A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF TUSTIN DETERMINING THAT
THE LOCATION, PURPOSE, AND EXTENT OF
THE PROPOSED VACATION OF PUBLIC RIGHT-
OF-WAY ADJACENT TO 1450 EL CAMINO REAL
CONFORMS WITH THE TUSTIN GENERAL PLAN.
The Planning Commission does hereby resolve as follows:
The Planning Commission finds and determines as follows:
A. That the owners (Tustin Red Hill Center, LLC) of the commercial retail
center at 1450 EI Camino Real desire to construct additional parking
spaces at their site to accommodate employee and customer parking
needs.
B. That acquisition of property from Caltrans and the City of Tustin adjacent
to the commercial retail center will be necessary to accommodate the
additional parking.
C. That the City parcel (Parcel F of Exhibit A) and the adjacent street
easement (portion of Parcel A of Exhibit A) are not needed for future street
right-of-way since EI Camino Real is currently constructed to a secondary
arterial highway standard as required under the City's Circulation Element
of the General Plan and the Orange County Master Plan of Arterial
Highways.
D. That there are no public utilities currently existing within the fee parcel or
the street easement, and none are anticipated in the future.
E. That Section 65402 (a) of Government Code provides that no real
property shall be vacated until the location, purpose, and extent of the
project has been reported upon by the local planning agency as to the
conformity with the applicable, adopted general plan.
F. That the required public hearing for City Council consideration of vacation
of the public right-of-way is scheduled for July 19, 2011.
G. That the vacation of the public right-of-way adjacent to 1450 EI Camino
Real furthers Land Use Element Policy 1.3 which is to facilitate the
development of vacant and underutilized freeway parcels with commercial
uses where appropriate and compatible with surrounding uses to
capitalize on their freeway access and visibility.

H. That Section 65402 (a) of the Government Code authorizes the Planning
Commission to determine whether the location, purpose, and extent of the
proposed disposition of real property is consistent with the General Plan.
I. That the general plan conformity determinations required by Government
Code Section 65402 (a) are not "projects" requiring environmental review
pursuant to the California Environmental Quality Act.
II. The Planning Commission hereby determines that the location, purpose, and
extent of the proposed vacation of public right-of-way adjacent to 1450 EI
Camino Real, as shown in Exhibit A attached hereto, is in conformance with
the Tustin General Plan.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a regular
meeting held on the 12t" day of July, 2011.
