HUSTON, INTERIM CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: LEGISLATIVE REPORT -SENATE BILL (SB) 730 SUMMARY: SB 730 would require the California Energy Commission to develop a pilot program to streamline the permitting of electric vehicle charging infrastructure and conduct consumer education. SB 730 has been significantly amended since being introduced, and its potential impact on local jurisdictions has been minimized. A copy of SB 730 is included as Attachment A to this report. RECOMMENDATION: That the City Council direct staff to monitor SB 730. FISCAL IMPACT: No impact to the City's General Fund is anticipated at this time. DISCUSSION: Existing Law Existing law provides for the following: • Establishes the Alternative and Renewable Fuel and Vehicle Technology Program to provide loans and grants for the development and implementation of innovative technologies that transform California's fuel and vehicle types to help attain the state's climate change goals. • Specifies that only certain projects or programs are eligible for this state funding, including a program to provide funding for homeowners who purchase an electric vehicle to offset costs associated with modifying electrical sources to accommodate a residential plug-in electric vehicle charging station. SB 730 June 7, 2011 Page 2 Proposed Law SB 730 would do the following: • Direct the California Energy Commission (Commission) to develop and administer the Plug-In Electric Vehicle Readiness Pilot Program to address issues relating to electric vehicle residential charging infrastructure needs. • Require the pilot program to include the development of expedited and streamlined local permitting of charging infrastructure, customer outreach, and planning for public and workplace charging opportunities. • Require the Commission to develop a process for evaluating the success of the pilot program and to report the results to the Legislature. • Require the Commission to solicit the involvement of cities and counties for participation in the pilot program. • Sunset on January 1, 2015. Attached for the Council's information is a copy of SB 730. As amended, the bill no longer proposes to require building permit approval for vehicle charging equipment applications within one business day nor inspections within seven days. Thus, the amended version of SB 730 would not impose astate-mandated local program. Given the fiscal and staffing impacts associated with the potential requirement for expedited local permitting of charging infrastructure, staff will continue to monitor SB 730 and report back to the Council as needed. Existing law specifies that only certain proj ects or programs are eligible for funding, including a program to provide funding for homeowners who purchase an electric vehicle to offset costs associated with modifying electrical sources to include a residential plug-in electric vehicle charging station. This bill would, , establish the Plug-In Electric Vehicle Readiness Pilot Program to be administered by the commission. The bill would require that the program include, but not be limited to, strategies that address several objectives relating to the permitting and planning of plug-in electric vehicle residential charging. The bill would also require the commission to solicit statewide the involvement of cities and counties for participation in the program. The bill would repeal these provisions on January 1, 201 S. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: Arno. The people of the State of California do enact as follows: 1 SECTION 1. Article 2.5 (commencing with Section 44273.5) 2 is added to Chapter 8.9 of Part S of Division 26 of the Health and 3 Safety Code, to read: 4 5 Article 2. S. Plug-In Electric Vehicle Readiness Pilot Program 6 7 44273.5. (a) The Plug-In Electric Vehicle Readiness Pilot 8 Program is hereby created. The program shall be administered 9 by the State Energy Resources Conservation and Development 10 Commission. The commission shall implement the program by 96 - 3 - SB 730 1 regulation pursuant to the requirements of Chapter 3. S 2 (commencing with Section 11340) of Part 1 of Division 3 of Title 3 2 of the Government Code. The commission shall solicit the 4 involvement of cities and counties statewide for participation in 5 the program. The program shall include, but not be limited to, 6 strategies that address all of the following: 7 (1) The development of expedited and streamlined permitting 8 of plug-in electric vehicle (PEV) residential charging. 9 (2) Customer PEV education and outreach. 10 (3) The provision of information to PEV owners concerning a 11 point of contact with the appropriate local government entity. 12 (4) Public and workplace infrastructure PEV planning, 13 including, but not limited to, planning relating to compliance with 14 the federal Americans with Disabilities Act of 1990 (42 U.S.C. 15 Sec. 12101 et seq.). 16 (S) Ensuring utility not cation of residential level 2 PEV 17 chargers. 18 (b) The commission, in consultation with participating cities 19 and counties, shall develop a process for evaluating the 20 effectiveness of the pilot program.
