SUMMARY
Approval of Amendment No. 9 to the Consultant Services Agreement with Tetra Tech will provide
for additional design services for the Rawlings Reservoir Replacement Project CIP No. 60136.
RECOMMENDATION
It is recommended that the City Council approve Amendment No. 9 to the Consulting Services
Agreement with Tetra Tech for the Rawlings Reservoir Replacement Project CIP 60136 and
authorize the Mayor and the City Clerk to execute the amendment on behalf of the City.
FISCAL IMPACT
The scope of services associated with the contract amendment is for a not to exceed amount of
$184,400. Sufficient funds are budgeted and appropriated in the Rawlings Reservoir Replacement
Project CIP No. 60136.
DISCUSSION
In 1996, an engineering study identified several structural deficiencies in the existing 3.82 million
gallon (MG) Rawlings Reservoir. The reservoir was taken out of service in November 2004. The
Rawlings Reservoir Replacement project consists of demolishing the existing reservoir and
replacing it with two (2) circular pre-stressed concrete reservoirs of 3.0 MG each.
During the on-going constructability review, it was deemed appropriate to separate the overall
project into two phases: Phase I -Demolition and Phase II -Reservoir Construction. Phasing the
project in this way enables the City to perform additional geotechnical investigations after the
reservoir is demolished. This will greatly reduce the geotechnical unknowns under the existing
reservoir and thus avoid potentially costly delays to the future reservoir construction.
Amendment No. 9 to Tetra Tech's Consultant Services Agreement includes the design services to
complete Phase II -Reservoir Construction plans and specifications incorporating the results of
the additional geotechnical investigations, and additional design to grade back the adjacent
property on the west in lieu of the more expensive tie-back shoring design. This amendment also
includes Construction Phase Support Services during both Phase I and Phase II, including but not
limited to shop drawing review, responding to the RFI's, minor plan changes, change order
support, and record drawings.

Tetra Tech is the design engineer for the Rawlings Reservoir Replacement Project. Based on the
additional scope of services outlined above, Tetra Tech submitted proposals dated February 21,
2011 and April 15, 2011 in the total amount of $184,400. Staff has reviewed Tetra Tech's
proposals and found them to be fair and reasonable based upon the amount of additional design
services required.
Staff recommends that the City Council approve Amendment No. 9 to the Consulting Services
Agreement with Tetra Tech for the Rawlings Reservoir Replacement Project CIP No. 60136. The
City Attorney has reviewed the Amendment and has approved it as to form.

TO
CONSULTANT SERVICES AGREEMENT
FOR
ADDITIONAL ENGINEERING DESIGN SERVICES FOR
RAWLINGS RESERVOIR REPAIR AND REPLACEMENT PROJECT
THIS AMENDMENT NO. 9 TO CONSULTANT SERVICES AGREEMENT
("Amendment No. 9") is made and entered into this day of 2011
by and between the CITY OF TUSTIN, a municipal corporation hereinafter referred to
as "City" and Tetra Tech, Inc. a California corporation, hereinafter referred to as
"Consultant".

