AGENDA REPORT MEETING DATE: AUGUST 23, 2011 TO: PLANNING COMMISSION FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: SUMMARY OF PROJECTS RECOMMENDATION: That the Planning Commission receive and file this item. DISCUSSION: ITEM # 4 The following is a list of projects and activities since the 2010 Year in Review report provided at the January 25, 2011, Planning Commission meeting. The list focuses on the status of projects that the Planning Commission, Zoning Administrator, or staff approved; major improvement projects; Certificates of Appropriateness; Code Enforcement activities; and, other items of interest. Nunos Brothers Retail Building (15761 Tustin Village Way): The project involves reconstruction of a 15,000 square foot retail center to replace a former retail center that was destroyed by fire. The project is nearing completion. Planning Commission Report Summary of Projects August 23, 2011 Page 2 • TTM 17342 (17772-17862 17th Street): The project is a subdivision, for condominium purposes, of an existing 9.62-acre property into five (5) numbered lots and one (1) lettered lot, for a maximum of 115 office units. The resulting map will create one parcel for each of the five (5) existing buildings (numbered lots), condominium units within each building, and a sixth lot (lettered lot) for the existing common access, parking, and landscaping areas. The Planning Commission and the City Council adopted resolutions approving the project. This Final Tract Map has recently been approved by the City Council and is awaiting recordation. Jalapenos Restaurant (450 E. 1St Street): The Planning Commission approved a Conditional Use Permit to allow a restaurant expansion, increased seating, new outdoor dining area, and modified business hours for Jalapenos restaurant located at 450 E. First Street. This project is now complete. • Larwin Square (530 E. 1St St.): Plans for minor facade improvements to include the removal and replacement of wooden posts and painting of the center facade have been issued and construction is now complete. The center also recently completed parking lot and ADA compliant improvements throughout the center. • Old Town Mixed-Use Building (170 EI Camino Real): Conditional Use Permit 07- 014 and Design Review 07-015 were approved for the construction of a 7,650 square foot mixed use building. Construction is underway and is anticipated to complete in late Fall. 170 EI Camino Real Planning Commission Report Summary of Projects August 23, 2011 Page 3 • 195 EI Camino Real (former Riteway Cleaners): A demolition permit has been issued for the existing commercial building and residential structure. The property owner indicated that the property is currently being sold to a new owner. No specific future use has been disclosed. New dental office building (740 EI Camino Real): A conditional use permit to establish amedical/dental office at 740 EI Camino Real was approved by the City Council on March 4, 2008. A Design Review application for demolition of the existing building and construction of a two-story dental office building with ground floor retail was approved by the Planning Commission on June 9, 2009. The project is complete Large Family Day Care (17362 Laurie Lane): On June 14, 2011, the Planning Commission approved a request to operate a large family day care home caring for up to fourteen (14) children at the residence located at 17362 Laurie Lane. On June 17, 2011, an appeal of the Planning Commission was filed by Councilmember Gavello due to concerns regarding traffic and noise. On August 2, 2011, the City Council upheld the Planning Commission's action and approved the large family day care home. • Old Town Family Fun Night: An application for a Thursday night farmers market has been submitted. The event would include sales of produce and crafts, entertainment, kids corner, food booths, etc. The applicant is in the process of collecting signatures from affected merchants and/or tenants. Council is considering associated fees. Planning Commission Report Summary of Projects August 23, 2011 Page 4 • First Street Specific Plan: Staff is working with the Planning Commission to revamp the First Street Specific Plan district regulations. Two Planning Commission workshops have been conducted and a public workshop is being scheduled in September. • Pacific Center East Specific Plan: On July 5, 2011, the City Council approved an Agreement with R.D. Olson Development for the purchase of seven and one-half acres of City-owned property located to the northwest corner of Newport Avenue and Del Amo Avenue for the development of two high-quality hotels totaling 300 rooms. The proposed hotels are anticipated to include the Hilton Garden Inn with 160 rooms, and the Hilton Homewood Suites with 140 rooms. In addition, the project will contain 16,000 square feet of retail and