A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN
APPROVING SIGN CODE EXEPTION 98-004 AUTHORIZING INSTALLATION OF
BUSINESS IDENTIFICATION, SUPPLEMENTAL AND DIRECTIONAL WALL SIGNS ON
THE RETAIL BUILDING AND PUMP ISLAND AND DENYING INSTALLATION OF A
TWENTY-FOUR (24) FOOT POLE SIGN AT 17241 SEVENTEENTH STREET
The Planning Commission does hereby resolve as follows:
The Planning Commission finds and determines as follows:

That a proper application for Sign Code Exception 98-004 was filed by
Chevron Products Company to request authorization to install new business
identification, supplemental and directional wall signs on the retail building
and pump island and re-install an existing, non-conforming pole sign in
conjunction with the demolition of an existing full-service gasoline station
and reconstruction of a self-service gasoline station, 2,011 square foot retail
building, and an (8) position fuel pump island on property located at 17241
Seventeenth Street, also described as Assessor's Parcel No. 395-311-01.

That a public hearing was' duly called, noticed and held on said application
on October 12, 1998, by the Planning Commission.

Pursuant to Section 9405(c) of the Tustin City Code, the Planning
Commission has the authority to grant or conditionally grant exceptions to
the Sign Code subject to the following: 1) Sign size and placement
restrictions shall be followed as closely as practicable; 2) The intent and
purpose of the sign regulations of the and use zone in which the sign is to
be located shall be followed as closely as practicable; 3) There are special
circumstances unique to the property which justify the exception; 4)
Granting the exception will not have a negative impact on surrounding
properties; and, 5) The request promotes the public health, safety, welfare
and aesthetics of the community and that the granting of the exception
meets the findings and intent of the Tustin Sign Code.

With respect to the retail building wall signs and fuel pump island
signs, a derision to approve this request is supported by the
following findings:
a,
Granting an exception for the retail building wall signs and
pump island signs follows the intent of the size restrictions
of the Tustin Sign Code in that, with the exception of the
wall signs on the west elevation of the retail building, the
total square footage of all signs on each elevation is less
than the maximum square footage that would be allowed for
pdmary and secondary wall signs. Although the wall
signs on the west elevation would exceed the total allowable
area of a secondary sign by nine (9) square feet, the
proposed signs will appear in scale with the project.

Granting an exception for larger supplemental wall signs on
the retail building follows the intent of the Tustin Sign Code
in that the signs will be subordinate to the business
identification signs and will not have a negative impact on
surrounding properties;

Granting an exception for wall and pump island directional
signs follows the intent of the Tustin Sign Code in that the
signs will be located in areas that will provide guidance to
customers using the various on-site services and will not
have a negative impact on surrounding properties;
Granting an exception for business identification signs on
the pump island canopy follows the intent of the Tustin Sign
Code in that the canopy structure is more visible from the
public-right-of-way than the retail building and functions in
the same manner as primary and secondary walls. The size
and location of these signs will not have a negative impact
on surrounding properties;

With respect to the pole sign, a decision to deny; this request is
supported by the following findings:
a,
The Sign Code prohibits pole signs for auto related uses
that are not located directly adjacent the freeway right-of-
way.

Granting an exception for. the pole sign would be
inconsistent with the intent and purpose of the regulations
for business identification signs in Commercial districts..The
intent of the Sign Code is to replace outdated pole signs
with monument or wall signs to create a uniformity of sign
types.

There are no special circumstances unique to the site plan
that would justify allowing a pole sign. There is ample area
within the landscape planter to provide a monument sign
with sufficient visibility to motorists along and Seventeenth
Street and Carroll Way. In comparison to the proposed
pole sign, a monument sign could provide improved clarity
and visibility of sign text given the increased sign area that
would be permitted.
d.
Granting an exception for the pole sign would have a
negative impact on surrounding properties and the
immediate vicinity in that the aesthetic trend and
requirement within the community is to replace pole signs
with monument signs. An outdated sign type such as pole
sign in combination with a facility that has been
redeveloped would present an inconsistent and awkward

appearance and detract from the streetscape along
Seventeenth Street and Carroll Way.

There is an existing, off-site pole sign located immediately
north of Mimi's Caf6 which provides business identification
for Chevron and indicates the general location of the project
site.
The Planning Commission hereby approves installation of business identification,
supplemental and directional wall signs on the retail building and pump island and
denies installation of a pole sign, consistent with the application for Sign Code
Exception 98-004, in conjunction with the construction of a self-service gasoline
station with eight (8) fuel pump stations and 2,011 square foot convenience market
at 17241 Seventeenth Street, subject to the conditions contained in Exhibit A,
attached hereto.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular
meeting on the 12th day of October, 1998.

EXHIBIT A
SIGN CODE EXCEPTION 98-004
RESOLUTION NO. 3620
GENERAL
(1)
1.1
The proposed project shall substantially conform with the submitted plans
for the project date stamped October 12, 1998, on file with the Community
Development Department, as herein modified by Resolution No. 3620, or
as modified by the Community Development Director in accordance with
Resolution No.. 3620 and this Exhibit. The Director may also approve
subsequent minor modifications to plans during plan check if such
modifications are consistent with provisions of the Tustin City Code or other
applicable regulations.

Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with prior to the issuance of any building permits for the project,
subject to review and approval by the Community Development
Department.
1.3
The subject project approval shall become null and void unless permits for
the proposed project are issued and substantial construction is underway
within eighteen (18) months of the date of this Exhibit. Time extensions
may be considered if a written request is received by the Community
Development Department within thirty (30) days prior to expiration.

Approval of Sign Code Exception 98-004 is contingent upon the applicant
and property owner signing and retuming an "Agreement to Conditions
Imposed" form as established by the Community Development
Department.

The applicant shall hold harmless and defend the City of Tustin from all
claims and'liabilities arising out of a challenge of the City's approval of this
project.
PLAN SUBMITTAL
(1) 2.1
All signs, including any change of copy, require review and approval by the
Community Development Department prior to installation. Four sets of sign
plans shall be submitted for review. Plans shall include a site plan
indicating the location of all proposed signs, sign dimensions, building and
pump island dimensions, material and fabrication details, copy, and
illumination details.

All signs shall comply with the applicable provisions of the Uniform Building
Code and the National Electrical Code as adopted by the City (including UL
approvals).

Window signs shall conform to the Tustin Sign Code and shall not exceed
25% of the glass area upon which the sign is located.

No signs, including window signs, advertising alcoholic beverages may be
visible from the exterior of the building.
All signs and their supporting structures shall be structurally safe and
maintained in good condition and shall comply with the most current
Uniform Building Codes, as locally amended.
Sign 11 on the convenience building shall be eliminated from the plans.
Prior to issuance of any building permits, payment shall be made of all
applicable fees, including but not limited to the following. Payment shall
be required based upon those rates in effect at the time of payment and
are subject to change.

Development Department based on the most current schedule.