WHEREAS, City and Consultant entered into a Consultant Services Agreement
as of November 15, 2004 (the "Agreement") for design and engineering services for the
Rawlings Reservoir Repair and Replacement Project; and
WHEREAS, City and Consultant desire to amend Section 1 and Section 4 of the
Original Agreement to provide additional engineering design services for the Rawlings
Reservoir Repair and Replacement Project.
NOW, THEREFORE in consideration of the mutual promises, covenants, and
conditions contained herein, and upon the terms and conditions hereinafter set forth, the
parties agree as follows:
AGREEMENT
Section 1: Section 1 of the Agreement is amended
Section 1 of the Agreement is hereby amended in its entirety to read as
follows.
Consultant shall perform all work necessary to complete in a manner satisfactory
to City, the services set forth in the City's Consultant Services Agreement dated
November 15, 2004, a copy of which is attached hereto marked as Exhibit "A"
and is by this reference incorporated into this Agreement.
Consultant shall also perform all services set forth in Exhibit "A" to the Original
Agreement and as set forth in Amendment Nos. 1 through 8.
Consultant shall also perform all services as set forth in Exhibit "B" to this
Amendment No. 9 attached hereto and incorporated into this Agreement by
reference.
Section 2: Section 4 of the Agreement is amended
Section 4 of the Agreement is hereby amended in its entirety to read as follows:
Section 4: Compensation
A. The compensation to be paid under the Original Agreement shall be as
set forth in Exhibit "A" and shall not exceed a total cost of $277,000.00.
B. The compensation to be paid under Amendment Nos. 1-8 shall not
exceed a total cost of $348,879.00.
C. The compensation to be paid under Amendment No. 9 as set forth in
Consultant's proposals dated February 21, 2011 and April 15, 2011
(Exhibit "B") shall not exceed a total cost of $184,400.00.
D. Consultant shall submit detailed monthly invoices, based upon the
actual work performed, accompanied by backup documentation as
requested by the City.
E. Progress payments for work completed shall be paid by the City as the
work progresses, within thirty (30) days of receipt of Consultant's
invoice with appropriate backup documentation.
F. Consultant shall provide City with a brief monthly synopsis of all tasks
performed and the fees accrued thereon in complete and sufficient
detail to fully apprise City of work progress.
Section 3:
Except as expressly amended herein, all other provisions of the Original
Agreement remain in full force and effect.
Section 4: Miscellaneous
A. If any term, covenant, condition, or provision of this Amendment No. 9 or the
application thereof to any person or circumstance, shall to any extent be held
by a court of competent jurisdiction to be invalid, void, or unenforceable, the
remainder of this Amendment No. 9, or the application thereof to any person
or circumstance, shall remain in full force and effect and shall in no way be
affected, impaired, or invalidated thereby.
B. This Amendment No. 9 shall be governed and construed in accordance with
the laws of the State of California. In the event of any legal action to enforce
or interpret this Amendment No. 9, the sole and exclusive venue shall be a
court of competent jurisdiction located in Orange County, California, and the
parties hereto agree to and do hereby submit to the jurisdiction of such court,
notwithstanding Code of Civil Procedure Section 394.
C. Each signatory to this Amendment No. 9 hereby warrants and represents that
each has been authorized to enter into this Amendment No. 9 on behalf of the
entity for whom they sign.

CONSULTANT SERVICES AGREEMENT
THIS AGREEMENT FOR CONSULTANT SERVICES, is made and entered into

WHEREAS, City requires the services of a consultant to famish the necessary
engineering services for the Rawlings Reservoir Repair and Replacement (CIP No.
6136) hereinafter referred to as "Project"; and .
WHEREAS, Consultant has submitted to the City a proposal dated October 6,
2004, a copy of which is attached hereto marked as Exhibit "A" and is by this reference
incorporated into this Agreement; and
WHEREAS, Consultant is qualified to provide the necessary services for the
Project and desires to provide said services; and
WHEREAS, City desires to retain the services of Consultant for said Project.
NOW, THEREFORE, for the consideration and upon the terms and conditions
hereinafter set forth, the parties agree as follows:
AGREEMENT
Section 1: Scooa of Consultant's Services
Consultant shall perform all work necessary to complete in a manner satisfactory
to City, the services set forth in Exhibit "A".
Section 2: Order of Precedence
In the event of a conflict between or among any of the documents comprising this
Agreement, the following order of precedence shall govern the provision in question:

Section 3: Time for Com letion
The time for completion of the work to be pertormed by Consultant is an essential
condition of this Agreement. Consultant shall prosecute regularly and diligently the
work of this Agreement according to reasonable schedules established by the City for
various items described and as outlined within Consultant's proposal. Consultant shall

not be accountable for delays in the progress of its work caused by any condition
beyond its control and without the fault or negligence of Consultant.
Section 4: Compensation
A. The compensation to be paid under this Agreement shall be as set forth in
Exhibit "A", not to exceed a total cost of $277,000.00
B. Consultant shall submit detailed invoices, based upon the actual work pertom~ed
accompanied by backup documentation as requested by the City.
C. Progress payments for work completed shall be paid by City as the work
progresses, within thirty (30) days of the date of Consultant's invoice.
D. Consultant shall provide City with a monthly itemization of all work performed,
and the fees accrued thereon, in complete and sufficient detail to fully apprise