restaurant uses. Total project costs are estimated at $62 million by the developer. Entitlement applications for the hotels will be submitted to the City shortly and will be forwarded to the Planning Commission for consideration. Tustin Auto Center (36 Auto Center Drive): Tustin Toyota is moving to Joe's Garage building. At its meeting held on July 5, 2011, the City Council unanimously approved an agreement with Tustin Toyota. The agreement is a sales tax reimbursement agreement for a major expansion and rehabilitation project planned by Tustin Toyota at 36 Auto Center Drive in the City of Tustin. Under the terms and conditions of the agreement, Tustin Toyota will receive reimbursement for a portion of their rehabilitation costs based on incremental sales taxes generated from the dealership. Tustin Toyota (Former Joe's Garage) Planning Commission Report Summary of Projects August 23, 2011 Page 5 Super Irvine Market (2505 Bryan Avenue): Super Irvine, a new Persian supermarket, has submitted a 72,650 square foot tenant improvement plans for plan check. Super Irvine will replace the old Sears/Kmart building on Bryan Avenue and Tustin Ranch Road. The supermarket will offer variety of produce, meat, hot food, and bakery items. • T-Mobile Wireless Facility (Cedar Grove): T-Mobile's request to install and operate a wireless telecommunications facility consisting of two (2) flagpoles with a height of forty (40) feet and a third flagpole with a height of forty-three (43) feet and underground equipment located within the landscaped circle in the parking lot of Cedar Grove Park was approved by the Planning Commission on April 26, 2011. On May 6, 2011, an appeal of Design Review 09-033 was filed by the City's Mayor Pro Tem due to concerns regarding the aesthetics and compatibility of the design of the facility and the parameters of the installation. The City Council considered the item on July 19, 2011, and continued the item to October 18, 2011, asking staff to bring back additional information for their consideration prior to taking action on the project. • Construction and Business License Fee Waivers: On July 19, 2011, the City Council approved a policy for construction and business license fees waivers. The policy will apply to new and renewal business licenses, and building plan check and permit fees for new improvements and additions to existing developments. Zoning Administrator Actions • Conditional Use Permit 2011-07(137 W. 1st Street, Suite A): The Zoning Administrator approved the on-site sale of alcoholic beverages in conjunction with the new Del Tomate restaurant, an Argentinean and Italian restaurant, at the Heritage Plaza shopping center. • Conditional Use Permit 2011-12 (13842 Newport Avenue, Suite C): The Zoning Administrator authorized the on-site sale of alcoholic beverages in conjunction with a new Japanese Bistro (Cohan) within an existing tenant suite once occupied by a Tobacco store. Conditional Use Permit 10-013 (694 EI Camino Real): A new chiropractor office will be located on the first floor of the EI Camino Plaza shopping center. Although the office will not directly face onto EI Camino Real, the lot in which the tenant suite is Planning Commission Report Summary of Projects August 23, 2011 Page 6 located fronts onto EI Camino Real; thereby requiring approval of a Conditional Use Permit. Design Review 10-021 (200 EI Camino Real): The Design Review for the construction of a new parking lot on a vacant lot adjacent to the Hair Gallery was approved. This site was at one time approved for a new office/retail building; however, the owner decided not to proceed with the development and instead proposed a new parking lot to accommodate the salon clientele. Conditional Use Permit 2011-10 (139 W. First Street, Suite E): The Zoning Administrator approved the establishment and operation of a yoga studio in a 4,104 square foot existing tenant suite located at in Heritage Plaza. This suite was once occupied by Anthony B hair studio. • Conditional Use Permit 2011-01 (13891 Red Hill Avenue): On June 6, 2011, the Zoning Administrator approved a request to install and operate a ground water remediation system at an existing Shell gas station. Construction plans have not yet been submitted for review. Conditional Use Permit 2011-11 (631 E. 1St Street): The Zoning Administrator approved a request to establish an exercise studio (bar method exercise) in an existing tenant suite. Minor tenant improvement plans have been submitted and are currently in review. • Conditional Use Permit 2011-02 (195 EI Camino Real): Installation and operation of a temporary soil remediation system at 195 EI Camino Real was approved. The applicant indicated that the remediation work has been completed and that a demolition work is proposed to accommodate a new buyer. Tustin Legacy • Master Developer: The