A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, APPROVING USE DETERMINATION 98-001 TO ALLOW
PROFESSIONAL, INSTRUCTIONAL, MOTIVATIONAL OR SEMINAR
SCHOOLS AS A CONDITIONALLY PERMITTED USE IN THE OFFICE AS
PRIMARY USE DESIGNATION OF THE FIRST STREET SPECIFIC PLAN
(FSSP).
Planning Commission does hereby resolve as follows:
The Planning Commission finds and determines as follows:
A.
That a proper application for Use Determination 98-001 was filed by Oscar
Montalvo to request a use determination from the P!anning Commission for
establishment of a driving school at 205-215 First street, Suite 201, 210,
211 and 212, more specifically.described as Assessor's Parcel No. 401-
531-13, 14.

According to First Street Specific Plan (FSSP) driving schools are not listed
uses in the Office Primary land use designation and require a use
determination by the Planning Commission as stated in Section III C (6) of
the FSSP.
That a public hearing was duly called, noticed and held on said application
on January 25, 1999, by the Planning Commission.

The Commission finds that the proposed use will not impair the orderly and
harmonious development of the area, the present or future development
therein, or the occupancy as a whole.
F.
The Planning Commission finds that approval of the use determination to
allow professional, instructional, motivational or seminar schools in the First
Street Specific Plan, Office as Pdmary Use designation can be supported
by the following findings:
1)
The proposed use is consistent with the overall intent of the Office as
Primary Use designation which is to encourage a variety of offices
and community facilities in that professional, instructional,
motivational or seminar schools typically offer a community service in
an office setting.
2)
The proposed use is c.~nsistent with the other listed permitted uses
in the planning unit, in that professional, instructional, motivational or
seminar schools are similar to conditionally permitted uses in the
planning unit such as churches and fraternal organizations that
provide for large gatherings. These types of schools typically do not
generate more traffic or noise otherwise associated with other office
uses in the area. To ensure compatibility, as conditionally permitted

uses in the area. To ensure compatibility, as conditionally permitted
uses, professional, instructional motivational or seminar schools
would be reviewed on a case by case ba§i's by the Planning
Commission.
That this project is categorically exempt pursuant to Section 15301 (Class
1) of the California Environmental Quality Act.
II.
The Planning Commission hereby approves Use Determination 98-001 to allow
professional, instructional, motivational or seminar schools as a conditionally
permitted use in the Office as Primary Use designation of the First Street Specific
Plan (FSSP).
PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular
meeting on the 25th day of January, 1999.
