STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTON 11-37 TO APPROVE THE SUBMITTAL OF MEASURE M2 TIER 1 ENVIRONMENTAL CLEANUP PROGRAM PROJECT APPLICATION TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY SUMMARY City Council adoption of Resolution No. 11-37 will approve submittal of the City's project application for Renewed Measure M funds (Measure M2) under the Environmental Cleanup Allocation Program, Tier 1 Grant Program. The City has prepared a project application to include the installation of 52 catch basin inserts and 100 automatic retractable catch basin screens for a total cost of $134,857. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 11-37 approving the submittal of the project application to the Orange County Transportation Authority (OCTA) for funding under the Renewed Measure M Environmental Cleanup Allocation Program, Tier 1 Grant Program 2011 Call for Projects. FISCAL IMPACT The total project cost is $134,857. The OCTA Measure M2 grant would provide $100,000. The City is required to provide funding match of twenty five percent (25%) of the total project cost. If the project is selected, Tustin's matching cost will total $34,857 which will be funded by Measure M2 -Fair Share Fund 139. DISCUSSION/BACKGROUND As a component of the Measure M project (M2), OCTA has established and is overseeing an environmental cleanup grant program dedicated to protecting Orange County beaches and waterways from the conveyance of urban runoff associated with transportation generated pollution. The M2 Environmental Cleanup Program ensures that funds will be used on a countywide, competitive basis to assist cities in meeting goals for controlling transportation generated pollution as required by the City's National Pollutant Discharge Elimination System (NPDES) permit. Approximately $2.8 million is available in the first fiscal year (FY 11/12) to be awarded with this grant "Call for Projects". The maximum grant amount is $100,000 per project. Staff has prepared an application under this "Call for Projects" for the maximum amount that would be used to purchase additional catch basin inserts and automatic retractable catch basin screens. Resolution No. 11-37 states that the City Council supports the application, the City is capable of providing the required funding match, and that the City agrees to work with OCTA to meet established deadlines if the grant funds are awarded, and designates the Director of Public Works Measure M2 Tier 1 Project Application to OCTA May 3, 2011 Page 2 as the City's authorized representative. The Renewed Measure M funding eligibility requires City Council approval of applications for funding under this program. The application for this project was submitted to the OCTA by its deadline of April 18, 2011. Adopting the resolution serves to complete the initial OCTA administrative process for receipt of the applications. Stack, P.E.
