HomeMy WebLinkAboutPOWERPOINT - CEDAR GROVEDesign Review 09-033 Cedar Grove Park Wireless Communication Facility wpr�,R- a"_ -Mosel,, Ii Background o On October 20, 2010, the City of Tustin Zoning Administrator approved the proposed request (previously designed as a faux cedar tree). o On October 27, 2010, the Zoning Administrator vacated the decision on the project and forwarded the item to the Planning Commission for their consideration. o On December 14, 2010, the City of Tustin Planning Commission considered the item and continued the item to the January 25, 2011 meeting. Background o At the January 25, 2011 Planning Commission meeting, the item was continued to a date uncertain at the request of the applicant and the public. o On April 26, 2011, the Planning Commission adopted Resolution No. 4163 approving the subject project. o On May 6, 2011, the City Clerk received an appeal of the Planning Commission's decision to approve Design Review 09-033. Project Location o Cedar Grove Park is located in Tustin Ranch along Pioneer Road o The site is located within the East Tustin Specific Plan. o Surrounding uses include gated residences to the south and east of the park along with an OCFA Fire Station at the southern end. I C� rTaT ;-- - - _ F7Mf`" C94METE DRfM lew -:033 FW�esigyn Rev* 09 o There are two sections of the Tustin City Code which apply to the proposed project. • Section 9272 pertaining to Design Review • Section 7260 pertaining to Design Review of Aboveground Utility Facilities on Public Property and in the Public Right of Way; and Resolution No. 01-95 [B.'esign Review 09-033 o Location - Landscaped circle within the parking lot of Cedar Grove Park; no impact to the public's use of the park is anticipated. o Stealth Facility- Stealth design as flagpoles. o Co -location - Cannot accommodate additional carriers as currently proposed; however, future technological advances may allow for co -location. o Colors - The flagpoles would be painted gray to match the color of the existing flagpoles at the project site. [B.'esign Review 09-033 o Screening - Vents for the underground vault and meter pedestals would be screened by landscaping. o Landscape - No trees would be removed and additional landscaping would be provided to screen the vents. o Signage - Only signage related to certifications and warnings will be allowed. o Accessory Equipment - All accessory equipment would be located within an underground vault adjacent to the flagpoles. [B.'esign Review 09-033 o Required Removal - Upon termination of the license agreement, the proposed facility would be required to be removed. o Undergrounding - All of the utilities servicing the project site would be located underground. o Height, bulk, and area of proposed structure - designed as a set of flagpoles, each with a diameter of 14 inches, two flagpoles with a height of 40 feet and a third flagpole with a height of 43 feet, is compatible with the existing pair of 26 foot high flagpoles that would be replaced. _n [B.'esign Review 09-033 o Setbacks and Site Planning- Proposed flagpoles would have the same location and setbacks as those existing. o Exterior Material and Colors - flagpoles would be metal with a fiberglass portion near the top and painted grey to match typical flagpoles. o Towers and Antennae - Each flagpole would contain two completely concealed internal antennas at the top. o Parking area design and traffic circulation - No modifications to the parking lot and thus have no impact on circulation. [B.'esign Review 09-033 o Physical relationship of proposed structure to existing structures - The proposed flagpoles would replace existing flagpoles at the site to minimize any potential impact. Flag poles are common in public parks and consistent with public park purposes. o Appearance and design relationship of proposed structures to existing and future structures - The flag sizes would be in proportion to the new flagpoles. o Development guidelines and criteria as adopted by the City Council - The proposed facility complies with the City Council's adopted Design Guidelines for Aboveground Utility Facilities and their Accessory Equipment. General Concerns o The Planning Commission as well as the general public noted a number of concerns regarding the proposed project which included the following: o Health Concerns o Alternate Location Analysis o Architectural/Aesthetic Impacts o Impact to the Park and intrusion on the Redwood/Cedar trees o Public Outreach o Effect on Property Values General Concerns Health Concerns The Federal Government, in particular the Federal Communications Commission (FCC), is responsible for regulating wireless transmissions and radio frequency emissions. The FCC has established guidelines and thresholds for radio frequency emissions to ensure the health and safety of humans. All wireless facilities are required to comply with the standards established by the FCC. Alternate Location Analysis T Mobile has relocated the proposed facility from within the park to the landscape circle within the parking area. T Mobile performed drive test to confirm the need of the proposed facility Micro -sites option was evaluated and found to be not feasible OCFA facility in Irvine General Concerns Architectural/Aesthetics Impacts New location within landscape area in the parking lot and designed as flag poles replacing the two existing poles and add one new pole. Impacts to the Park and intrusion on Redwood Cedar trees New location in the parking lot away from park use and cedar trees Public Outreach Public outreach meeting on January 9, 2011 Effect on Property Values Any correlation between wireless telecommunication facilities and property values is difficult to measure. Several informational pamphlets are included in the staff report packet. Deed Restriction o Cedar Grove Park deeded to the City from the Irvine Company on August 8, 1989 o Deed only requires review of "Initial Park Improvements" by the Irvine Company. o Irvine Company reviewed initial improvements and has indicated no additional release is necessary. o The City Attorney has reviewed the request and does not find a conflict with the proposed project. License Agreement o Required pursuant to TCC Section 7261 o Separate from the Design Review o Reviewed by the City Attorney's Office, City Manager's Office, and City Council o Requires a separate City Council approval Federal Telecommunications Act o Provides regulations for wireless facilities o Regulates radio frequency emissions o The City and wireless providers are subject to these regulations o Regulates the placement, construction, and modification of wireless facilities Recommendation o Staff recommends that the City Council adopt Resolution No. 11-47 approving Design Review 09-033 to install and operate a wireless telecommunications facility consisting of two (2) flagpoles with a height of forty (40) feet and a third flagpole with a height of forty-three (43) feet and underground equipment located within the landscaped circle in the parking lot of Cedar Grove Park located at 11385 Pioneer Road.
