Present: Bacon, Sheridan, Mitchell, Mueller, Morris Smith, Berlin City Engineer McBride, present City Attorney Hourke, present MINUTES OF APRIL 23rd APPROVED PARR LANE APT. PROJECT - Var. N0.62-116 OPENED DISCUSSION ABOUT ABOVE HEAHING CLOSED ADOPTION OF RESOLUTION NO. 560 APPROVING VAH. NO~ 62-116 HEAnlNG ON ZC NO. 62-103 HE H-3 to C-1 ZONING DISCUSSION OF ABOVE HEAHING CLOSED Moved by Mr. Smith, seconded by Mr. Mueller that Minutes of April 23rd meeting be ap- proved as mailed and received. Motion carried. Hearing on Variance Application No. 62-116 of Park Lane Apartment Project, to permit de- tached garage units in the front one-half of property, opened at 7:35 P.M. Mr. O. L. Woolery asked for clarification of variance request. Mr. Bellew spoke in behalf of Park Lane Apartments Project and Land Research Assoc- iation, explaining complete layout of plans. M. Hilton, Tustin Fire Chief, requested fire hydrant be placed on property. There being no further comments and no ob- jections, the hearing was declared closed. Moved by Mr. Morris, seconded by Mr. Mitchell that Resolution No. 560, approving Variance Application No. 62-116 and stipulating that fire hydrant be placed with the ~ire Chief's approval, be passed and adopted. Motion carried by roll call, all members voting Aye. Hearing on Zone Change Application No. 62-103 of Ted Fish and John Siegel, asking for H-3 and C-1 zoning on certain property within McFadden Newport Annexat~ on, opened at 7:55 P.M. Letter of approval of said application from Frank L. Warden, Jr. read by the Secretary. Mr. Buescher, owner of adjacent property, spoke approving the zone request. Mr. Ted Fish, applicant, spoke in his own behalf. Mr. George Bliss requested some form of physical protection be placed between C-1 and R-3 property and his property, directly to the. Southwest. There being no further comments, the hearing was declared closed at 8'10 P.M. ADOPTION OF RESOLUTION NO. 561 RECOMMENDING TO C~TY COUNCIL ZONING OF R-3 BE PASSED Moved by Mr. Mueller, seconded by Mr. Smith that Resolution No. 561 recommending to the City Council that entire parcel under considera- tion be zoned R-3 be passed and adopted. Motion carried by roll call - Ayes: Sheridan, Mitchell, Mueller, Smith, Berlin, Bacon. Abstained: Morris. HEARING ON UP62-106 OF JACOBSON OPENED DISCUSSION OF ABOVE HEAHING CLOSED F.D. REQUEST ROAD AHOUND DEVELOPMENT ADOPTION OF RESOL.NO. 562 APPROVING UP 62-106 OBJECTIONS TO UV497~ TO BE SENT TO COUNTY PLANNING COMMISSION AND THAT STUDY BE MADE OF ENi~I}~E 17 ST AREA Hearing on U.P. Application No. 62-106 of Eugene and Harold Jacobson for ap- proval of construction of units in P.D. District opened at 8:20 P.M. Mr. Eugene Jacobson explained location and plans, stating property is ll.2 acres, over 5 acres to be in parks. There will be 49 one bedroom and den apartments, 86 two-bedroom and den apartments, 4 recreation areas and pools, a putting green and that only 8 of the buildings are to be two-story. Mr. W. B. Taylor, 10281 S. W. Ladera, Santa Ana, owner of property on Main Street stated that both sides of Main St-eet should be the same, either R-1 or P.D. Mr. George Broomell, Pacific Street; Mrs. John Sauers, 515 Pacific Street; Mr. S. Borum, 350 Myrtle; and Mr. A. T. Williams, 735 W. Main Street all spoke objecting to any apartment use in the area. There being no further objections or dis- cussion, the hearing was declared closed at 8:40 P.M. Morgan Hilton, Tustin Fire Chief requested a road completely around the development and fire hydrants strategically placed. Moved by Mr. Smith, seconded by Mr. Mueller that Resolution No. 562, approving UP 62-106, subject to the