Section 3: indeuendent Contractor
Consultant's relationship to City in the performance of this Agreement is that of
an independent contractor. Consultant's personnel performing services under this
Agreement shat! at all times be under Consultant's exclusive direction and control and
shall be employees of Consultant and not employees of City. Consultant shall pay all
wages, salaries and other amounts due its employees in connection with this
Agreement and shall be responsible for all reports and obligations respecting them,
such as social security, income tax withholding, unemployment compensation, workers'
compensation and similar matters.
Section 6: Indemnification
Consultant agrees to defend, indemnify, and hold City, its officers, agents,
employees, successors and assigns harmless from any loss, damage, injury, sickness,
death, or other claim made by any person and from all costs, expenses and charges
including attorney's fees caused by or arising out of Consultant's, its officers', agents',
subcontractors`, or employees' negligent acts, negligent errors, or negligent omissions
or willful misconduct, or conduct for which the law imposes strict liability on Consultant
in the performance or failure to perform this Agreement.
Section 7: Insurance
A. Consultant shall maintain in full force and effect during the term of these
Agreement policies of commercial general liability and automobile liability
insurance (each of which shall include property damage and bodily injury) and
each with limits of at least $1,000,000 combined single limit coverage per
occurrence.

B. Consultant shall maintain in full force and effect during the tens of this
Agreement a policy of professional liability insurance coverage with limits of at
least $1,000,000 combined single limit coverage per claim or per occurrence. If
Consultant provides claims made professional liability insurance, Consultant shall
also agree in writing either (1) to purchase tail insurance in the amount required
by this Agreement or to cover claims made within five {5) years of the completion
of Consultant's service under this Agreement, or (2} to maintain professional
liability insurance coverage with the same carrier in the amount required by this
Agreement for at least five (5) years after completion of Consultant's services
under this Agreement. Consultant shall also provide evidence to the City of the
purchase of the required tail insurance or continuation of the professional liability
policy by executing the attached Letter Agreement on Consultant's letterhead.
C. Consultant shall cant' and pay for such workers' compensation insurance as is
required fully protect Consultant and its employees under Califomia Worker's
Compensation Insurance Law. The insurance company shall agree to waive all
rights of subrogation against the City for losses paid under the policy, which
losses arose from the work performed by the named insured.
D. Other applicable insurance requirements are: (1) Name the City, its officials and
employees as an additional insured on the commercial, general and automobile
policies. (2) The insurance shall be issued by a company authorized by the
Insurance Department of the State of Califomia and rated A, VII or better (if an
admitted carrier) or A-, X (if offered, by a surplus line broker), by the latest edition
of Best's Key Rating Guide, except that the City will accept workers'
compensation insurance rated B-VIII or better or from the State Compensation
Fund. (3) The Insurance shall not be cancelled, except after thirty (30) days
written prior notice to the City; and (4) The commercial general and automobile
liability insurance shall each be primary as respects the City, and any other
insurance maintained by the City shall be in excess of this insurance and not
contribute to it.
E. Upon execution of this Agreement, Consultant shall provide to City certificates of
insurance showing the names of the insurers and the amounts of coverage and
insurer endorsements evidencing the required insurance provisions. Insurer
endorsements (or a copy of the policy binder if applicable} shall be provided as
evidence of meeting the requirements of Subsections (1)(3) and (4) of Section
7D above and the waiver of subrogation requirement in Section C above. If self-
insured for worker's compensation, Consultant shall submit to City a copy of its
certification of self-insurance issued by the Department of Industrial Relations.
Section 8: Termination of Agreement
A. City and Consultant shall each have the right to terminate any or all of the
services covered by this Agreement at any time for any reason by giving ten (14)
business day written advance notice to -the other party.

