HomeMy WebLinkAboutCC RES 11-30RESOLUTION NO. 11-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING FINAL PARCEL MAP 2010-127 TO SUBDIVIDE A 33.549-ACRE SITE INTO SIX (6) PARCELS FOR CONVEYANCE AND ESTABLISHMENT OF RIGHT-OF- WAY PURPOSES ONLY FOR THE PROPERTIES BOUNDED BY NEWPORT FREEWAY (SR 55) TO THE WEST, VALENCIA AVENUE TO THE SOUTH, PORTIONS OF DEL AMO AVENUE AND NEWPORT AVENUE TO THE EAST, AND EDINGER AVENUE TO THE NORTH. The City Council of the City of Tustin does hereby resolve as follows: The City Council finds and determines as follows: A. That a proper application to process Parcel Map 2010-127 as a Final Parcel Map only was initiated by the City of Tustin to subdivide a 33.549- acre site into six (6) parcels for conveyance and establishment of right-of- way purposes only. The site is bounded by Newport Freeway (SR 55) to the west, Valencia Avenue to the south, portions of Del Amo Avenue and Newport Avenue to the east, and Edinger Avenue to the north. B. That the parcels involved are comprised of land zoned for industrial or commercial development and that the parcels involved, as determined by the City Engineer, have approved access to a public street and have the approval of the City as to street alignments and widths. Accordingly, Tustin City Code Section 9313b3 requires a Tentative Parcel Map and Final Parcel Map be processed in lieu of Tentative Tract Map and Final Tract Map unless waived in compliance with Tustin City Code Section 9314. C. That the parcels involved were acquired by the City via Order of Condemnation through an eminent domain procedure in which Tustin City Code Section 9314a1 allows for a waiver of the requirement for filing a Tentative Parcel Map by the Community Development Director after consultation with the City Engineer. D. That the proposed subdivision is in compliance with the Tustin General Plan and the Pacific Center East Specific Plan. E. That the proposed subdivision is for conveyance and establishment of right-of-way purposes only. Future development of the project site will be subject to approval of a Concept Plan and Design Review which will facilitate the development on the proposed lots consistent with the Pacific Resolution No. 11-30 Page 1 of 3 Center East Specific Plan and the Mitigation Measures of Final EIR 90-1 and its Supplemental #1. F. That the proposed project is located within an urbanized area, and the proposed subdivision for conveyance and establishment of right-of-way purposes only and will not be likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. G. That the City determines that the geotechnical analysis for the Newport Avenue/SR 55 northbound ramp reconfiguration project on file with Public Works/Engineering is adequate to satisfy the requirement of a preliminary soils report pursuant to Section 66491(a) of the Subdivision Map Act. H. That the establishment of the "New" Newport Avenue and "New" Del Amo Avenue are consistent with the Tustin General Plan and Pacific Center East Specific Plan. That the Public Works/Engineering Department has reviewed the map and determined that it is technically correct and is in substantial conformance with the Pacific Center East Specific Plan, City Subdivision Code, and State Subdivision Map Act; J. That the City Attorney has reviewed the findings for consistency with the Tustin City Code. K. That Final Parcel Map 2010-127 is considered a ministerial project and exempted from the requirements of CEQA pursuant to Section 15268(b)(3) of the California Code of Regulations, Title 14, Chapter 3 (Guidelines for California Environmental Quality Act). II. The City Council hereby approves Final Parcel Map 2010-127 for the subdivision of an approximately 33.549-acre site into six (6) parcels for conveyance and establishment of right-of-way purposes, subject to final approval of the City Engineer.