City Council approved a Disposition Strategy for the master developer footprint. The Disposition Strategy would have the City assume a limited Master Developer role by marketing smaller segments or Disposition packages or parcel groupings of the property. The segments were selected based on infrastructure needs and phasing of the backbone infrastructure and local infrastructure obligations, and market conditions. Recently, the City released development sites for offers from highly qualified and well financed developers. • Columbus Square: There are three (3) remaining undeveloped sites located within Columbus Square (Coventry Court, Astoria, and Mirabella). Mirabella: The development of 60 attached townhomes at the Mirabella site is progressing. Models are nearing completion and units are available for sale. Planning Commission Report Summary of Projects August 23, 2011 Page 7 Augusta (formerly Astoria): The construction of 64 detached single family homes (previously approved as part of the Astoria site) are progressing. To date, models have been completed and units are available for sale Coventry Court: On July 7, 2010, the City Council approved Lennar's application to resume construction of the 240-unit senior housing complex at Columbus Square. The project construction is rapidly taking place and Meta Housing has also hired a management company to facilitate the leasing and qualification of applicants. • Columbus Grove: Ainsley Park is the last product to be built at Columbus Grove. Construction of 84 duplex-cluster homes at Ainsley Park is progressing. To date phase 4 of the 5 phases have been completed. Planning Commission Report Summary of Projects August 23, 2011 Page 8 Fire Station 37 (Relocation): The City is continuing with the design development process for Fire Station 37 with the Design Consultant and the Orange County Fire Authority. The construction drawings are currently in plan check. • The District at Tustin Legacy: Vestar Development Company together with the U.S. Army Reserves are in the process of exchanging properties to accommodate a new parking area for the District at Tustin Legacy. Included as part of this project is the installation of permanent traffic control devices preventing left turns at Park Avenue into the Lowe's driveway and the Costco gas station to alleviate backups on- site at the Wholefoods and TJ Maxx drive aisle. Code Enforcement • Graffiti: There were 2,360 incidents from January 1, 2011 thru August 15, 2011. Water Quality: Existin Develo ment Ins ections NPDES Ins ections :The new permit cycle (five year cycle which may be extended to seven years) began July 1, 2010. There are currently 112 commercial and 85 industrial for a total of 197 inspections to be completed. Water Quality Management Plans,~WQMPs): There are currently 84 WQMP's on file. Prior to the rainy season in October, 25% of the WQMP's on file must be inspected every year (21 inspections this year). Regular quarterly updates will be provided to the Planning Commission on the progress of inspections. • Administrative Citations: 18 cites issued (1/1/11 through 7/1/11) 10 of the cites issued are still open and 8 cites have been closed. Public Improvements -Public Works Department Update • Newport Avenue Extension (CIP No. 70131): The City, Southern California Regional Railway Authority, Burlington Northern and Santa Fe Railroad, and the Orange County Flood Control District completed review of the 100% design plans. Dokken Engineering, the City's consultant, is currently revising the plans based on these comments. • San Juan Sidewalk west of Browning Avenue (CIP No. 70198): Construction is now complete. The project was funded by the Community Development Block Grants (CDBG). Planning Commission Report Summary of Projects August 23, 2011 Page 10 • Street Maintenance: The FY 2010-2011 Annual Major Pavement Maintenance and Sidewalk Repair projects are nearly complete. Design for the FY 2011-2012 projects has been initiated. Mitchell Avenue/Utt Drive Pedestrian Enhancements (CIP No. 40073): The construction contract was awarded and construction has begun. Work is scheduled to be completed by mid-September in conjunction with the Mitchell Avenue Storm Drain project. The project is funded with State of California Safe Route to School Grant funds (SR2S). Red Hill Avenue Parking Bay at Pine Tree Park (CIP NO. 20063): Construction is now complete. The project was funded by CDBG. • Traffic signal installation on Prospect Avenue at Beneta Way/Amaganset Way (CIP No. 40077): Construction is now complete. The project was partially funded with State of California Safe Route to School Grant funds (SR2S). • Red Hill Avenue Quiet Zone at railroad crossing (CIP No. 40069): All supplemental safety measures were installed at the at-grade railway crossing. The Notice of Establishment was filed with