AN ORDINANCE OF THE CITY 0F TUSTIN, CALIFORNIA,
CREATING AND PROVIDING FOR A TRAFFIC COMMISSION

The City of Tustin, California, does ordain as follous:
1. Created; Composition, Appointment; Terms of Members;
Vacancies; Removal of Members.

The~e is hereby created a Traffic Commission of the

City. Such Commission shall consist of seven (7) members,

five (5) of whom shall be members of the public appointed by

the City Council as hereafter provided, together with the

Chief of Police, or in his absence the Tustin Police Department
13
Field Operations Manager shall serve as his alternate,
14
~ogether ~ith the City Engineer, or in his absence the CiUy
15
Traffic Engineer shall serve as his alternate. The ter~s of
16
office of the public members shall be two years running ~rom
17
January ls~ through December 31st of the following year.

Three of the public-member Commissioners shall have
19
beginning January.1 of even years, and t~o of the public-
20
member Commissioners shall have terms beginning January ls~
21
of odd years. The City Council shall appoint new Commissioners
22
one month in advance of the expiration o~ the preceding term
23
to a~sure a smoo=h con=inu~nce of the Commismiono New
24
Commissioners have no of[icial powers or duties un~ii the
25
expiration of the prior term, The Council shall, within one
month of any vacancy, appoint successors to fill the unexpired
27
term of any Commissioner whose office is vacant for any
28
r~ason. Commissioners may be removed a= any time bF ~he
29
City Council. ~ Commissioners shall serve at the pleasure of
30
the City Council and may be removed by the City Council at
31
any ~i~e. upon anV filing of nomination paj.,e~s [or ~e office
32
city councilman on behalf of anV Traffic Commissioner, his position
shall he vacated [orthwith.
1 2. Meetings; Procedural Rules and Regulations;
2 Officers.
The Commission shall meet as often as necessary to

carry out its responsibilities, but shall meet at least omce
5
each month in regular session. The Commission shall establish
such rules and regulations as it deems necessary for governinS
itself and for the faithful performance of its duties. Such

rules and reSulazions shall not be inconsistent with the
9
laws of the state or ordinances of the City. At the next
10
regular meeting followin~ January let of each year, the
11
Commission shall elect one member chairman and one member
12
vice-chairman, who shall hold office for one year from
13
January through December. Responsibilities of chairmen
shall be: prepare agenda for eli meeticEs, act as chai=ma~
15
~" .for all meetings, prepare end review preliminary drafts of
16
minutes prior to approval by the Commission, act as spokesman
for the Commission expressing the desires of the Commission.

The vice-chairman ~halI assume =he duties of =he chairman in

his absence.

3. Responsibilities and Authority.

The Commission is responsible for researching and
22
recommending $olut'ions, improvements and programs, to enhance
23
understanding, control, and safety in traffic-related matters.

The Commission has ~nly such authority as that expressly
25
granCed to it by the City Council and is not empowered to
26
initiate any program or undertaking without the approval of
27
"' the City Council; provided, however, that the COmmission
28
may, on its own initiative, recommend such undertaking or
29
program to the Council withou~ the request of the Council
30
for such recommendation. The City Council may set aside any
31
act or recommendation of the Commissio~.

The ~utiea of the Commission shall include, but no~ be

~ limited to, the following:'
4 The Commission shall act in an advisory capacity
5 to the City Council on all traffic mat'tara, and ~peciflcally,
6 but not limited to the areas
7 a.. receiving complaints having to do with

8 traffic
9 b. surveying, reviewing and m~k!ng recommendatlon~

tO the C~ty Council relative to traffic conditions,
11
improvemen~ of traffic conditions and the
and enforcement of traffic regulations;
c. surveying, revie~ing and recommending
City Council on plans fo~ improved parking;
15 d. surveying, reviewing and recommending
16
City Council safe~y programs, campaigns and
17
activities to educate t~e public in traffic safety.

5- Traffic Safety Program.

The Commission is hereby empowered to initiate and

maintain a program .o~ traffic safety pursuant to the California

Traffic Safety Proaram~ Vehicle Code Division 2, Chapter
2Z
Section 2900-2910. Said secUions of Vehicle Code are hereby

Such actions by the Commission are subject ~o the disapproval
of the City Council'insofar as Such disapproval is no=
inconsis~ent ~i~h the said sections of the Vehicle Code or
any state law relating thereto.
6. Public Liaison.
The Commission is specifically empowered to act as a
body to receive complaints and recommendation~ concernin~

traffic matters. In this capaclty~ the Commission shall act
as a llaison to communicate information obtained from the

1 general public and other local agencies to the City Council.
2 The Commission shall. provide a procedure to proce~.s and
3 analyze the information g~thered from the above complaints
4 and recommendations, and based on thi~ analysis shall give
5 appropriate recommendations to'the City Council.
6 7. Cooperation With Other Agencies.
~ The Commission shall cooperate ~ith other city officials
8 or agencies in endeavoring to improve traffic condltion8 and
.9 to execute any other po~ers or duties imposed by this code
10 or any other ordinances of this City.
