HomeMy WebLinkAboutPC RES 3708RESOLUTION NO. 3708 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN DETERMINING THAT THE LOCATION, PURPOSE, AND EXTENT OF THE PROPOSED ACQUISITION AND CONSTRUCTION OF AN ELEMENTARY SCHOOL AT THE NORTHEAST CORNER OF TOWNSHIP DRIVE AND RAWLINGS WAY BY THE TUSTIN UNIFIED SCHOOL DISTRICT CONFORMS WITH THE TUSTIN GENERAL PLAN. The Planning Commission does hereby resolve as follows: ]0 I. The Planning Commission finds and determines as follows: II A. 14 B. 17 C. ]9 20 22 23 24 2? That the Tustin Unified School District proposes to construct an elementary school at the northeast corner of Township Drive and Rawlings Way within the East Tustin Specific Plan "Planned Community Residential" zoning district and General Plan land use designation. That California Government Code Section 65402 (a) provides that an agency shall not acquire or dispose of real property and construct or authorize public buildings until the location, purpose, and extent of the project has been reported upon by the local planning agency as to the conformity with the applicable, adopted general plan. That the "Planned Community Residential" land use designation provides for the establishment of schools that are compatible with and oriented towards serving the needs of the surrounding community. In addition, the General Plan contains the following Goals and Policies which support the provision of schools: Goal 1' "Provide for a well balanced land use pattern that accommodates existing and future needs for open space and community facilities and services" Goal 8' "Ensure that necessary public facilities and services are available to accommodate development proposed on the Land Use Policy Map" Policy 9.2: "Provide for supporting land uses in East Tustin including neighborhood commercial centers, park and recreational facilities, and schools, to serve the residential community" With implementation of the City's recommended mitigation measures contained in the letter dated December 7, 1999, the proposed acquisition and construction would conform to the Tustin General Plan. l0 12 Exhibit A Resolution 3708 December 13, 1999 Page 2 II. Bi That general plan conformity determinations required by Government Code Section 65402(a) are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. The Planning Commission hereby determines that the location, purpose, and extent of the proposed acquisition and construction of an elementary school at the northeast corner of Township Drive and Rawlings Way by the Tustin Unified School District conforms with the Tustin General Plan.