the Federal Railway Authority (FRA) and other affected agencies in early March 2011 and the Quiet Zone was formally implemented on March 24, 2011. • Mitchell Avenue Storm Drain (CIP No. 50035): The construction contract was awarded and construction has begun. Work is scheduled to be completed by mid- September in conjunction with the Mitchell Avenue/Utt Drive Pedestrian Enhancement Project. • Rawlings Reservoir Replacement Project (CIP No. 60136): Phase I Demolition of the Reservoir is underway and is scheduled to be complete by the end of September 2011. The Phase II Construction Design Plans and Specifications prepared by Tetra Tech are being completed by incorporating the constructability review completed by Butier Engineering, Inc. The Phase II construction is scheduled to begin in Spring 2012 and will be complete in approximately 18 months. Planning Commission Report Summary of Projects August 23, 2011 Page 11 • Tustin Metrolink Parking Structure (CIP No. 10062): The OCTA Board of Directors awarded a contract to Bomel Construction on August 23, 2010. Construction is under way and is scheduled to be complete by late September/early October 2011. Tustin Ranch Road Rehabilitation between Bryan Avenue and Jamboree Road (CIP No.70195) and Bryan Avenue Rehabilitation between Browning and Jamboree Road (CIP No. 70199): The Construction is now complete. Tustin Avenue Well (CIP No. 60150): Design engineering (95% complete) is continuing for the Drilling of the Tustin Avenue Well at 1822 N. Tustin Avenue. 'The residence was moved to its current location from 640 W. 1St Street in 1990. The Survey notes that this is one of Tustin's very fine rare Italianate structures and there are less than 25 Italianate homes remaining in all of Orange County. The proposed work involves the installation of a roof mounted photovoltaic (PV) system. The system will consist of twelve (12) PV panels approximately 3' X 5' in dimension which are flush mounted with the roof slope. All panels will be located on the west facing portions of the existing roof which will minimize visibility of the panels from the street. Conduit will run down the west side of the house to the inverter box and be painted to match the existing surface. The inverter will be located near the existing electrical panel on the west side of the house. In accordance with Ordinance No. 1001 which was adopted June 20, 1988, by the Tustin City Council, the Community Development Director has the authority to approve, approve with conditions, or deny Certificates of Appropriateness for improvements requiring a City building permit for property located within a Cultural Resource District. The Community Development Department finds and determines as follows: A. The proposed work conforms to the Municipal Code and any applicable design standards in that the proposed project meets zoning code and building code requirements. B. The proposed work does not adversely affect the character of the District or Designated Cultural Resources within the District in that: the proposed photovoltaic panels would be located on the western portion of the two story roof in order to limit visibility from the public right-of-way. Furthermore the panels will be flush mounted to the roof with no slope differential. C. The proposed project includes the demolition of the existing garage, kitchen, and family room, and addition of a new garage, kitchen, family room, and second floor master bedroom suite. The proposed addition will be constructed to be compatible with the existing house in terms of exterior wall material, windows, exterior color, and roof materials. In accordance with Ordinance No. 1001 which was adopted June 20, 1988, by the Tustin City Council, the Community Development Director has the authority to approve, approve with conditions, or deny Certificates of Appropriateness for improvements requiring a City building permit for property located within a Cultural Resource District. The structure is "Non-rated" per the Tustin Historical Resources Survey. The Community Development Department finds and determines as follows: A. The proposed work conforms to the Municipal Code and any applicable design standards in that: 1) the proposed project meets zoning code requirements and would match the exterior colors and materials of the existing house, and 2) the garage back-up distance of 20 feet (including 5 feet of rear yard setback and 15 feet of alley width) will accommodate the turning radius necessary for a passenger vehicle. B. The proposed work does not adversely affect the character of the District or Designated Cultural Resources within the District in that: the proposed project is an addition to an existing house with all of the work at the rear of the property and not highly visible from Pasadena Avenue, thereby maintaining the character of the District.
