LEGACY BACKBONE INFRASTRUCTURE BETWEEN THE CITY AND
HUNSAKER & ASSOCIATES
SUMMARY
Approval is requested of Amendment No. 3 to a Consultant Services Agreement for Tustin Legacy
backbone infrastructure between the City and Hunsaker & Associates to provide additional
engineering services related to infrastructure and grading design requirements for Tustin Ranch Road
roadway improvements and mapping services related to the City's Disposition Strategy and Business
Plan.
RECOMMENDATION
It is recommended that the City Council/Members of the Board of Directors of the Tustin Community
Redevelopment Agency:
Approve Amendment No. 3 to a Consultant Services Agreement for certain Tustin Legacy
engineering design services between the City and Hunsaker & Associates, increasing the not to
exceed amount by $101,700 to $724,450, and authorize the City Manager and/or Assistant City
Manager to execute the document on behalf of the City; and
2. Appropriate $42,700 from unappropriated funds in CFD 06-01 Fund (435) and $59,000 from MCAS
Tustin Redevelopment Revenue Fund (555) into the Tustin Ranch Road Extension Project Capital
Improvement Program Fund (CIP No. 70206) and Redevelopment Agency operating account 555-
35-00-6010, respectively to cover associated expenses.
FISCAL IMPACT
The consulting services will be compensated on a time and material basis with a not to exceed budget
of $101,700. The Scope of Services will require an appropriation from unappropriated funds in the
CFD 06-01 Fund to cover the additional engineering services related to infrastructure and grading
design requirements for Tustin Ranch Road roadway improvements, and will require an appropriation
from unappropriated funds in the MCAS Revenue Fund (555) to cover the additional mapping services
related to the City's Disposition Strategy and Business Plan. An itemized list of approved Tustin
Legacy agreements for professional consulting services, including pending approvals, is attached for
reference.
DISCUSSION
On September 7, 2010, the City Council approved a Consultant Services Agreement ("Agreement")
with Hunsaker & Associates to provide engineering services at Tustin Legacy related to the City's

Disposition Strategy and Business Plan, aerial mapping, and improvements related to Tustin Ranch
Road and Valencia Avenue. Subsequently, amendments to the Agreement were necessitated and
approved as follows:
On November 2, 2010, Amendment No. 1 to the Agreement was approved for engineering
services related to preparation of a final tract map for conveyance purposes.
On February 1, 2011, Amendment No. 2 to the Agreement was approved for engineering
services related to infrastructure design requirements for Tustin Ranch Road roadway
improvements, Valencia Avenue traffic signal and sewer line modifications, and Park Avenue
roadway, storm drain, water, and sewer improvements.
More recently, based upon plan checking of the subdivision map currently being prepared for
Neighborhood D and G under the existing Agreement, significant changes to street right-of-way areas,
open space areas, and the need to accommodate Navy Lease In Furtherance of Conveyance
("LIFOC") areas became necessary based on plan review comments, increasing the number of lots
from the original 81 lots to 173 lots and requiring significant alterations to the work underway by the
Consultant. In addition, the grading and drainage plans for the Tustin Ranch Road Project has
required additional engineering work to accommodate the Tustin Ranch Road Phase I grading
schedule.

This AMENDMENT NO. 3 TO CONSULTANT SERVICES AGREEMENT

( Amendment No. 3) is made and entered into by and between the CITY OF TUSTIN, a
municipal corporation ("City") and HUNSAKER & ASSOCIATES IRVINE, a California
Corporation ("Consultant"), pursuant to Section 1.6 "Additional Services" and Section
2.3 "Changes", of the Consultant Services Agreement.
WHEREAS, City and Consultant entered into a Consultant Services Agreement
on September 7, 2010, to provide consulting services to the City for engineering
services for the Tustin Legacy Disposition Strategy and Business Plan; and
WHEREAS, City requested certain additional engineering services related to
grading plans modification, storm drain plans addition, and tract map revision; and
WHEREAS, Hunsaker & Associates submitted an authorization request for
additional engineering services dated April 20,-2011, attached hereto as Exhibit "A"; and
THEREFORE, it is agreed that the Original Agreement be amended as follows to
reflect the modifications requested by Hunsaker & Associates and authorized by the
City of Tustin:
1. Modification of Compensation. Section 2 entitled "Compensation" is
amended to provide additional engineering services as identified in Exhibit "A"
of this Amendment No. 3 to be charged on an hourly rate up to a not to
exceed additional compensation amount of $101,700.
2. General Requirements. All other terms and provisions contained in the
Original Agreement shall remain in effect and shall not be altered by this
Amendment..

This will approximately double the size of the new
shallower basin in order to handle previous silt capacity.
FourvolNC PARTNERS: This interim case will result in a portion of the adjacent
RICHARD HUNSAKER design pad being inundated in a 100-year storm event.

drain Neighborhood "B" (ramp parcel) to keep it 1' above
Three Hughes ground water per NMG report (minimum 3' cover at the
Irvine, California northerly right-of-way). The berm/riser/spillway at that

(949) 583-1010 PH doubled in size in order to keep the same silt capacity.

• H&A to provide structural design for proposed gunite
shown in Detention Basin #6. Structural design to assume
that there are no proposed weep holes and that structure
is to withstand floating loads.
• Delete the low flow earthen channel at Detention Basir) #6
and replace with new HDPE low flow outlet pipe.
• Extend proposed box culvert at Legacy Drive, north of the
currently shown termination point at Tustin Ranch Road
to the existing earth channel (approximately 400') to
eliminate the original proposed earth channel that was
below ground water.
• Detention Basin #6 -Revise currently proposed earthen
channel by vertically adjusting grades in order to be
above the NMG estimated ground water elevation. Outlet
of revised earthen channel will be integrated into
proposed storm drain system located at Park Place and
Legacy Drive via low flow pipe.
• Detention Basins #2 and #5 -Adjust bottom of basin
vertically to be raised above the estimated NMG ground
water elevation.
• H&A to verify and adjust accordingly all proposed bottom
elevations of bioswales on Tustin Ranch Road to ensure
that they are one foot (1') above the NMG estimated
ground water elevation.
• Revise Erosion Control Plan to correlate with revised
design of all earthen channels and detention basins.
2. H&A to revise flows into Detension Basin #2 by adding a
retention basin south of Moffett Avenue ................................... $ 18,000
• Additional sheets will be added to reflect this interim
condition/design.
• H&A to update the earthwork volumes calculations as all
quantities associated with the retention basin.

Confirm appropriate right-of-ways have been provided for
the tentative map's street system to accommodate
intersection widenings per the intersection lane
configurations and right/left turn storage length
requirements prepared by Austin-Foust Associates for the
Legacy Park of Tustin Legacy Traffic Analysis.
• Convert all 56' right-of-way street sections in
Neighborhood "D" per the 1st plan check comments to 60'
right-of-way street sections (local streets).
• Reduced the right of way width for the street segment
extension of Carnegie Avenue between Park Avenue and
Warner Avenue to a local street with 60' right-of-way for
consistency with the Legacy Park of Tustin Legacy Traffic
Analysis for Neighborhood "D."
2. Revise and update final map to reflect changes per tentative
map. As a result, an additional 12 sheets will be added to
reflect the additional 90+ lots (16 numbered lots and 76
lettered lots) that were added. As such, all closures will need
