HomeMy WebLinkAboutPC RES 3646]0 2O 1_3 24 2_'5 26 RESOLUTION NO. 3646 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN APPROVING CONDITIONAL USE PERMIT 98-032 TO AMEND THE MASTER SIGN PROGRAM FOR THE TUSTIN MARKETPLACE TO ALLOW FOR PAD TENANTS WHO OCCUPY A BUILDING OF AT LEAST 10,000 SQUARE FEET AS A SOLE TENANT TO HAVE UP TO 300 SQUARE FEET OF WALL SlGNAGE ALLOCATED AMONG UP TO FOUR ELEVATIONS AS DESIRED WITH A MAXIMUM OF 150 SQUARE FEET OF SlGNAGE ON ANY ONE ELEVATION. The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: Ao That a proper application, Conditional Use Permit 98-032, was filed by The Cooper Group and Stuart Anderson's Restaurants on behalf of Irvine Retail Properties requesting approval of an amendment to the Master Sign Plan for the Tustin Marketplace to allow pad tenants occupying a building of at least 10,000 square feet of floor area as a sole tenant to have up to 300 square feet of signage allocated among up to four elevations as desired with a maximum of 150 square feet of signage on any one elevation. B, That a master sign plan less restrictive than the sign code is allowed pursuant to Tustin City Code Section 9403(H)(2)(e) with the approval of a Conditional Use Permit. Ce That a public hearing was duly called, noticed and held for said application on January 11, 1999 by the Planning Commission. BI Pursuant to Sign Code Section 9403h(2), the request to amend the master sign plan can be supported by the following findings: o The signs reflect a common theme, incorporating design elements in terms of materials, letter styles, colors, illumination, sign type and sign shape. The new wall signs utilize open channel letters, Iogos and neon banding, as encouraged by the existing Master Sign Plan. . All of the new signs utilize materials, colors, and a design motif which are compatible and which reflect the special qualities of the architecture of the existing buildings both in daytime and nighttime settings. The Tustin Marketplace encourages larger scale signage and distinctive designs that complement the multi-colored stucco buildings. . Provisions of the proposed Master Sign Program. may be less restrictive than the standards for permanent business identification within the Tustin Sign Code provided the center is greater than one l? 20 24 25 26 2? 28 Resolution No. 3646 Page 2 acre in size. 1 The Master Sign Program, as conditioned, will not be detrimental to the health, safety, morals, comfort and general welfare of the persons residing in or working in the neighborhood of the use, nor will it be injurious or detrimental to property or improvements in the vicinity or to the general welfare of the City in that: a) The new wall signage uses materials, colors, and styles complementary to existing signage and buildings within the Tustin Marketplace; and, b) The signage allowed under the Master Sign Program uses materials, colors, and styles appropriate for a mixed-use commercial and entertainment center. c) Increased sign area for Pad Tenants occupying a building of at least 10,000 square feet as a sole tenant is appropriate to reflect the size and scale of such a building and tenant within a mixed-use center. E. That this project is categorically exempt pursuant to Class 11, Section 15311 of the California Environmental Quality Act. II. The Planning Commission hereby approves CUP 98-032 for an amendment to the Master Sign Program for the Tustin Marketplace allowing pad tenants that occupy at least 10,000 square feet of building space as a sole tenant to have up to 300 square feet of wall signage allocated among up to four elevations as desired, with a maximum of 150 square feet of signage on any one elevation, subject to the conditions contained in Exhibit A, attached hereto. BINS-ACK Planning Commission Secretary ]2 ]8 ]9 20 2] 23 ~4 ~5 26 2? -"8 29 (1) (1) (2) (3) (4) EXHIBIT A CONDITIONAL USE PERMIT 98-032 CONDITIONS OF APPROVAL RESOLUTION NO. 3646 GENERAL 1.1 The proposed signs shall substantially conform with the submitted plans for the project date stamped January 11, 1999, on file with the Community Development Department, except as herein modified, or as modified by the Director of Community Development in accordance with this Exhibit. The Director of Community Development may also approve minor modifications to plans during plan check if such modifications are to be consistent with the provisions of the Tustin City Code and other applicable codes. 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with as specified or prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. 1.3 The subject project approval shall become null ~nd void unless permits are issued within twelve (12) months of the date of this Exhibit and substantial construction is underway. Time extensions may be granted if a wdtten request is received by the Community Development Department within thirty (30) days prior to expiration. 1,4 Approval of Conditional Use Permit 98-032 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. 1,5 The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's approval for this project. 1,6 All signs shall be maintained in ~3roper operating order at all times, if the City' becomes aware of any lighting or signs that are not operable, the applicant shall be responsible for making appropriate repairs within 72 hours of being notified by the City. The entire sign shall not be illuminated until such repairs are completed. (1) 2,2 All signs, including any change of copy, require review and approval by the Community Development Department prior to installation. Permits shall be required for all signs. (5) 2.3 All signs shall conform to the City of Tustin Sign Code and the Tustin Marketplace Master Sign Program includin, g window signs, which shall not exceed 15% of the glass area upon which the sign is located. (5) 2.4 All signs and their supporting structures shall be enclosed, structurally safe, and maintained in good condition and shall comply with the most current Uniform Building Codes, as locally amended. (5) 2.$ All types of signs prohibited pursuant to Tustin City code Section 9404(A)(1), such as aerial signs, animated signs, audible signs, beacons, festoons, flashing or moving signs, light bulb strings, roof mounted signs, and projecting signs, are not permitted. PLAN SUBMrl-rAL (5) 3.1 Three (3) sets of construction level plans with necessary, specifications, and details prepared in accordance with the Uniform Building Code, and other related Codes, City Ordinances, and state and federal laws and regulations shall be submitted for review and approval by the Community Development Department. Compliance with approved plans shall be inspected by the Community Development Department during construction and prior to final inspection. FEES (1) 4,1 Prior to issuance of any building permits, all payments shall be made of all applicable fees including the building division and sign permit fees, including but not limited to the following. Payment shall be required based upon those rates in effect at the time of payment and are subject to change. A) Building plan check and permit fees to the Community Development Department based on the most current schedule. ]0 14 ]? 20 24 25 26 2? Exhibit A - Conditions of Approval iCup 98-032 Page 3 1) 4.2 Within forty-eight (48) hours of approval of the subject project, the applicant · shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $38.00 (thirty eight dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
