Holland The City Council met in Closed Session and provided the City Attorney instructions regarding the Meredith Hillman claim; denied the Serrano Homeowners Association claim, and did not discuss TUSD litigation; otherwise, no reportable action was taken. ORAL COMMUNICATION/PUBLIC INPUT - • William McKie • James Laird • Francine Scinto • Jonathan Abelove CONSENT CALENDAR ITEMS 1-8 City Council/Redevelopment Agency/ Tustin Public Financing Authority May 17, 2011 Minutes Page 2 of 7 Motion: It was moved by Councilmember/Agencymember/Board Member Murray and seconded by Mayor Pro Tem/Chair Pro Tem/Vice Chair John Nielsen to pull consent items 3, 4, 5 and 7 and to approve the balance of the consent calendar items as recommended by staff. Motion carried 4-0 1. APPROVAL OF MINUTES - REGULAR MEETING OF JOINT CITY COUNCIL/REDEVELOPMENT AGENCY/TUSTIN PUBLIC FINANCING AUTHORITY HELD ON MAY 3, 2011 Recommendation: Approve the Action Minutes of the Regular Meeting of the Joint City Council/Redevelopment Agency/Tustin Public Financing Authority held on May 3, 2011 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $2,206,615.22 and Payroll in the amount of $650,858.35. 3. AWARD CONTRACT FOR PARK RE-CAMPING CIP NO. 20066 Staff is requesting that the City Council appropriate additional capital project funding and award the construction contract for the Park Re-Camping at Pine Tree, Peppertree and Frontier CIP No. 20066 to the lowest responsive/responsible bidder. Motion: It was moved by Councilmember Murray and seconded by Mayor Pro Tem Nielsen that the City Council: 1. Appropriate and transfer $14,000 from undesignated/unappropriated Park Development Fund (Fund 131) to the capital project budget for Park Re-Camping, CIP No. 20066; and 2. Award the construction contract for the Park Re-Camping at Pine Tree, Peppertree and Frontier CIP No. 20066 to the lowest responsive/responsible bidder, Anderson-Howard Electric, in the amount of $121,978, and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. Motion carried 4-0 4. AMEND KELLER DRIVE PARKING RESTRICTIONS In response to a request made by the Mandevilla Condominium Complex, staff is requesting the City Council to amend parking restrictions on the north side of Keller Drive to allow parking on Friday nights to accommodate programs at the Tustin Sports Park while reducing parking encroachments/violation within the adjacent private condominium complex. City Council/Redevelopment Agency/ Tustin Public Financing Authority May 17, 2011 Minutes Page 3 of 7 Motion: It was moved by Councilmember Murray and seconded by Mayor Pro Tem Nielsen that the City Council amend Keller Drive parking restrictions to allow parking on the north side of Keller Drive on Friday nights in addition to allowing parking during weekends, holidays, special events and for thirty minute intervals on weekdays. Motion carried 4-0 5. QUARTERLY INVESTMENT REPORT Government Code Section 53646 requires that the Treasurer make an Investment Report to the City Council at least quarterly showing balances by authorized investment and certifying its compliance with the adopted Investment Policy. Motion: It was moved by Mayor Pro Tem Nielsen and seconded by Councilmember Murray to receive and file. Motion carried 4-0 6. STATUS REPORT ON REDEVELOPMENT AGENCY PROJECTS SUMMARY Redevelopment Agency staff provides on a monthly basis an update of redevelopment related projects. Recommendation: Receive and File. 7. COUNCIL MEMBER IPAD POLICY Motion: It was moved by Mayor Amante and seconded by Councilmember Gomez to approve the policy with added clarification regarding the use of the IPAD for Council committee-related documents and establishing backup of the device prior to wiping clean the IPAD once the device is turned in. Motion carried 4-0 8. JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORTS This report transmits two John Wayne Airport Noise Abatement Quarterly Reports for the third and fourth quarters of 2010. The average noise level measured at monitoring station NMS 10N, located at Columbus Tustin Middle School on Beneta Way, remained relatively constant during the third and fourth quarters. Average noise levels during both quarters remained below the City, County, and State criteria of 65 dB Community