8. Upon termination of this Agreement, Consultant shall be paid for services
rendered by the effective date of the termination.
C. Upon termination of this Agreement or completion of the Project, all documents
relating to the Project shall become the sole property of City. Should City
terminate this Agreement pursuant to subparagraph A. of this Section,
Consultant shall, within ten (10) business days of receipt of notice of termination,
provide City with all documents within Consultant's possession relating to this
Agreement and the Project, including but not limited to all completed documents
and all drafts of uncompleted documents.

Any notice allowed or required to be given shall be effective upon personal
delivery thereof, or upon depositing thereof in the United States Postal Service, certified
mail, return receipt requested, postage prepaid, addressed as follows:

Section 10: Miscellaneous Provisions
A. Consultant shall proceed immediately and diligently to perform the services
provided for in this Agreement upon receipt of notice from City to proceed
therewith.
B. No part of this Agreement may be assigned by Consultant without the prior
written approval of City.
C. This Agreement shat! extend to and be binding upon and inure to the benefit of
heirs, executors, administrators, successors and assigns of the respective parties
hereto.
D. Consultant shall perform all services' required under this Agreement using that
degree of care and skill ordinarily exercised under similar conditions in similar
localities, and shall be responsible for all errors and omissions for services
performed by Consultant under the terms of this Agreement.

E. Consultant certifies that there shall be no discrimination against any employee
who is employed in the work covered by this Agreement, or against any
application far such employment, because of race, religion, color, sex or national
origin including but not limited to, the following: employment, upgrading,
demotion or transfer, recruitment, or recruitment adverfising, lay-off or
termination, rate of pay or other forms of compensation, and selection for
training, including apprenticeship.
F. This Agreement shall be interpreted in accordance with California Law. The
parties agree that the Orange County Superior Court is the exclusive venue for
any lawsuits by either party regarding this Agreement

Proposal for Additional Engineering Services -Phase 2 (Amendment No. 9)
Dear Mr. Mittal:
Tetra Tech has been providing professional engineering services for this project since November 2004.
Tetra Tech has completed the final plans and specifications and has submitted them to the City of
Tustin. Tetra Tech has completed all of our scope of services per our existing Consulting Services
Agreement (including all of our approved Amendments Nos. I through 7). As of January 27`x, 201 1,
the City approved Amendment No. 8 for $19,900 to perform engineering services for the Phase
Demolition of the existing Rawlings Reservoir.
Tetra Tech is pleased to provide the following proposal for additional engineering services for the
Rawlings Reservoir Project. In order to obtain additional geotechnical information for soils underlying
the existing reservoir that can be used to assist the Contractors in bidding the reservoir construction
project, the City has decided to separate the project into two phases: Demolition Phase (Phase i); and
Reservoir Construction Phase (Phase 2). The City has previously authorized Tetra Tech to prepaze the
Phase 1 (Demolition Phase) Plans and Specifications. By this correspondence, we are requesting
approval of the additional services to prepare the Phase 2 (Reservoir Construction Phase) Plans and
Specifications and the corresponding increase in our approved budget.
Phasing Overview
The intent of the additional services is to revise the plans and specifications to allow the City to bid the
Demolition Phase of the Work prior to the actual Reservoir Construction Phase. Once the demolition
work has been completed, additional geotechnical work can be performed. This additional geotechnical
work will provide soils data relative to subsurface conditions that are underlying the existing reservoir
that could not be previously obtained. This additional data will be used by the Contractors bidding the
Reservoir Construction Phase as part of their shoring system design. This additional geotechnical data
will reduce potential claims due to unknown subsurface conditions and will assist the Contractor in
designing the shoring as well as constructing the proposed reservoirs.
Assumptions
The following are our assumptions in preparing this proposal:
1. Submit 90% and 100% design submittals of the Phase 2 work.
2. At each submittal, submit three sets of full size plans, reduced plans and project specifications.

