STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: AWARD CONTRACT FOR THE MITCHELL AVENUE STORM DRAIN PROJECT CIP 50035 SUMMARY Staff is requesting that the City Council award the construction contract for the Mitchell Avenue Storm Drain Project CIP 50035 to the lowest responsive/responsible bidder and appropriate $267,312 from the un-appropriated reserves of the Gas Tax Fund to the project, pending final CDBG FY 2011-2012 allocation from United States Department of Housing and Urban Development (HUD). RECOMMENDATION It is recommended that the City Council: Appropriate $267,312 from the un-appropriated reserves of the Gas Tax Fund; and 2. Award the construction contract for the Mitchell Avenue Storm Drain Project CIP 50035 to the lowest responsive/responsible bidder, GCI Construction, Inc., in the amount of $724,618.55, and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. FISCAL IMPACT $560,036 has been budgeted and appropriated in this Fiscal Year 2010-2011 Capital Improvement Program for this project, of which $483,155 is funded from the City's Community Development Block Grant (CDBG) Program, including recent reallocations by the City Council. The City's CDBG One Year Action Plan for Program Year 2011-2012, which includes additional funds for the Mitchell Avenue Storm Drain construction, was approved by the City Council on April 19, 2011 and was subsequently submitted to the United States Department of Housing and Urban Development (HUD). The City has received preliminary confirmation from HUD as to the amount of the City's CDBG Program Year 2011-2012 allocation. The amount to be allocated to the Mitchell Avenue Storm Drain construction has been determined to be $267,312. However, since the confirmation from HUD is preliminary, staff recommends, in order to maintain the current project schedule and construction window utilizing the summer months to minimize related school impacts, that $267,312 be allocated from the un-appropriated reserves of the Gas Tax Fund to award the project. Final confirmation and allocation from HUD is expected in August. Upon receipt, the CDBG 2011-2012 project allocation will credited against any Gas Tax Fund project expenditures and all remaining Gas Tax Funds will be returned to fund balance. Mitchell Avenue Storm Drain Project CIP 50035 June 7, 2011 Page 2 Additionally, approximately $50,000 of Mitchell/Utt intersection improvements associated with this project are eligible State legislated Safe Routes to School (SR2S) for CIP 40073 and will be credited against the grant accordingly. DISCUSSION The proposed project covers the segment of Mitchell Avenue between Newport Avenue and Red Hill Avenue. The existing corrugated metal pipe arch (CMPA) storm drain, located in the northerly parkway of Mitchell Avenue, was investigated and found to be in a severe state of deterioration. The project consists of lining the existing pipe with cured in place pipe (CIPP); connection of existing storm drain laterals; removal of existing concrete cross-gutters and installation of new catch basins at various street intersections; installation of curb ramps at intersections to be in compliance with current federal Americans with Disabilities Act (ADA) requirements; modifications to existing water mains in conflict with the proposed storm drain improvements; replacement of striping and pavement markings; and adjustment of manhole rims and valve boxes to grade. In order to minimize the impact of construction activities on the school and adjacent residences, construction of the project will be completed in conjunction with the Mitchell Avenue/Utt Drive Pedestrian Enhancements Project CIP 40073 and will be scheduled to occur during the summer months while the Beswick Elementary School is not in session. Certain items of work, including replacement of curb ramps, cross-gutter, and paving at the Mitchell Avenue/Utt Drive intersection are eligible to be paid for with the State Safe Routes to Schools grant for CIP 40073 and will be charged to that project. Formal bids were publicly opened on May 19, 2011 and reviewed by Public Works. Three (3) bids were received and are summarized below by order of least dollar amount: GCI Construction, Inc ............................................................... $724,618.55 Mike Prlich & Sons, Inc ............................................................. $872,722.50 Palp, Inc. dba Excel Paving Company ....................................... $914,264.00 Staff has reviewed the references and State Contractor's License for GCI Construction, Inc. and has determined that they are appropriate for the subject project. It is recommended that the City Council appropriate $267,312 from the un-appropriated reserves of the Gas Tax Fund to maintain project schedule and award the construction contract for the Mitchell Avenue Storm Drain Project CIP 50035 to the lowest responsive/responsible bidder, GCI Construction, Inc., and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City.