Noise Equivalent Level (CNEL) for residential uses. Recommendation: That the City Council receive and file this report. SET DATE FOR FISCAL YEAR 2011-12 BUDGET WORKSHOP Staff is requesting that the City Council schedule a Budget Workshop for Fiscal Year 2011-12. The draft budget will be submitted to the City Council prior to the budget workshop. Motion: It was moved by Mayor Pro Tem Nielsen and seconded by Councilmember Murray to schedule a budget workshop for July 5, 2011 at 4:00 p.m. Motion carried 4-0 10. CITY MANAGER RECRUITMENT Motion: It was moved by Councilmember Murray and seconded by Mayor Pro Tem Nielsen that the City Council authorize Teri Black & Company (search firm) to proceed with recruitment of a City Manager pursuant to the terms of the agreement executed by the City and search firm in July 2010. Motion carried 4-0 11. LEGISLATIVE REPORT None OTHER BUSINESS/COMMITTEE REPORTS Councilmember Gomez • Visited Tustin High School construction • Attended AAUW meeting • Attended Teacher of the Year dinner sponsored by the Tustin Public Schools Foundation • Attended Beckman's Pancakes for Patriots and congratulated them on Distinguished School designation • Attended Acura open house on May 9 • Attended Historical Society tour • Visited Wescom's ribbon cutting • Had discussions with Magnolia Park visitors regarding tennis court lights Councilmember Murray • Attended Tustin Community Foundation volunteer luncheon • Attended the Chamber of Commerce new member reception • Attended the Tustin Family Youth Center Cinco de Mayo celebration • Attended the Orange County Human Relations awards banquet; congratulated the City Council/Redevelopment Agency/ Tustin Public Financing Authority May 17, 2011 Minutes Page 5 of 7 police department for receiving a community policing award • Attended WACO meeting; discussions included salt water intrusion possibility with a large earthquake • Attended the Association of California Cities Orange County (ACCOC) legislative meeting • Attended Mothers Day luncheon at Tustin Senior Center • Attended Tustin Acura's 25th anniversary • Attended ACCOC business council in Sacramento • Attended Promenade of Homes and Gardens • Attended Wescom Bank ribbon cutting • Announced that former Councilmember Jim Palmer received the Local Elected Official of the Year award from the GOP Central Committee • Looking forward to Tustin having new hotels and banquet facilities in the future Mayor Pro Tem Nielsen • Attended SCAG General Assembly meeting • Attended Orange County Sanitation District Administrative Committee meeting • Attended Tustin Community Foundation Volunteer Recognition luncheon • Attended Tustin Senior Center Mothers Day luncheon and thanked volunteers • Attended Andrew Markstrum's Eagle Scout Court of Honor • Attended Acura's 25th anniversary • Thanked Lions Club where he was the keynote speaker at the luncheon • Attended Tustin Area Historical Society home tour • Attended Teacher of the Year dinner Mayor Amante • Congratulated the Tustin Community Foundation for its volunteer luncheon; thanked Michael Demoratz and Lindbergh McPherson for hosting the event and for their generosity • Attended Chamber of Commerce receptions and encouraged to see new businesses and optimism • Attended with Mayor Cavecche of Orange National Day of Prayer event held by Lee Lescano at the Salvation Army; Major Lescano will now head up operations in San Diego and will be missed • Attended Tustin Public Schools Foundation dinner • Attended Dick Hsu's Acura 25th anniversary which was the first auto dealer in Tustin's auto center • Attended ACCOC Sacramento conference • Met with Bob Dutton, Senate Minority Leader, and others regarding public policy • Attended the May 12 ACCOC meeting • Thanked and congratulated Peter Buffa, former Mayor of Costa Mesa and OCTA Chair, who resigned to accept a position in Century City as Director in the Public Financing Department for Barclays Bank ADJOURNED at 8:26 p.m. -The next meeting is scheduled for Tuesday, June 7, 2011 at 5:30 p.m. for the Closed Session Meeting followed by the Regular Meeting at 7:00 p.m. in City Council/Redevelopment Agency/ Tustin Public Financing Authority May 17, 2011 Minutes Page 6 of 7 the Council Chamber, 300 Centennial Way, Tustin, California.
