HomeMy WebLinkAbout00 PC Agenda 05/24/11AGENDA REGULAR MEETING TUSTIN PLANNING COMMISSION MAY 24, 2011 CALL TO ORDER: 7:00 p.m. INVOCATION/PLEDGE OF ALLEGIANCE: Commissioner Eckman ROLL CALL: Commissioners Eckman, Kozak, Moore, Puckett, Thompson PRESENTATION: ORANGE COUNTY HUMAN RELATIONS COMMUNITY POLICING AWARD FOR THE NITF ALLIANCE PROJECT The Community Development Department Code Enforcement Division actively participates in the City's Neighborhood Improvement Task Force (NITF). NITF is a community governance committee, originally formed by the Tustin Police Department, wherein collaborative efforts from different City departments including the Tustin Police Department, City department staff, and other agency representatives, and community-based organizations work together to provide municipal services and address community problems. On May 5, 2011, the Tustin Police Department was awarded with the Orange County Human Relations Community Policing Award for the Neighborhood Improvement Task Force (NITF) Alliance Project. Orange County Human Relations works to foster mutual understanding among residents and eliminate prejudice, intolerance and discrimination in order to make Orange County a better place for all people to live, work, do business and go to school. The Tustin Police Department was recognized for the NITF Alliance Project, a successful partnership between law enforcement, city departments, and community-based organizations to reduce crime and increase the livability of Tustin's Alliance Avenue neighborhood. City staff will provide the Planning Commission with a brief presentation and video on what was presented at the Orange County Human Relations Awards Ceremony. CONSENT CALENDAR: All matters listed under the Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Commission, staff, or public request specific items to be discussed and/or removed from the Consent Calendar for separate action. 2. APPROVAL OF MINUTES - MAY 10, 2011, PLANNING COMMISSION MEETING. PUBLIC HEARINGS: 3. CONTINUED THREE-FOOT LANDSCAPE REQUIREMENT AND SYNTHETIC TURF STANDARDS On May 10, 2011, the item was brought before the Planning Commission for consideration of the three-foot landscape requirement and to consider the Draft Synthetic Turf Standards. The items were presented and discussed at the hearing. The Planning Commission recommended minor changes to the Synthetic Turf Standards and requested that the three-foot landscape ordinance be clarified with the intent to protect and maintain an attractive buffer between driveways of abutting residential properties to enhance the attractiveness of a residential property as viewed from adjoining properties and/or the public right of way. The Planning Commission further suggested that the three-foot landscape/hardscape requirement be subject to review, at the discretion of the Community Development Director, to allow flexibility in the application of the Code and to ensure consistency with the intent of the ordinance. The review would be subject to specific findings to ensure that the location, size, architectural features and general appearance of any proposed improvements will attain the desired aesthetic effect between residential properties. The matter was continued to May 24, 2011, and the requested modifications have been incorporated into Ordinance No. 1358. The revisions are shown in red underline format throughout the revised documents. Agenda -Planning Commission May 24, 2011 -Page 2 Minor changes, as suggested by the Planning Commission, have also been incorporated into the Synthetic Turf Standards. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4173 approving Code Amendment 11-004 recommending that the Tustin City Council adopt Ordinance No. 1398 amending Tustin City Code Sections 5502 and 9267 modifying landscape requirements and setting forth Synthetic Turf Standards. CODE AMENDMENT 2011-03, DRAFT ORDINANCE NO. 1381 REASONABLE ACCOMMODATION ORDINANCE The federal Fair Housing Amendments Act of 1988 and California's Fair Employment and Housing Act impose an affirmative duty on local governments to make reasonable accommodation in their land use and zoning regulations and practices when such accommodation may be necessary to afford individuals with disabilities an equal opportunity to housing. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4148, recommending that the Tustin City Council adopt Draft Ordinance No. 1381, adding Section 9278 to the Tustin City Code to establish a procedure to provide individuals with disabilities reasonable accommodation in regulations and procedures to ensure equal access to housing, and to facilitate the development of housing for individuals with disabilities.
