That a proper application, Design Review 97-019, was filed by Rielly Homes, Inc. and Ballesteros Property, Inc. requesting approval of a community recreation. facility on a 0.5 gross acre site on property located at 2834 Ballesteros Circle (Lot 2 of TT 15574); Bo That' a public heating was duly called, noticed and held on said application on February 23, 1998, by the Planning Commission; C.' In making such findings, the Commission has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbac 'ks and site planning. 3. Exterior materials and colors. 4. Type and pitch ofrosfs. .° o Size and spacing Of windows,'doors and other openings. . Towers, chimneys, roof structures, flagpoles, radio and television antennae. . Landscaping, parking area design and traffic circulation. Location, height and standards of exterior illumination. . The Planning Commission hereby approves Design Review 97-019 authorizing construction of community recreation facility on property located at 2834 Ballesteros Circle (Lot 2 of Tr 15574), subject to conditions contained in Exhibit A attached hereto. BINSACK Planning Commission Secretary EXHIBIT A DESIGN REVIEW 97-019 CONDITIONS OF APPROVAL RESOLUTION NO. 3579 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project dated February 23, 1998, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. The Director of Community Development may also approve subsequent minor modifications to plans during plan check' if such modifications are found to be consistent' with provisions of the Tustin City Code. 1.2 Desi~ Review approval shall become null and void unless building permits are issued within twenty-four (24) months of the date of this Exhibit. 1.3 The applicant shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any permits. (i) 1.4 All conditions in this Exhibit shall be complied with prior to the issuance of any building permits for this project, subject to review and approval of plans by the Community Development Department. 1.5 The applicant shall hold harmless and defend the City of Tustin from all cia/ms and liabilities arising out of the City's approval of this project. ,. All conditions of approval of Resolution No. 2637 and 2638 shall be applied to Desig-n Review 97-019. PLAN SUBMITTAL (1) 2.1 When submitting for a building permit, submit four sets of plans, two sets of structural calculations, acoustical reports, specifications and soils reports. electrical, mechanical and plumbing plans shall be included. Grading plans, landscape plans and sign plans shall be submitted separately. Also indicate the distances between the buildings. (1) 2.5 Pedestrian exit gates shall open from the inside without a key or special knowledge. Gates .shall swing in the direction of travel. Maximum effort to operate a gate shall not exceed 8.5 pounds. (1) 2.6 All gates and passage door, rays shall be 3'-0" wide and a minimum of 6'-8" kigh. Pairs of doors must have one leaf that provides a 32" minimum clear opening when opened at 90 degrees. (1) 2.7 · The bottom 10" of all passage doors or gates shall have a smooth solid surface on the push side. (1) 2.8 All gates and passage doors shall have lever type hardware, or other hardware designated to provide passage without grasping the hardware. Hand activated door opening hardware is to be between 30 and 44 inches above floor. (:) 2.9 Complete the hazardous material questionnaire and the air quality questionnaire and submit to the Building Division and the proper agencies..And if the answer to any of the questions is "yes", please provide'a note on plans stating: "Clearances from the Comity of Orange Hazardous Mmerials Disclosure Office and the South Coast Air Quality Management District shall be submitted to the Building Division prior to final inspection." The handicap access aisle should be revised to eight (8') feet wide. (1) 2.11 Recreation buildings, common areas and pool facilities shall provide complete access to disabled persons. (1) 2.12 Submit plans of community pool and spa to the County of Orange Health Care Agency for approval. (1) 2.13 Trash enclosures shall comply with Great Western Reclamation and City of Tustin standards. (1)' 2.14 All exterior colors to be used shall be subject to final review 'and approval of the Director of Community Development with regard to cglor, materials and detailing and shall be noted on the submitted construction plans and elevations. 2.15 Provide manufacturer's detail sheets of proposed exterior lighting fixtures. All fixtures shall be substantially consistent'with the architecture of the project and shall be subject to final approval by the Director of Comm.unity Development. (1) 2.16 All plant materials shall be installed in a healthy vigorous condition typical to the species. Landscaping shall be maintained in a neat and healthy condition; including, but not limited to, trimming, mowing, weeding, removal of litter, fertilizing, regular watering, or replacement of diseased or dead plants. USE RESTRICTIONS (5) All construction operations, including engine warm-up and deliveries of materials and kluipment, shall be subject to the provisions of the Tustin Noise Ordinance and shall take place only between the hours of 7:00 a.m. and 6:00 p.m., Monday through Friday, and between 9:00 a.m. and 5:00 p.m. on Saturday, unless otherwise determined by the Building Official. ' (1) 3.2 The operation and use of the recreational facility shall conform to the Tustin Noise Ordinance. Exhibit A .. Planning Commission Resolution No. 3579 Conditions of Approval, DR 97-019 Page 4 (1) 3.3 Any damage done to existing street improvements and utilities shall be repaired before acceptance of the tract and/or issuance of a Certificate of OccUpancy for the development on any parcel within the subdivision. OtLA.NGE COUNTY FItLE AUTHORITY Prior to. the issuance of any grading permits, the applicant shall submit and obtain the Fire Chiefs approval of the construction details for any access gate. Contact the Orange Comity Fire'Authority Plan Review Section at (714) 744-0403 for a copy of the "Guidelines for Fire Authority Emergency Access." 4.2 Prior to the issuance of building permits, the applicant shall submit to the Fire Chief a list of the quantifies of all hazardous, flammable, and combustible materials, liquids, or gases. These liquids and materials are to be classified according to the "Orange County Fire Authority Chemical Classification Handout." The submittal shall provide a summary sheet listing each hazard class, the total quantity of chemicals stored per class and the total quantity of chemicals used in that class. All forms of materials are to be converted to units of measure in pounds, gallons, and cubic feet. (1) 4.3 Prior to issuance of any building, permits, the applicant shall contact the Orange Cotinty Fire Authority Hazxrdous Materials Disclosure Office at (714) 744-0463 to obtain a "Hazardous Materials Business Information and Chemical Inventor}, Packet." This shall be completed and submitted to the Fire Chief before the issuance of any building permits.' 4.4 Prior to the issuance of a building permit, the applicant shall submit.plans for the review and approvhl of the Fire Chief. The applicant shall 'include information on the plans required by the Fire Chief. Contact the Orange County Fire Authority Plans Review Section at (714) 744-0403 for the Fire Safety Site/Architectural Notes to be placed on the plans. . (1) 4.5 Prior to installation, plans for an approved fire-suppression system for the protection of commercial-type cooking equipment shall be submitted to .the Fire' Chief for review and approval. Exhibit A Planning Commission Resolution No. 3579 Conditions of Approv. al, DR 97-019 Page 5 FEES (1) s.1 Prior to issuance of any permits, the applicant shall pay the following fees. Payment will be required based upon the rate in effect at the time of permit issuance and are subject to change. a. All applicable Building plan Check and permit fees to the Community Development Department based on the most current schedule. b. Within forty-eight (48) hours of project approval, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $38.00 (thirty-eight dollars) to enable the City to file the appropriate' environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
