HUSTON, INTERIM CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT PUBLIC WORKS DEPARTMENT SUBJECT: FINAL TRACT MAP 17342 SUMMARY: Final Tract Map (FTM) 17342 is a request to subdivide an existing office complex for condominium purposes. The proposed subdivision would result in five (5) numbered lots and one (1) lettered lot, for a maximum of 115 office units. On July 27, 2010, the Planning Commission recommended that the City Council approve Tentative Tract Map (TTM) 17342. On September 7, 2010, the City Council approved TTM 17342. The property is located at 17772-17862 Seventeenth Street. (Applicant: Greenlaw Partners). RECOMMENDATION: That the City Council adopt Resolution No. 11-44 approving Final Tract Map 17342, a subdivision of a 9.62-acre site, improved with an existing office complex, into five (5) numbered lots and one (1) lettered lot for condominium purposes. FISCAL IMPACT: FTM 17342 is an applicant-initiated project. The applicant has paid applicable fees for the processing of this project. BACKGROUND: FTM 17342 would subdivide an existing property into five (5) numbered lots and one (1) lettered lot, for a maximum of 115 condominium office units. On July 27, 2010, the Planning Commission held a public hearing and adopted Resolution No. 4149 recommending approval of TTM 17342 to the City Council, and on September 7, 2010, the City Council approved TTM 17342 by adopting Resolution No. 10-80. DISCUSSION: Site and Surroundings The project site is 9.62 acres in area and located at the southeast corner of Seventeenth Street and Prospect Avenue, also known as the Tustin Financial Plaza, within the City's Planned Community Business Park (PC-BUS PARK) zoning district (Attachment A - Location Map). The site is developed with four two-story office buildings, one four-story office building, a common parking lot, and common landscape areas. Figure 1 Final Tract Map 17342 FTM 17342 is a request to subdivide a 9.62-acre site into five (5) numbered lots and one (1) lettered lot for condominium purposes, with a maximum 115 office units. As a condition of approval to create condominium offices, a Covenants, Conditions and Restrictions (CC&Rs) must be prepared and approved prior to recordation of FTM 17342. The proposed CC&Rs have been approved by the City Attorney and staff. That on July 27, 2010, the Planning Commission adopted Resolution No. 4149 recommending that the City Council approve Tentative Tract Map 17342, and the City Council approved Tentative Tract Map. 17342 on September 7, 2010, by adopting Resolution No. 10-80; 3. That the proposed subdivision is in conformance with the Tustin General Plan land use designation of Planned Community Commercial/Business and Planned Community Business Park (PC-BUS PARK) Zoning District in that these designations provide for the development of office uses; 4. That the proposed subdivision is in conformance with Tentative Tract Map 17342, the Tustin Area General Plan, Tustin Zoning Code, State Subdivision Map Act, the City's Subdivision Code, and has been determined to be consistent with the Air Quality Sub-Element; 5. That the Public Works/Engineering Department has reviewed the map and determined that it is technically correct and is in substantial conformance with the Pacific Center East Specific Plan, City Subdivision Code, and State Subdivision Map Act; 6. That the City Attorney has reviewed the findings for consistency with the Tustin City Code; 7. The final tract map is Categorically Exempt pursuant to Section 15315, Class 15 of Title 14, Chapter 3, of the California Code of Regulations (Guidelines for the California Environmental Quality Act). That Final Tract Map No. 17342 was submitted by Greenlaw Partners, the property owner, requesting approval to subdivide an existing office complex into five (5) numbered lots and one (1) lettered lot, for a maximum of 115 office units, on a property located at 17772-17882 17t" Street; B. That on July 27, 2010, the Planning Commission adopted Resolution No. 4149 recommending that the City Council approve Tentative Tract Map 17342, and the City Council approved Tentative Tract Map 17342 on September 7, 2010, by adopting Resolution No. 10-80; C. That the proposed subdivision is in conformance with the Tustin General Plan land use designation of Planned Community Commercial/Business and Planned Community Business Park (PC-BUS PARK) Zoning District in that these designations provide for the development of office uses; D. That the proposed subdivision is in conformance with Tentative Tract Map 17342, the Tustin Area General Plan, Tustin Zoning Code, State Subdivision Map Act, the City's Subdivision Code, and has been determined to be consistent with the Air Quality Sub-Element; E. That the Public Works/Engineering Department has reviewed the map and determined that it is technically correct and is in substantial conformance with the Pacific Center East Specific Plan, City Subdivision Code, and State Subdivision Map Act; F. That the City Attorney has reviewed the findings for consistency with the Tustin City Code; G. The final tract map is Categorically Exempt pursuant to Section 15315, Class 15 of Title 14, Chapter 3, of the California Code of Regulations (Guidelines for the California Environmental Quality Act).