3. Final submittal will include reproducible signed construction drawings (mylar) and unbound
signed specifications.
~. Front ends will be prepared by the City and Tetra Tech will review and comment.
5. City will provide all reproduction for bidding and distribute all addenda.
The following is our preliminary schedule:
• Submit 90% design submittal for Phase 2 three (3) weeks after receiving the additional
geotechnical findings;
• Allow two (2) weeks for the City and CM to review and provide comments;
• We will submit to the County of Orange for grading permit once we receive the City and CM
comments and make any major changes (assume a minimum of six week review period);
• Submit 100% design submittal for Phase 2 three (3) weeks after receiving the City/CM
comments and two (2) weeks after receiving the County of Orange review comments;
• Allow two (2) weeks for the City and CM to review and provide comments; and
• Submit final signed plans and specifications two (2) weeks after receiving the City/CM
comments.
Scone of Work
Task 1: Project Management
Tetra Tech will conduct Project Management activities to ensure adherence to schedule and budget,
including frequent communication between the City, and the City's Construction Manager. For this
proposal, we have assumed the project management activities will be required for up to Five (5)
months. This should account for modifying and bidding the Construction Phase (Phase 2) plans and
specifications based on the additional geotechnical findings. Tetra Tech will prepare bi-weekly a-mail
status reports and monthly invoice back-up spreadsheets.
Phase 2 (Reservoir Construction Phase)
The previously submitted 100% plans and specifications will be revised to remove the portion of work
included within the Phase 1 (Demolition Phase) work as well as the necessary revisions as the result of
the additional geotechnical investigation findings and constructability review comments provided by
the City's Construction Manager. We have assumed that these revisions will be minor in nature and
will not require the preparation of additional sheets or details except as noted below. We have assumed
that two additional sheets will be required to show the new cut slope and buttress grading and sections
that have been discussed with the City, the Construction Manager and with Leighton. We have
assumed that the conceptual design will be provided by the City's Construction Manager with
additional information provided by Leighton Consulting, Inc. We have included the time and effort to
submit these additional sheets to the County of Orange in order to obtain a grading permit.

Task 2: Preparation of Plans
Revise the sheets to reflect the worked performed as part of the Demolition Phase I Plan Set, remove
any references to the demolition work performed and provide notes for the remaining demolition work,
and include the additional grading plan and section for the west side of the property. Revise the notes
on the plans to account for the additional geotechnical information. Make minor changes to the plans
based on the constructability review performed by the Construction Manager. Revise the sections and
site plan to represent the final site plan prepared for the demolition phase of the work.
Task 3: Preparation of Specifications
Prepare new bid form, revise Summary of Work (Section 01010) and Bid Form, Measurement and
Payment (Section 01150). Make revisions to the Technical Specifications as necessary due the
additional geotechnical findings and comments obtained from the constructability review performed by
the Construction Manager as well as the County of Orange Grading Permit conditions. Insert necessary
Technical Specifications with only minor editing. Prepare engineer's construction cost estimate and
preliminary construction schedule working with the City's Construction Manager.
Task 4: Meetings and Processing of Plans
We have assumed that the following meetings with the City and the City's Construction Manager will
occur during this phase of the design work: discuss the additional geotechnical investigation work
recommended; discuss additional geotechnical investigation findings and constructability review
comments provided by Construction Manager; and 90%a design review meeting. Tetra Tech will
process the plans and specifications with the City for the 90% and 100% design submittals.
Task S: County of Orange Grading Permit Processing
Tetra Tech will submit the additional grading plans to the County of Orange for a Grading Permit.
Tetra Tech will meet with the County of Orange (we have assumed only one meeting) and make the
revisions required as part of the grading permit review process. We have assumed that Leighton and the
City's Construction Manager will provide the additional information and soils data requested by the
County of Orange. We have also assumed that a separate plan set will not be required by the County.
The City of Tustin will pay all permit application and review process fees.
Task 6: Prepare Addendum to WQ~1lP
Tetra Tech will prepare an addendum to the WQMP to include the proposed grading revisions and the
phasing of the construction activities.
Task 7: Bid Phase Services
Tetra Tech will attend the Pre-Bid Meeting with the City/City's Construction Manager and prospective
bidders to assist the City in answering any ques[ions regarding the reservoir construction plans.

