HUSTON, INTERIM CITY MANAGER FROM: PATRICIA ESTRELLA, CITY CLERK SERVICES SUPERVISOR SUBJECT: APPOINTMENT OF AUDIT COMMISSIONER SUMMARY At its March 15, 2011 meeting, the City Council appointed Audit Commissioners to fill vacancies created by term expirations of three Audit Commissioners. With the reappointment of Richard Hilde, no vacancies remained for a commissioner residing outside Tustin but within the area served by the Tustin Water Department. The City Council may: Reconsider appointment of Kim Leason Direct staff to accept applications and set date for Audit Commissioner interviews Other RECOMMENDATION Pleasure of the Council. FISCAL IMPACT None. BACKGROUND On January 18, 2011, the City Council set March 15 at 5:30 p.m. to conduct interviews to frll the vacancies on the Planning Commission, Community Services Commission and Audit Commission. Following the initial vote and two additional runoff votes, Craig Shimomura, Richard Hilde and Kim Leason were appointed Audit Commissioners by majority vote. Recent revisions to the Tustin City Code state that "The Audit Commission shall consist of five (5) members, each of whom shall be both residents and registered voters of the City during all times they hold office, subject to the following exception. Up to two (2) members may reside and be registered voters within the area served by the Tustin Water Department, but outside the City." With the reappointment of Richard Hilde on a prior ballot, two members resided and were registered voters within this area (Lavairence R. Friend as the other Audit Commissioner) and the third member was required to be a resident and voter in Tustin. At the time of the selection, Kim Leason did not reside in Tustin and did not meet the qualifications for appointment once Mr. Hilde was reappointed. However, Mr. Leason has since relocated within city limits. He has not been sworn in as Audit Commissioner.
