Present: Bacon, Sheridan, Mitchell, Muelle~, Morris, Gibbons Absent: None City Attorney Roorke, present. City Engineer, Carlsen, absent. Planning Advisor Remland, present. Moved by Mueller, seconded by Sheridan that Minutes of April 22nd meeting be approved as mailed and received. Carried. Hearing on UP application No. 63-137 of William D. Prout to permit Garden Apartments on property zoned P.D. and located at Gwyneth D,ive, Tustin, opened at 7:35 P.M. Mr. Remland described subject property and reviewed accompanying map. Recommendations and application read. City attorney advised that railroad is holding a Hearing regarding right of way and stated that it appears to be a routine matter. ~ l-~r. Rourke recommended approval subject to approval of railroad. There being no objections or comments, the Hearing was declared closed at 7:45 P.M. Moved by Mueller, seconded by Mitchell that Resolution No. 640 approving UP 63-137 with restrictions as set forth by Planning Department, Building Department and Fire Department and stating no building permit issued until Railroad right of way is recorded, be passed and adopted. Carried by roll call, all members voting Aye. Hearing opened at 7:49 P.M. on UP 63-138 of Capital Alliance to permit t~dev~]opment of property zoned PD and located 585 feet S/E of Newport on North side of First Street extension. Property described by Mr. Remland and conditions and correspondence read. Mr. R. Smith spoke in his own behalf. There being no objections or further comments, the Hearing was closed at 8:55 P.M. Moved by Mueller, seconded by Mitchell that Resolution No. 641 be passed and adopted approving granting UP 63-138 subject to conditions as set forth by Planning Advisor, Engineering Department and Fire department. Motion carried. Ayes: Bacon, Sheridan, Mitchell, Mueller, Gibbons. Abstained: Morris. Hearing on UP 63-139, Mobil Oil Co. to permit pole sign in C-2-P District opened at 8:05 P.M. Moved by Mueller, seconded by Morris that Hearing on UP 63-139 be continued to next regular meeting unless revoked prior to that time. Carried. Zone Change 63-123, Alex Fishman, continued from April 22nd explained by Mr. Rem_land as to ~ocation, access and surrounding zoning. RESOLUTION NO. 642 ZC 63-123 ALEX FISHNAN TRACT 5150 TUSTIN ELEM. SCHOOL DISTRICT CASE 649 CASE 651 UV 5154 Moved by Mueller, seconded by Sheridan that Resolution No. 642 be passed and adopted, recommending approval of ZC 63-123 of A. Fishman with final rezoning not to be completed until such time as architectural contwol is clarified regarding Section 5.23 of Ordinance 157 to mean building permit and that Myrtle Avenue be a dedicated street and Myrtle and Newport Avenues be improved to meet city standards. Motion carried - all members voting Aye. Moved by Mitchell, seconded by Mueller that ZC Appli- cation 63-118 of Richard Huffman be re-noticed for Hear- ing on June 10, 1963. Map of Tentative Tract No. 5150 presented with explanation and condition recommendations by Mr. Remland. Mr. Gallino, Civil Engineer, representing subdivider H. K. Stanley, explained plans. Moved by Morris, seconded by Sheridan that Tentative Tract #5150 be approved subject to conditions pre- sented and filed. Carried. Moved by Morris, seconded by Mueller that study of applicable Ordinance regarding Trailer Parks be referred to Mr. Remland. Carried. Moved by Mr. Mueller, seconded by Mr. Morris that Tustin Elementary School District be notified that Elementary School Site (k-6~located on the South- easterly corner of Main Street and Bryan Avenue is hereby approved subject to Main St. and Bryan Ave. being brought up to City S+andards includin~' concrete curbs and sidewalks. Carried. Moved by Morris, seconded by Mitchell that County Planning Commission be notified that this Commission has no objections to Case No. 649 (Sectional District Map IRS-13 Exhibit "S"). Carried. Moved by Morris, seconded by Mueller that County Planning Commission be notified that this commission has no objections to Case 651 (Sectional District Map IRS-11 Exhibit "Q"). Carried. Moved by Mueller, seconded by Mitchell that the County Planning Commission be notified that this Commission has no recommendations regarding UV 5154 due to lack of sufficient information, with regard to future zoning plans for surrounding county area. Carried. Moved by Morris, seconded by Sheridan that corres- pondence be received an~ filed. Carried. Amendments an~] modifications to PD Ordinance as presented by Mr. Remland were taken under study. Moved by Morris, seconded by Sheridan that meeting be adjourned. Carried. Cha i rman
