Present' Bacon, Mitchell, Sheridan, Mueller, Morris, Smith, Berlin City Engineer McBride, present City Attorney Rourke, present MINUTES OF APhIL 9th APrHOVED Moved by Mr. Mueller, seconded by Mr. Sheridan, that minutes of April 9th meeting be approved as mailed and re- ceived. Motion carried. ZONE CHANGE HEAIIING HE SCHMETZEH Hearing on Zone Change Application No. 62-102 of Louis Schmetzer to rezone property at 185 5. Prospect Avenue from C-2-P back to original M. Zoning. COMMENTS BY MR. SCHMETZER Mr. Schmetzer spoke in his own behalf and explained problems of enlarging his h~iness under the present zoning. COMMENT S Mr. Nicholas Barletta spoke against any spot zoning of PI on Prospect Avenue. Mr. Ed Mitchell spoke against M zoning on Prospect. HEAHING CLOSED There being no further comments, the hearing was declared closed. CITY ENGINEER MADE HECOMMENDA_ TIONS i~E PhOi~'EtiTy City Engineer recommended that a portion of property remain C-2-P and remainder des- cribed as follows be zoned PM' Commencing at a point 40 feet East of the Southwest corner of the North 155 feet of Lot A, Tract ~o. 555 as per M.M. Book 26, page 15 - thence, North 80 feet---thence, East 271 feet, plus or minus, to West line 20 feet alley shown on Tract No. 3994 thence, South, 80 feet, thence, West 271 feet plus or minus to point of beginning. Motion carried by roll call - Ayes' Bacon, Sheridan, ~itchell, Mue!ler, Morris, Smith. Abstained' Berlin. TANCkEDI HEARING OPENED COMMENTS BY MR TANCHEDI C OMM ENT S Hearing on Zone Change Application No. 62-101 of harry Tancredi requesting C-1 zoning both North and South sides of Fourth Street for ll50 feet opened at 8:05 P.M. Mr. Tancredi spoke in his own behalf. Mr. Frank Schmitzer, 165 Yorba Street, spoke against any commercial zoning in this area. HEAHING CLOSED There being no further comments, the hearing was declared closed. TANCHEDI HE- QUEST POSTPONED FOR STUDY UNTIL MAY 28th Moved by Mr. Sheridan, seconded by ~lr. Morris that decision on above request be deferred to the second meeting in May for study and con- sideration of Fourth Street zoning from Newport Freeway to Newport Avenue. ~lotion carried. Motion carried. NO OBJECT IONS TO COUNTY TRACT 4611 Moved by ~lr. Mueller, seconded by Mr. Sheridan that Secretary write the County Planning Com- mission stating no objections to tentative maps. Tract No. 4611. Motion carried. NO OBJECTIONS. TO COUNTY TRACT NO 4664 Moved by Mr. Smith, seconded by Mr. Morris that secretary write the County Planning Commission stating no objections to tentative map Tract No. 4664 under the existing zoning although surrounding territory is under consideration by the City for future annexation and M zoning. Motion carried. NO ACTiON TAKEN ON DIST MAP 9-5-9 Moved by Mr. Sher~dan~ seconded by Mr. Mueller that no action be taken at this time regarding Sectional District Map 9-5-9 due to the ar~i- .cipated study of Fourth Street Extension from Newport Freeway to Newport Avenue. Motion carried. Motion carried. ~r. J. Bellew with Land Research Association presented plot plan for proposed apartments in R-3 zone area, East of Frontage Road in Bed Brown Annexation and requested opinion of Commission regarding location of garages. Mr. Bellew was informed he would have to apply for a Variance. IN TEiiPIikT&Ti ON OF SECTS. 5 & 12 of Ord. 157 Mr. J. Prescott requested interpretation of Sections 5 and 12 of Ordinance No. 157 and explained controlled parking. Moved by Hr. Sheridan, seconded by Mr. Morris CONTHOLLED that request of Tustin Mortuary for controlled PA~KING APPROVED parking be approved, subject to approval of AT HEQUEST OF the architectural committee after plans are TUSTIN MOi~TUA~{Y submitted. Motion carried. M~.'Mitchell abstained from voting. FI]~ST HE~RING ON 157 AMENDMENTS ON 5-28-62 ADJ~ b~NMENT Moved by Mr. Mueller, seconded by Mr. Smith' that first hearing on amendments to Ordinance No. 157 be held on ~lay 28th in the Tustin City Hall.