We will provide assistance during the bidding period, answering questions from prospective bidders
and preparing any necessary contract addendums. We have assumed that two (2) addendums may be
necessary.

We are prepared to start work immediately upon your written authorization. We appreciate the

Reference: Rawlings Reservoir Repair and Replacement Project (C1P No. 6136)
Proposal for Construction Support Services
Dear Mr. Mittal:
Tetra Tech has been providing professional engineering services for this project since November 2004.
Tetra Tech has completed the final plans and specifications and has submitted them to the City of
Tustin. Tetra Tech has completed all of our scope of services per our existing Consulting Services
Agreement (including all of our approved Amendments Nos. 1 through 7). As of January 27`h, 20l I,
the City approved Amendment No. 8 for $19,900 to perform engineering services for the Phase 1
Demolition of the existing Rawlings Reservoir. Tetra Tech is waiting for approval of Amendment No.
9 for $50,000 for the Phase 2 Reservoir Construction Phase (proposal dated February 21, 201 l ).
In order to obtain additional geotechnical data for soils underlying the existing reservoir, the City has
decided to separate the project into two phases: Demolition Phase (Phase 1); and Reservoir
Construction Phase (Phase 2). Tetra Tech is pleased to provide the following proposal to provide
Construction Support Services for both Phase 1 and Phase 2 construction projects. The following
proposal has been prepared based on the assumption that Butier Engineering, Inc. will be providing the
Construction Management during the construction of both phases.
Scone of Work
Task 1: Project Management
Tetra Tech will conduct Project Management activities to ensure adherence to schedule and budget,
including frequent communication between the City, and the City's Construction Manager. For this
proposal, we have assumed the project management activities will be required for up to thirty (30)
months. This is based on the Phase 1 Demolition Construction starting in June/July and the Phase 2
Construction duration of 500 working days. Tetra Tech will prepare monthly a-mail status reports and
monthly invoice back-up spreadsheets.
Demolition Phase (Phase !)
Task 2: Construction Prajeet Meetings
Tetra Tech will attend the Pre-Construction Meeting, and have assumed that we may be requested to
attend two other construction project meetings to answer questions or provide input. Therefore, for this
proposal, we have assumed that Tetra Tech will be requested to attend three (3) meetings. We have
assumed that the meeting agenda and minutes will be prepared by Butier Engineeering, Inc.

Task 3: .Shop Drawing Review
Tetra Tech will review and process shop drawing submittals. It may be in the City's best interest to
have Butler Engineering, [nc, review several of the non-engineering shop drawing submittals, as well
as Leighton review the geotechnical submittals in lieu of Tetra Tech. Based on this assumption, we
have envisioned the following shop drawing submittals and the corresponding reviewing party:
• Schedule and Schedule of Values (Butier)
• BMP/SWPPP Submittals (Butier)
• Fiber Rolls/Visqueen and Erosion Control Plans (Butier)
• Sequence of Demolition (Tetra Tech and Butier)
• Abatement Plan (Butier and National Econ)
• Dewatering Plan (Butier)
• Sound Wall (Tetra Tech)
• Grading Plan (Tetra Tech)
• Fencing and Gate (Butier)
Therefore, we have assumed that we may need to review about four (4) different shop drawing
submittals. We have also assumed that each submittal will need to be reviewed only twice (the original
submittal and one re-submittal). Tetra Tech will complete our review of each submittal within ten (10)
working days of receiving the submittal. Tetra Tech will maintain a log for shop drawings.
Task 4: Requests for Information (RFIs)
Tetra Tech will respond to Contractor's "Request for Information" as requested by the
City/Construction Manager. We have assumed that the majority of the RFIs will be reviewed and
responded to by Butler. For this proposal, we have assumed approximately five (5) RFIs will require
our response. Tetra Tech will provide a response to each RFI within twenty-four (24) hours.
In addition, Tetra Tech will provide revised design details and clarifications sketches in response to the
Contractor's RFI. We have assumed one (1) such RFI will be required. Tetra Tech will notify the City
within twenty-four (24) hours of receiving these RFIs with the proposed schedule for providing the
revised design details and sketches.
Tetra Tech will maintain a fog for RFIs.
Task S: ~Liinor Plan Changes
Tetra Tech will prepare minor plan changes due to changes in the field conditions and/or at the request
of the Contractor and/or Construction Manager. For this proposal, we have assumed twenty (20) hours
f'or these minor plan revisions. Tetra Tech will maintain a log of plan revisions.

