby approves Final Parcel Map 2010-127 for the subdivision of an approximately 33.549-acre site into six (6) parcels for conveyance and establishment of right-of-way purposes, subject to final approval of the City Engineer.
