HomeMy WebLinkAboutPC RES 3609RESOLUTION NO. 3609 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN APPROVING DESIGN REVIEW 98-023, A REQUEST TO INSTALL EXPOSED TUBE NEON SIGNAGE AND REPAINT AND REFACE AN EXISTING PYLON-TYPE SIGN AT 1091 OLD IRVlNE BOULEVARD. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application for Design Review 98-023 was filed by Custom Signs on behalf of the property owner to install new wall signage that includes exposed tube neon design elements, and to repaint and reface an existing pylon-type sign at 1091 Old lrvine Boulevard. B. That this item was considered by the Planning Commission on August 24, 1998 and continued to September 14, 1998. Co D. That the subject location is within the Town Center Redevelopment Project Area. Tustin City Code Section 9299(B)(4)(c) requires Design Review by the Zoning Administrator unless review is already required by the Planning Commission. Tl~at Tustin City Code Section 9404(C)(2) requires that the use of exposed tube neon requires review by the Planning Commission. E. Pursuant to Tustin City Code Section 9272, the Commission finds that the location, size, architectural features and general appearance of the proposed signs will not impair the ordedy and harmonious development of the area, the present or future development therein, or the occupancy as a whole in that: . The City's recently adopted Neon Guidelines encourage the use and color of neon materials to be compatible with the color and style of the subject structure. The building is a Spanish-style building with plaster/stucco walls and red clay tile roof materials. The proposed color scheme of purple and yellow as secondary colors for the signage is acceptable for the style and primary color pattern of the building. . The Town Center Redevelopment Project Area Plan Section 420 stipulates that uses or structures within the Project Area shall be consistent with'the surrounding uses by reason of appearance, noise, etc. "9 ',5 Resolution No. 3609 Page 2 3. The design treatment is consistent with the review criteria identified in the City's Sign Code, particularly TCC Section 9403hi(b) which requires signs to be compatible with and bear a harmonious relationship to the visual image and architectural design of the buildings they identify in terms of materials, colors and design motif, and TCC Section 9403hi(F) which requires signs to be compatible with the visual characteristics of the development and signs in the surrounding area and not detract from adjacent developed properties. F. In making such findings, the Commission has considered at least the following items: 1. Height, bulk and area of structures. 2. Setbacks and. site planning. 3. Exterior materials and colors. . Physical relationship of proposed improvements to existing structures in the neighborhood. , Appearance and 'design relationship of proposed improvements to existing structures and possible future structures in the neighborhood and public thoroughfares. 6. Proposed Signing. Development Guidelines and critei'ia as adopted by the City Council. Gl This project is categorically exempt (Classes 1 & 11, Minor modifications to existing facilities and signs) pursuant to Sections 15301 and 15311 of the California Environmental Quality Act. II. The Planning Commission hereby approves Design Review 98-023 requesting the installation of exposed tube neon signage and the repainting - and refacing of an existing pylon sign at 1091 Old Irvine Boulevard, subject to the conditions contained in Exhibit A, attached hereto. BINSACK, the undersigned, hereby certify that I am the Secretary of the Planning Commission of the City of Tustin, California; that Resolution No. 3609 was duly passed and adopted at a regular meeting of the Tustin Planning Commission, held on the 14th day of September, 1998. ]0 Planning Commission Secretary ]7 24 25 27 2g EXHIBIT A RESOLUTION NO. 3609 CONDITIONS OF APPROVAL DESIGN REVIEW 98-023 GENERAL (1) 1.3 The proposed project shall substantially conform with the submitted plans for the project date stamped September 14, 1998 on file with the Community Development Department, as herein modified, or as modified by the Community Development Director in accordance with this Exhibit. The Director may' also approve subsequent minor, modifications to plans during plan check if such modifications are consistent with provisions of the Tustin City Code or other applicable regulations. Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. The subject project approval shall become null and void unless permits for the proposed project are issued and substantial construction is underway within twelve (12) months of the date of this Exhibit. Time extensions may be considered if a wdtten request is received by the Community Development Department within thirty (30) days prior to expiration. Approval of Design Review 98-023 is conti.ngent upon the applicant signing and retuming an "Agreement to Conditions Imposed". form as established by the Director of Community Development. The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge to the City's approval of this project. (1) 2.2 Plans submitted for Plan Check shall incorporate the revisions approved by the Planning Commission. FEES (1) (1) 3.1 3.2 Prior to the issuance of any building permits, payment shall be made of all applicable building plan check and permit fees and sign design review fees to the Community Development Department. Within 48 hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a CASHIERS CHECK payable to the COUNTY CLERK, in the amount of thirty-eight dollars ($38.00) to enable the City to file with the County Clerk, the appropriate environmental documentation pursuant to the California Environmental Quality Act. If within such 48 hours period,' the applicant has 'not delivered to the Community Development Department the above noted check, the approval for the project granted herein shall be considered automatically null and void.
