SUBJECT: ADOPT RESOLUTION NO. 11-43 DECLARING THE CITY'S INTENT TO
VACATE A PORTION OF PROPERTY ADJACENT TO EL CAMINO REAL
BETWEEN RED HILL AVENUE AND NEWPORT AVENUE, AND SET A
PUBLIC HEARING
SUMMARY
The City received a request from property owners at 1450 EI Camino Real to purchase city
property along the south side of EI Camino Real (formerly Laguna Road) to be used to expand
their parking facilities. The subject city parcel and street easement is no longer needed for public
roadway or utility purposes. The expanded parking facilities would ease some of the current
congestion caused by vehicles queuing onto EI Camino Real as a result of the parking lot being
full.
RECOMMENDATION
It is recommended that the City Council:
1) Adopt Resolution No. 11-43 declaring the City's intent to vacate a portion of real property
adjacent to EI Camino Real and a portion of an easement between Red Hill Avenue and
Newport Avenue, and
2) Set a public hearing for July 19, 2011, at 7:00 P.M. in the City Council Chambers to consider
the matter.
FISCAL IMPACT
There is no fiscal impact associated with this action.
DISCUSSION
The owners of the commercial retail center at 1450 EI Camino Real desire to construct additional
parking spaces at their site to accommodate employee and customer parking needs. Acquisition
of property from Caltrans and the City of Tustin will be necessary to accommodate the additional
parking. A boundary survey depicting the property orientation at the intersection of Red Hill
Avenue and EI Camino Real is attached, along with an enlargement of the portion of city property
under consideration.
The City owns Parcel F shown on the attached boundary survey in fee and the easement for street
purposes adjacent to Parcel F. Parcel F and the street easement are portions of old Laguna Road
(now EI Camino Real) right-of-way, which was abandoned when EI Camino was realigned in
conjunction with construction of the Santa Ana Freeway... Parcel F is approximately 1,721 square
feet and the subject portion of street easement is approxirrf~tely 1,806 square feet.

It has been determined that the City parcel (Parcel F) and the subject portion of street easement
are not needed for future street right-of-way since EI Camino Real is currently constructed to a
secondary arterial highway standard as required under the City's Circulation Element of the
General Plan and the Orange County Master Plan of Arterial Highways. There are no public
utilities currently existing within the fee parcel or the street easement, and none are anticipated in
the future.
A public hearing is required to consider this request. Staff is proposing that that the City Council
set the hearing on July 19, 2011, at 7:00 P.M. in the City Council Chambers.

RESOLUTION NO. 11-43
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, DECLARING ITS INTENTION TO VACATE AND
ABANDON A PORTION OF REAL PROPERTY ADJACENT TO EL
CAMINO REAL AND A PORTION OF AN EASEMENT BETWEEN RED
HILL AVENUE AND NEWPORT AVENUE, AND TO SET A TIME AND
PLACE FOR A PUBLIC HEARING THEREON
WHEREAS, the City Council of the City of Tustin has been requested to vacate a
portion of real property adjacent to EI Camino Real and a portion of an easement
between Red Hill Avenue and Newport Avenue; and
WHEREAS, the City Council of the City of Tustin is responsible for maintaining a
transportation and circulation system for the City of Tustin; and
WHEREAS, the portion of real property adjacent to EI Camino Real and the
portion of an easement between Red Hill Avenue and Newport Avenue, as described in
the attached Exhibit "A" and shown on the attached Exhibit "B", is not an essential or
integral part of said transportation and circulation system; and
NOW THEREFORE, the City Council of the City of Tustin does hereby resolve as
follows:
1. It is the intention of the City Council to vacate a portion of real property
adjacent to EI Camino Real and a portion of an easement between Red Hill
Avenue and Newport Avenue as described in Exhibit "A" and shown on
Exhibit "B" attached hereto and incorporated herein by this reference and on
file in the office of the City Clerk.
2. It is the intention to make a finding that the peal property adjacent to EI
Camino Real and the portion of an easement between Red Hill Avenue and
Newport Avenue is unnecessary for present or prospective public street
purposes or as anon-motorized transportation facility.
3. It is the intention to find that the project is categorically exempt from CEQA
requirements (Section 65402 (a) of the California Government Code).
4. A public hearing is hereby set for July 19, 2011 at 7:00 P.M., in the
Chambers of the City Council at 300 Centennial Way, Tustin, California for a
hearing of all persons interested in, or objecting to, the proposed vacation.

5. This resolution shall be published once in the Tustin News, a newspaper of
general circulation published in the City of Tustin, not less than fifteen (15)
days before said hearing and notice of said hearing shall be posted
conspicuously along the line of those portions adjacent to EI Camino Real
proposed to be vacated not less than ten (10) days before said hearing, and
not more than three hundred feet (300') apart and not less than three (3)
copies shall be posted.
6. The City elects to proceed under the provisions of Chapter 2, Part 3, Division
9 (Section 8320, et. seq.) of the California Streets and Highways Code.
PASSED AND ADOPTED at a regular meeting of the City Council held on the
21st day of June 2011.
