HomeMy WebLinkAboutPC RES 3630RESOLUTION NO. 3630 20 25 26 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN APPROVING CONDITIONAL USE PERMIT 98-024 TO ESTABLISH A MASTER SIGN PLAN INCLUDING TWO CENTER IDENTIFICATION MONUMENT SIGNS AND THREE ON-SITE DIRECTIONAL SIGNS FOR THE RETAIL CENTER LOCATED AT 17260 EAST SEVENTEENTH STREET (ENDERLE CENTER). The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application, Conditional Use Permit 98-024, was filed by EMS Development on behalf of Enderle Center requesting approval of a master sign plan including two center identification monument signs and three on- site directional signs for the retail center located at 17260 East Seventeenth Street commonly known as Enderle Center. Bo That a master sign plan less restrictive than the sign code is allowed pursuant to Tustin City Code Section 9403(H)(2)(e) with the approval of a Conditional Use Permit. C. That a public heating was duly called, noticed and held for said application on November 9, 1998 and continued to November 23, 1998 by the Planning Commission. Do Pursuant to Sign Code Section 9405c, the request to establish a master sign plan can be supported by the following findings: . The Master Sign Program, as conditioned, will not be detrimental to the health, safety, morals, comfort and general welfare of the persons residing in or working in the neighborhood of the use, nor will it be injurious or detrimental to property or improvements in the vicinity or to the general welfare of the City in that the two center identification signs and the three directional signs will help to provide a more uniform image to the center. . The inclusion of tenant identification on the three directional signs is appropriate given that there are over thirty tenants and five major drive aisles within the center. . The Master Sign Plan, as conditioned, will not be detrimental to surrounding properties in that the signs will be an improvement to the aesthetics of the retail center. The center identification signs, replacement monument signs, and directional signs will be complementary to the materials, design and colors of the center. ]4 20 Resolution No. 3630 Page 2 . '1'he Master Sign Plan, as conditioned, will provide for sign standards that reflect the size and scale of the buildings and surrounding properties. o The Master Sign Plan will encourage uniformity among future signs installed in the center. E, That this project is categorically exempt pursuant to Class 11, Section 15311 of the California Environmental Quality Act. !1. Tho Planning Commission hereby approves CUP 98-024 for a master sign plan including two center identification monument signs and three on-site directional signs, subject to the conditions contained in Exhibit A, attached hereto. BINSACK Planning Commission Secretary (1) (1) (1) EXHIBIT A CONDITIONAL USE PERMIT 98-024 CONDITIONS OF APPROVAL RESOLUTION NO. 3630 GENERAL 1.1 The proposed signs shall substantially conform with the submitted plans for the project date stamped November 23, 1998 on file with the Community Development Department, except as herein modified, or as modified by the Director of Community Development in accordance with this Exhibit. The Director of Community Development may also approve minor modifications to plans during plan check if such modifications are to be consistent with the provisions of the Tustin City Code and other applicable codes. 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with as specified or prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. 1.3 The subject project approval shall become null and void unless permits are issued within twelve (12) months of the date of this Exhibit and substantial construction is underway. Time extensions may be granted if a written request is received by the Community Development Department within thirty (30) days prior to expiration. 1.4 Approval of Conditional Use Permit 98-024 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. 1.5 The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's approval for this project. 1.6 All signs shall be maintained in proper operating order at all times. If the City becomes aware of any lighting or signs that are not operable, the applicant shall be responsible for making appropriate repairs within 72 hours of being notified by the City. (2) (3) (4) SOURCE CODES STANDARD CONDITION CEQA MITIGATION UNIFORM BUILDING CODE/S DESIGN REVIEW EXCEPTIONS (s) (6) (7) RESPONSIBLE AGENCY REQUIREMENTS LANDSCAPING GUIDELINES PC/CC POLICY Exhibit A - Conditions of Approval Cup 98-024 Page 2 SIGNS (1) 2.1 All signs shall comply with the applicable provisions of the Uniform Building Code and the National Electrical Code as adopted by the City (including UL approvals). 2.2 All signs, including any change of copy, require review and approval by the Community Development Department prior to installation. Permits shall be required for all signs. (1) :2.3 Construction level plans, including any required structural calculations, for all project signs shall be submitted, reviewed and approved by the Community Development Department prior to issuance of sign permits. (4) 2,4 The primary center identification signs located at the southeast corner of Yorba and Seventeenth Streets and at the northwest corner of Enderle Center Drive and Vandenberg Lane (identified as "New Monument Signage" on the approved Site Plan) may identify one tenant logo each, and on-site directional signs (identified as "Directional Signs" on the site plan) may identify a maximum of six tenants of the center. Tenant identification bays for the directional signs shall conform to the colors and typestyles shown on the approved set of plans. No tenant Iogos shall be displayed at the directional signs. The center identification and directional signs shall be installed on the locations specified on the plans. Any future modifications to these monument signs regarding design, color, materials and location require approval by the Community Development Department. 2,5 VVithin twelve (12) months of the issuance of building permits for the Center Identification monument signs identified as "New Monument Signage" on the approved set of plans or at the expiration of a tenant's lease, whichever comes first, the existing monument signs identified on the site plan as Monument Signs 1 through 7 shall be removed and replaced with "Replacement Monument Signs" as identified in Section E.1 and illustrated in Section J of the approved Master Sign Program. The final size, design and configuration of the "Replacement Monument Signs" shall be consistent with the "New Monument Signs" and subject to Community Development Director approval. Existing monument signs deemed by the Director to be substantially consistent and compatible with the design of the center and existing signs may be exempt from replacement. (5) 2.6 All signs shall conform to the City of Tustin Sign Code including window signs, which shall not exceed 25% of the glass area upon which the sign is located. Exhibit A - Conditions of Approval Cup 98-024 Page 3 (5) 2.7 All signs and their supporting structures shall be enclosed, structurally safe, and maintained in good condition and shall comply with the most current Uniform Building Codes, as locally amended. (5) 2.8 The portable signs located adjacent to the Unocal Service Station shall be permanently removed prior to issuance of building permits for any sign authorized by the Master Sign Plan. The owner shall ensure that these or similar signs are not erected in the future. (5) 2.9 Pursuant to Section 9404c of the Tustin City Code, all exposed neon signs are subject to review by the Planning Commission. (5) 2. o All types of signs prohibited pursuant to Tustin City code Section 9404(A)(1), such as aerial signs, animated signs, audible signs, beacons, festoons, flashing or moving signs, light bulb strings, roof mounted signs, and projecting signs, are not permitted. PLAN SUBMITTAL (5) 3.1 Three (3) sets of construction level plans with necessary, specifications, and details prepared in accordance with the Uniform Building Code, and other related Codes, City Ordinances, and state and federal laws and regulations shall be submitted for review and approval by the Community Development Department. Compliance with approved plans shall be inspected by the Community Development Department during construction and prior to final inspection. FEES 4.1 Prior to issuance of any building permits, all payments shall be made of all applicable fees including the building division and sign permit fees. Payment shall be required based upon those rates in effect at the time of payment and are subject to change. 4.2 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $38.00 (thirty eight dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the Califomia Environmental Quality Act could be significantly lengthened.
