HomeMy WebLinkAboutPC Minutes 05-24-11ITEM # 1 MINUTES REGULAR MEETING ( TUSTIN PLANNING COMMISSION MAY 24, 2011 7:02 p.m. CALL TO ORDER: Given INVOCATION/PLEDGE OF ALLEGIANCE: Commissioner Eckman ROLL CALL: Present: Chair Thompson Chair Pro Tem Puckett Commissioners Eckman, Kozak, Moore Staff Present James Eggart, City Attorney Dana Ogdon, Assistant Community Development Director Captain Steve Lewis, Tustin Police Department Lieutenant Paul Garaven, Tustin Police Department Justina Willkom, Principal Planner Scott Reekstin, Senior Planner Amy Thomas, Senior Planner Ryan Swiontek, Associate Planner Erica Rabe, City Clerk Services Specialist Adrianne DiLeva, Recording Secretary PRESENTATION: ORANGE COUNTY HUMAN RELATIONS COMMUNITY POLICING AWARD FOR THE NITF ALLIANCE PROJECT Amy Thomas described the NITF (Neighborhood Improvement Task Force) Alliance Project along with collaborative efforts between the City of Tustin Community Development Department, Code Enforcement, and the Tustin Police Department, in earning the given award. Lieutenant Garaven discussed the value of the NITF and provided statistics regarding the positive effects it is having on the City of Tustin. The Planning Commission commended the NITF for their accomplishment. None PUBLIC CONCERNS CONSENT CALENDAR: Approved 2. APPROVAL OF MINUTES -MAY 10, 2011, PLANNING COMMISSION MEETING. Agenda -Planning Commission May 24, 2011 -Page 1 It was moved by Puckett, seconded by Kozak, to approve the Consent Calendar. Motion carried 5-0. PUBLIC HEARINGS: Adopted Resolution 3. CONTINUED THREE-FOOT LANDSCAPE No. 4173 pending REQUIREMENT AND SYNTHETIC TURF STANDARDS amendment by staff On May 10, 2011, the item was brought before the Planning Commission for consideration of the three-foot landscape requirement and to consider the Draft Synthetic Turf Standards. The items were presented and discussed at the hearing. The Planning Commission recommended minor changes to the Synthetic Turf Standards and requested that the three-foot landscape ordinance be clarified with the intent to protect and maintain an attractive buffer between driveways of abutting residential properties to enhance the attractiveness of a residential property as viewed from adjoining properties and/or the public right of way. The Planning Commission further suggested that the three- foot landscape/hardscape requirement be subject to review, at the discretion of the Community Development Director, to allow flexibility in the application of the Code and to ensure consistency with the intent of the ordinance. The review would be subject to specific findings to ensure that the location, size, architectural features and general appearance of any proposed improvements will attain the desired aesthetic effect between residential properties. The matter was continued to May 24, 2011, and the requested modifications have been incorporated into Ordinance No. 1358. The revisions are shown in red underline format throughout the revised documents. Minor changes, as suggested by the Planning Commission, have also been incorporated into the Synthetic Turf Standards. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4173 approving Code Amendment 11-004 recommending that the Tustin City Council adopt Ordinance No. 1398 amending Tustin City Code Sections 5502 and 9267 modifying landscape requirements and setting forth Synthetic Turf Standards. Thomas Presented the Continued Three-Foot Landscape Requirement staff report. Staff answered Planning Commission questions. The Public Hearing opened at 7:28 p.m. No members of the public stepped forward. The Public Hearing closed at 7:28 p.m. Motion: The motion was moved by Kozak, seconded by Eckman, to adopt Resolution No. 4173 recommending that the City Council adopt Ordinance No. 1398 pending modifications to be made by staff. Motion carried 4-0. Adopted Resolution 4. CODE AMENDMENT 2011-03, DRAFT ORDINANCE NO. No. 4148 pending 1381 REASONABLE ACCOMMODATION ORDINANCE amendment by staff The federal Fair Housing Amendments Act of 1988 and California's Fair Employment and Housing Act impose an affirmative duty on local governments to make reasonable accommodation in their land use and zoning regulations and practices when such accommodation may be necessary to afford individuals with disabilities an equal opportunity to housing. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4148, recommending that the Tustin City Council adopt Draft Ordinance No. 1381, adding Section 9278 to the Tustin City Code to establish a procedure to provide individuals with disabilities reasonable accommodation in regulations and procedures to ensure equal access to housing, and to facilitate the development of housing for individuals with disabilities. The ordinance provisions would be applicable citywide. Swiontek Presented the Reasonable Accommodation Resolution and Draft Ordinance. Staff answered Planning Commission questions. The Public Hearing closed at 7:53 p.m. Motion: The motion was moved by Kozak, seconded by Puckett, to adopt Resolution No. 4148 recommending that the City Council adopt Draft Ordinance No. 1381 pending modifications to be made by staff. Motion carried 5-0. None REGULAR BUSINESS: 5. STAFF CONCERNS: REPORT OF ACTIONS TAKEN AT THE MAY 17, 2011, CITY COUNCIL MEETING. The Assistant Director indicated nothing to report. COMMISSION CONCERNS: Eckman Stated an individual from Tustin Ranch expressed concern regarding the refurbishment of handicap ramps within the curb. Puckett Stated he completed his 100-Hole Golf Marathon and with everyone's help, he was the top fundraiser raising $5,375 for student scholarships for Hope International University; approximately $40,000 was raised in total; • Commented on the tornado in Joplin, Missouri, and stated the lives affected by this storm should continue to be kept in our prayers. Moore Thanked staff for their work; • Stated the Tustin Community Foundation Volunteer Lunch prompted his wife to volunteer for the Village of Hope; said this organization is effective at spreading the need to volunteer and give back to the community; • Wished everybody a happy Memorial Day; stated his heart goes out to all the families who have sacrificed family members throughout history, and thanked the men and women of the military for their service; • Stated he will attend his first Chili Cook-off and is looking forward to this event in June. Kozak • Provided detail regarding the Tustin Street Fair and Chili Cook-off on Sunday, June 5t" from 11a.m. to 5p.m.; Agenda -Planning Commission May 24, 2011 -Page 4 • Stated Tustin Community Pride is taking applications and nominations through June 15t" for the 2011 Landscape } Awards for residential properties in which judging will take place between June 17 - 23`d; • The 16t" annual State of the City Luncheon is approaching on June 2nd; • Will be attending the ribbon-cutting ceremony for the Kinship Center; • Stated Concerts in the Park are approaching, and he is looking forward to those events; • Stated Tom Woodruff, a 30-year resident of the community and the original founder of Woodruff, Spradlin, and Smart has passed away; requested to close the meeting in his honor. Thompson Stated he attended the OCTA Citizens' Advisory Committee Meeting, will provide a further update at the upcoming City Council meeting; • Commented on the Kinship Center ribbon-cutting, the State of the City Luncheon, and the Chili Cook-off. 8:09 p.m. ADJOURNMENT: The next regular meeting of the Planning Commission is scheduled for Tuesday, June 14, 2011, at 7:00 p.m. in the City Council Chamber at 300 Centennial Way.
