HomeMy WebLinkAboutPC RES 3607RESOLUTION NO. 3607 17 20 25 28 29 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING SIGN CODE EXCEPTION 98-003 AUTHORIZING INSTALLATION OF TWO FACADE MOUNTED SIGNS AND A WALL MOUNTED DIRECTIONAL SIGN ON THE PROPERTY LOCATED AT 2521 MICHELLE DRIVE. The Plamfing Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: Ao That a proper application, Sign Code Exception 98-003, ,,,,'as filed by Pacific Bell Mobile Sen'ices, requesting approval to install a 100 square foot faCade mounted sign on the north elevation, a 64 square foot fagade mounted sign on the south elevation and a 16 square foot directional wall sign on the existing aggregate wall, near the entrance to the building. Bo The size of the proposed channel letter facade mounted sig-ns and the proposed directional wall mounted sign is allowed with approval by the. Planning Commission pursuant to Tustin City Code Section 9404c2. Ce That this project is categorically exempt (Class 11) pursuant to Section 15311 of the California Environmental Quality Act. D. Pursuant to Sign Code Section 9405c, the request to install the additional sign copy can be supported by the following findings: le Sign size and placement restrictions of the sign code shall be closely followed as practicable. ' The total area of the proposed fagade mounted signs exceeds the maximum letter height of 6" for a primary sign in a industrial center. The cumulative amount of sign area of both tenant signs' does not exceed the maximum allowed size of 200 square feet per elevation for a wall sign of an individual btusiness. ,, The intent and purpose of the sign regulations of the land use zone in which the sign is to be located shall be followed as closely as practicable. The proposed signs appear to be in scale with the project and are compatible with the other signs on the property in size and color. e There are special circumstances unique to the property to justify the exception. Consistent with the purpose of the Sign Code, the proposed fagade mounted signs create better visibility from the street and from the freeway. The directional sigh mounted on the existing aggregate wall is significantly set back fi'om the front property line and eliminates the need for another monument sign as authorized for the second tenant. 10 15 16 20 24 25 26 27 Resolution No. 3607 Page 2 . 5~ Granting the exception will not have a negative impact on the surrounding properties. The proposed signs will not be detrimental to, or have a negative effect on, surrounding properties in that the signs are compatible with the uses in the surrounding area in location, size, and fabrication. The proposed signs are compatible with the existing signs and the building design. The sign application promotes the public, health, safety, welfare and aesthetics of the community and that the granting of the exception meets findings and the intent of the sign code. The proposed signs compliment the aesthetics of the building and building site. The illuminated signs do not negatively impact any of the surrounding properties. E. That the project has been reviewed for consistency with the Air Quality Sub- element of the City of Tustin General Plan and has been determined to be consistent with the Air Quality Sub-element. The Planning Commission hereby approves Sign Code Exception 98-003 authorizing installation of a 100 square foot fagade mounted sign on the north elevation, a 64 square foot fagade mounted sign on the south elevation and a 16 square foot directional wall sign on the existing aggregate wall, near the entrance to the building at the property located at 2521 Michelle Drive, subject to the conditions contained in Exhibit A, attached hereto. BINSACK Planning Commission Secretary 15 19 20 2'3 24 25 27 25 29 EX3IIBIT A SIGN CODE EXCEPTION 98-003 CONDITIONS OF APPROVAL RESOI..UTION NO. 3607 GENERAL (1) 1.1 The proposed signs shall substantially conform with the submitted plans for the project date stamped August 10, 1998, on file with the Conununity Development Department, except as herein modified, or as modified by the Director of Commtmity Development in accordance with this Exhibit. The Director of Community Development may also approve minor modifications to plans during plan check if such modifications are to be consistent with the provisions of the Tustin City Code and other applicable codes. 0) 1.2 Unless other,vise specified, the conditions contained in this Exhibit shall be complied vdth as specified or prior to the issuance of any building permits for the project, subject to rewew and approval by the Community Development Department. 0) 1.3 The subject project approval shall become null and void unless permits are issued within m~elve (12) months of the date of this Exhibit and substantial construction is underway. Time extensions may be granted if a written request is received by the Community Development Department within thirty (30) days prior to expiration. O) 1.4 Approval of Sign Code Exception 98-003 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's approval for this project. 1.6 The signs shall be maintained in a good operating order. If the illumination of one or more of the letters become inoperable, the sign shall be turned off until appropriate repairs are made. Pi,AN SUBMITT.M_, (4) 2.1 Three (3) sets of construction level plans with necessary, specifications, and details prepared in accordance with the Uniform Building Code, and other related Codes, City Ordinances, and state and federal laws and re~lations shall be submitted for review and approval by the Community Development Department. Payment shall be required based upon those rates in effect at the time ofpa3q'nent and are subject to change. Within forty-ei~t (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $38.00 (thirty ei~t dollars) to enable the City to file the appropriate environmental documentation for the project. If xx4thin such fbrty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the Califbrnia Environmental Quality Act could be significantly lengthened.