satisfaction of the Fire Chief as to fire protection and stating that Sixth Street be a cul-de-sac approved by the City Engineer, be passed and adopted. Motion carried by roll call. Ayes: Bacon, Mitchell, Sheridan, Mueller, Smith, Berlin. Abstained: Morris. Moved by Mr. Mueller, seconded by Mr. Sheridan, that the Secretary write the County Planning Commission, voicing this commission's objection to the granting of UV4974 as being incompatible to the area and being conducive to spot and strip zoning and suggesting that further study be made of the entire 17th Street area from Newport Freeway to Newport Avenue by both the county and city planners. Motion carried. Mr. W. 0pp spoke in favor of multiple dwellings in this area. DISAPPROVAL OF CP996 TO COUNTY PLAN. COM. Moved by i~lr. Smith, seconded by Mr. Morris that the Secretary write the County Planning Commission stating this commission's dis- approval of CP996 as being incompatible to present zoning. 217 MR. SMITH & MR. MORRIS WITHDREW MOTIONS RECOMMENDATION TO COUNTY PLAN.COM. DENIAL OF CP996 Mr. Smith and Mr. Morris withdrew motion and second respectively. Moved by Mr. Smith, seconded by Mr. Sheridan that clerk write the County Planning Commission recommending denial of CP996 inasmuch as the use would be detrimental to property values to the East. Motion carried. Mr. Mitchell voting No. RECOMMENDATION TO COUNTY PLAN. COM. THIS COMMISSIONS' OBJECTIONS TO UV4971 AS INCOM- PATIBLE TO THE AREA Moved by Mr Mueller~ seconded by Mr Smith that Secretary w~ite thevounty Planning ~ommission voicing this Commission's objections to the granting of UV4971 as being incompatible to the area and being conducive to spot and strip zoning and requesting that UV4971 be deferred until further study of entire Seventeenth Street area from Newport Freeway to Newport Avenue is completed by both the county and city planners. Motion carried. AMENDMENTTO READ "DEFERRED" Moved by Mr. Mueller, seconded by Mr. Smith that original motion regal'ding UV4974 be amended to read deferred. Motion carried. NO OBJECTIONS TO UV4970 Moved by ~'ir. Mueller, seconded by Mr. Morris that Secretary write the County Planning Com- mission stating no objections to UV4970. Motion carried. NO OBJECTIONS TO UV4969 Moved by Mr. Mueller, seconded by Mr. Smith that Secretary write County Planning Commission stating no objections to UV4969. Motion carried. COHkESPONDENCE RECEIVED & FILED Moved by Mr. Sheridan, seconded by Mr. Mitchell that correspondence be received and filed. Motion carried. UP AND ZC COMING Mr. Hose of LarwinSquare-Tustin spoke to the UP MAY 28th BROUGHT Commission regarding U.P. and Zone Change hear- UP BY MR. ROSE ings coming before the Commission on May 28th. CLARIFICATION OF ZON lNG REQUESTED Mr. C. Smith asked for clarification of property zoned 100-C-l-10,000 and RP in the County when said property is annexed. CLARIFICATION GIVEN BY ATTY. It was explained by the city attorney that any property with a county zoning not the same as a zone listing within the city would have to come in as a "U" Zone and be rezoned after annexation. REVISED ZONING ORD. OF PHOENIX, ARIZ. PRESENTED FOR CONSIDERATION OF INDUST.PARK ZON. HEQUEST FOR COLORED ZONING MAP FOR PLAN. COM. ADJOURNMENT Mr. Sheridan presented the Revised Zoning Ordinance of the City of Phoenix, Arizona, for the purpose of consideration by this city of Industrial rark Zoning. Said ordinance placed on file with the · CityClerk. Moved by Mr. Smith, seconded by ~r. Morris that this commission respectfully request that the city council supply the commission with a colored zoning map including Tustin and the surrounding county area. Motion carried.
