STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 11-38 DESIGNATING THE CITY'S AUTHORIZED AGENTS FOR STATE AND FEDERAL DISASTER ASSISTANCE APPLICATIONS SUMMARY The California Emergency Management Agency (CaIEMA) requires a current City resolution on file to process state and federal disaster assistance claims. RECOMMENDATION It is recommended that the City Council Adopt Resolution No. 11-38 designating the City Manager, the Finance Director and the Public Works Director as the City's authorized agents for state and federal disaster assistance applications. FISCAL IMPACT The City is currently eligible for reimbursement of $18,129.28 for public works response costs associated with the December 2010 floods. The proposed resolution will apply to the current claim and future claims for other emergencies. DISCUSSION The City of Tustin submits applications as needed to Federal Emergency Management Agency (FEMA) and/or California Emergency Management Agency (CaIEMA) to recover costs associated with locally declared emergencies. CaIEMA requires that the applications and other related documents/forms must be signed by an authorized agent designated in order to submit claims, secure reimbursements and process other related documentation. CaIEMA has requested that the City file a new resolution designating City agents to sign all CaIEMA documents. The prior resolution was approved by Council in 1992. CaIEMA is now requiring a new resolution be adopted every three years. Approval of this resolution designates and authorizes the City Manager, Finance Director and Public Works Director to sign Federal Emergency Management Agency/California Emergency Management Agency applications, claims and other related documents for the purpose of obtainina state and federal disaster assistance. mo~gl S. Stafford Disaster Relief and Emergency Assistance Act of 1988 provides for financial assistance to State and Local Governments during emergencies; and WHEREAS, the State of California Emergency Management Agency requires local agencies to designate an agent(s) to represent the local agency in matters pertaining to disaster assistance requests; and WHEREAS, Tustin City Code section 52020 designates the City Manager as the Director of Emergency Services. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that it determines and orders as follows: That the City Council of the City of Tustin, hereby designates the City Manager, the Finance Director and the Public Works Director as its agents to the California Emergency Management Agency for all open and future matters pertaining to disaster assistance such as the Agency may require.
