A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING CONDITIONAL USE PERMlT 98-014
APPROVING A MASTER SIGN PLAN FOR THE FRENCH QUARTER
CENTER AT 17245 - 17395 17TH STREET.
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
A.
That a proper application for Conditional Use Permit 98-014 was filed by
Barry Wathns to request approval of a Master Sign Plan for the French
Quarter Center, 17245 - 17395 17th Street(APN # 398-142-03 through 09).
The Master Sign Plan includes two monument signs that exceed the
maximum allowed height of six feet. Pursuant to Sign Code Section
9403h2(e), a conditional use permit is necessary to deviate from Tustin City
Code 9408A & B.

That Section 9403h2(e) of the City Code, allows a master sign plan to
deviate from the Sign Code re~m~lations pertaining to sign height and panel
size with the approval of a conditional use permit.

That a public heating was duly called, noticed and held on said application
on June 22, 1998 by the Planning Commission.

That the project is categorically exempt (Class I 1) pursuant to Section 15311
of the California EmSronmental Quality Act Guidelines.
That the establishment, maintenance and operation of the use applied for will
not under the circumstances of this case, be detrimental to the health, safety,
morals, comfort, or general welfare of the persons residing or working in the
neighborhood of such proposed use, nor be injurious or detrimental to the
property and improvements in the neighborhood of the subject property, or
to the general welfare of the City of Tustin, as evidenced by the following
findings:
The proposed master sign plan will have a minor impact on the
streetscape. The height and shape of the proposed signs is not a
significant change from the existing monument signs.

The proposed monument signs will not affect the sight lines of vehicles
attempting to enter or exit the center, or the vehicle/pedestrian sight lines
at the intersection of 17th Street and Carroll Way.

The size of the proposed tenant signage should not have an adverse
impact on the street. The size of these panels is not a significant change
from the existing monument signs and is appropriate to the size of the
sign.
The Planning Commission hereby approves Conditional Use Permit 98-014, a
Master Sign Plan for the French Quarter Center located at 17245 - 17395 17th Street,
(APN # 398-142-03 through 09), subject to the conditions contained in Exhibit A
attached hereto.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular
meeting on the 22nd day of June, 1998.

The proposed project shall substantially conform with the submitted plans for the
project date stamped June 22, 1998 on file with the Community Development
Depa_ranent, as herein modified, or as modified by the Community Development
Director in accordance with this Exhibit. The Director may also approve
subsequent minor modifications to plans during plan check if such modifications
are consistent with provisions of the Tustin City Code or other applicable
regulations.
Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with prior to the issuance of any building permits for the project, subject
to review and approval by the Community Development Department.
The subject project approval shall become null and void unless permits for the
monument sig-ns are issued and substantial construction is underway, within 12
months of the date of this exhibit. Time extensions may be considered if a ~,ritten
request is received by the Community Development Department within thirty (30)
days prior to expiration.
Approval of Conditional Use Permit 98-014 is contingent upon the applicant and
property owner signing and returning an "Agreement to Conditions Imposed" form
as established by .the Community Development Department. Failure to comply
with the conditions imposed shall be grounds for suspension or revocation of
Conditional Use Permit 98-014.
The applicant shall hold harmless and defend the City of Tustin from all claims and
liabilities arising om of a challenge of the City's approval of this project.

PLAN SUBMITTAL
(1) 2.1
Provide three (3) sets of drawings incorporating the conditions of approval for the
record set with the Master Sign Plan. These plans are in addition to the plans and
exhibits needed for building plan check and permits required below.

When submitting for building plan check, prior to obtaining a building permit,
submit three (3) complete sets of structural plans and details showing attachments,
foundations and site improvements in accordance with applicable Building Codes.
Compliance with the approved plans shall be inspected by the Community
Development Department during construction and prior to final inspection, a
building permit, submit complete structural plans and details showing attachments
and foundations.

The signs shall comply in all respects with the Building Code, other related codes,
City Ordinances, and State and Federal Laws and regulations.

The design proposed 6 foot 6 inch monument sign shall be modified to include a
river rock base which is consistent with the design of the 14 foot monument sign.
Design modifications shall be submitted and approved by the Community
Development Department.

Center identification shall be included on the westerly monument sign. Design
modifications shall be submitted and approved by the Community Development
Department. The overall height may be increased a maximum of 12 inches to
accommodate center identification.

The background color of all the sign panels on both monument signs shall be in a
consistent and made of an opaque material. All the colors and mater/als of the
proposed signs shall be reviewed and approved by the Community Development
Department prior to issuance of permits for said signs. All signs, new and
existing, shall be compatible with the proposed color scheme of the center.
USE RESTRICTIONS
No tenant shall be permitted to occupy sign space on the French Quarter Center
identification monument sign unless such tenant occupies a minimum of 5,000
square feet of gross floor area and has a minimum store front width of 50 feet of
in-line tenant space within the subject shopping center.

No tenant shall bi permitted to occupy the sign space on the tenant identification
monument sign located within the French Quarter Center on the comer of 17th and
Carroll Way unless they occupy space within the adjacent comer building.
The tenant copy area represented on the easterly monument sign shall not exceed
a total of 52 square feet or 13 square feet per tenant sign face. The tenant copy
area represented on the westerly monument sign shall not exceed a total of 32
square feet or 18 square feet per tenant sign face.
Prior to the issuance of any building permits, payment shall be made of all
applicable fees, including but not-limited to the following. Payment shall be
required based upon those rates in effect at the time of payment and are subject to
change.

Building plan check and permit fees to the Community Development
Department based on the most current schedule.
Within forty-eight (48) hours of approval of the subject project, the applicant shall
deliver to the Community Development Department, a cashier's check payable to
the COUNTY CLERK in the amount of $38.00 (thirty eight dollars) to enable
the City to file the appropriate environmental documentation for the project. If
within such forty-eight (48) hour period that applicant has not delivered to the
Community Development Department the above-noted check, the statute of
limitations for any interested party to challenge the environmental determination
under the provisions of the California Environmental Quality Act could be
significantly lengthened..