Task 6: Claange Order Srepport
Tetra Tech will provide support services in reviewing Change Order requests provided by the
Contractor. This will include discussions with the Construction Manager. We have assumed that the
majority of the change order review and evaluation will be performed by Butier and Tetra Tech will
only provide engineering review support. Eor this proposal, we have assumed a total of one (I) Change
Order request will require our review.
Task 7: Record Drawings
Tetra Tech will prepare record drawings based on Contractor's and Construction Manager's red-lines.
Tetra Tech will submit both mylars and electronic files.
We have assumed that Butier Engineering, Inc. will provide all coordination of services: survey,
concrete/material testing, geotechnical inspection, abatement inspection, sewer discharge permit
coordination, private property coordination, County of Orange coordination, etc.
Reservoir Construction Phase (Phase 2)
Task 8: Construction Project Meetings
Tetra Tech will attend the Pre-Construction Meeting, and have assumed that we may be requested to
attend a construction project meeting every other month for the duration of the construction contract
(assumed a total of ten (!0) construction meetings) to answer questions or provide input. Therefore, for
this proposal, we have assumed that Tetra Tech will be requested to attend eleven (I I) meetings. We
have assumed that the meeting agenda and minutes will be prepared by Butier Engineeering, Inc.
Task 9: Shop Drawing Review
Tetra Tech will review and process shop drawing submittals. It may be in the City's best interest to
have Butier Engineering, Inc. review several of the non-engineering shop drawing submittals, as well
as Leighton review the geotechnical submittals in lieu of Tetra Tech. Based on this assumption, we
have assumed that Tetra Tech will be required to review approximately seventy (70) shop drawing
submittals. We can provide a summary of these submittals if requested by the City. We have also
assumed that each submittal will need to be reviewed only twice (the original submittal and one re-
submittal). Tetra Tech will complete our review of each submittal within ten (10) working days of
receiving the submittal. Tetra Tech will maintain a tog for shop drawings.

Contractor's IZFI. We have assumed ten (10) of the above twenty-five (25) RFIs will require this
additional response effort. Tetra Tech will notify the City within twenty-four (24) hours of receiving
these RF1s with the proposed schedule for providing the revised design details and sketches.
Tetra Tech will maintain a log for RFIs.
Task 11: Minor Plan Changes

for these minor plan revisions. Tetra Tech will maintain a log of plan revisions.
Task 12: Change Order Support

Contractor. This will include discussions with the Construction Manager. We have assumed that the
majority of the change order review and evaluation wilt be performed by Butier and Tetra Tech will
only provide engineering review support. For this proposal, we have assumed a total of six (6) Change
Order requests will require our review.

Tetra Tech will prepare record drawings based on Contractor's and Construction Manager's red-lines.

We have assumed that Butier Engineering, Inc. will provide all coordination of services: survey,

Orange permit coordination, private property coordination, OCSD coordination, East Orange County
Water District coordination, etc. In addition, we have assumed that Butier will provide the final
inspection, coordinate the testing and start-up procedures, and prepare the Operation and Maintenance
Manuals.
5ummarv
Tetra Tech does not control the amount of submittals, RFIs or such that will be submitted by the
Contractor. In addition, Tetra Tech does not control the adequacy of the submittals prepared by the
Contractor or the level of additional information required by the Contractor.
This proposal is based on the assumptions noted above for each scope of work task item. Tetra Tech
will perform the above scope of services on a Time and Material Basis and will provide status
summaries to the City each month.
