HomeMy WebLinkAboutPC RES 3634RESOLUTION NO. 3634 14 20 24 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, DENYING VARIANCE 98-006 A REQUEST TO PERMIT THE USE OF TANDEM PARKING FOR ONE OF THREE REQUIRED ENCLOSED PARKING SPACES IN CONJUNCTION WITH DESIGN REVIEW 98-012 (A REQUEST TO CONSTRUCT 114 SINGLE FAMILY RESIDENTIAL UNITS ON LOTS 9 AND 10 OF TRACT 13627) The Planning Commission of the City of Tustin does hereby resolve as follows: The Planning Commission finds and determines as follows: Ao That a proper application for Variance 98-006 has been filed by Brookfield Homes requesting that one of three required enclosed parking spaces be provided in tandem configuration in conjunction with Design Review 98-012, a request to construct 114 single family residential units on Lots 9 and 10 of Tract 13627. Be That a public headng was duly called, noticed and held for said item by the Planning Commission on November 23, 1998. C, There are no special circumstances applicable to the subject property, including size, shape, topography, location or surroundings that would prevent compliance with the requirement to provide three independently accessible parking space or deprive the subject .property of privileges enjoyed by other properties in the vicinity and under identical zone classifications in that: , Given the physical features of the Project site and the proposed site plan, it is feasible to provide three independently accessible enclosed parking spaces and meet all development standards of the Estate Density Residential/Hillside District. , The provision of three independently accessible enclosed parking spaces does not deprive properties of 'sufficient front, side, and rear yards and other site amenities enjoyed by similar developments in East Tustin. Do That a variance constitutes a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated in that similar projects within the Estate Density Residential/Hillside District have been required to provide three independently accessible enclosed parking spaces. ]0 15 2o 24 26 Resolution No. 3634 Page 2 II. Eo That a variance may adversely affect the interests of residents and properties in the development in that those properties with tandem parking configurations may be more inclined to use on-street guest parking rather than tandem parking spaces that are not readily accessible. The Planning Commission hereby denies Variance 98-006 disallowing the use of tandem parking for one of three required enclosed parking spaces in conjunction with Design Review 98-012, a request to construct 114 single family units on Lots 9 and 10 of Tract 13627.
