July 8, 1963
Meeting called to order at 7:33 P.M. by Chairman Bacon.
Present: Bacon, Sheridan, Mueller, Morris, Gibbons, Hurd
Hefner
City Attorney Rourke arrived at 9:40 P.M.
City Engineer Carlsen present.
Planning Advisor Remland, present.
Moved by Mueller, seconded by Hurd that minutes of last
meeting of June 24 be apprc~ved as mailed. Carried.
Mr. Remland presented report regarding existing and
potential zoning within the present city limits all as
presented to the City Council on July l, 1963.
City Clerk presented petition of approximately 711 names
of residents which was filed with the Council on July 1
and referred to this Commission. Said petition requested
the City Council to take the necessary steps to prohibit
any additional property being zoned P.D. (Plarmed Develop-
ment) for a period of one (1) year or until the adoption
of a Master Plan.
Mr. A. E. McKown spoke regarding petition and requested
that the Planning Commission recommend to the Council
at the July 15th meeting that a moratorium be declared
on rezoning any property to P.D., R-3, R2~ or any
multiple use.
Mr. D. Babs of Tiki Lane requested that no building
permits be issued on existing multiple zoned property.
Moved by Mueller, seconded by Morris that the Planning
Commission request the City Council to appoint three
council members to work with a committee of three members
of this Commission, three members of property owners'
committee, three developers, a representative of the
Chamber of Commerce, City Planning Advisor, and the Orange
County Planning Department, to study status of multiple
zoning and use in the city and surrounding area including
P.D., R-2, R-3, R-4 and to re-evaluate multiple uses in
area. Report of the findings of this study to be made
to this commission not later than first meeting in
August. Carried.
Chairman Bacon appointed Mr. Mueller, Mr. Hurd and
Mr. Morris to above committee to represent the Planning
Commission.
Hearing on UP application Ne. 63-146 of Crawford M.
Mullaney tp permit development of property zoned P.D.
opened at 8:23 P.M. Chairman Bacon reported that pro-
ponents had requested continuation of Hearing to
7-22-63.
Moved by Sheridan, seconded by Hefner that Hearing on UP
application 63-146 be continued to July 22nd meeting.
Carried.
}{earing on UP application No. 63-147, Magel Development
Corp. to permit development of 21 one and two bedroom
residentail units in a C-1 zone opened at 8:25 P.M.
Mr. Morris asked to be disqualified.
Mr. Remland presented recommendations and explain~
location and zoning of property and use and zoning of
surrounding area. Application read by Secretary.

There being no further comments or objections, the
Hearing was declared closed, at 8:40 P.M.
Moved by Hurd, seconded by Mueller that Resolution
No. 660 granting UP 63-147 be passed and adopted.
Rcll call: Ayes: Mueller, Hurd, Bacon. Abstained:
Norris. Noes: Sheridan (without prejudice) Gibbons,
Hefner.
Moved by Mueller, seconded by Hurd that results on
above roll call vote be deferred until city attorney can
render a decision. Carried.
Hearing on Zone Change Application No. 63-126 of
Newport Colonial to permit P.D. Zoning on property on
S/W corner of Main and Williams Street, was opened
at 8:50 PM.
Mr. Remland explained location and zoning of subject
property and use ar~zoning of surrounding area.
Correspondence and application read by Secretary.
Mr. D. Hefner asked to be disqualified.

There being no further comments or objections, the
~earing was declared closed at 9:15 P.M.
Moved by Mueller, seconded by Sheridan, that decision
on Zone Change No. 63-126 be continued to first regular
meeting in August for ~rpose of hearing report of
committee regarding multiple zoning. Carried.
Hearing on Zone Change application No. 63-127 of G. Meurs
opened at 9:21 P.M.
Location, zoning and surrounding area explained by Mr.
Remland and correspondence read by secretary.
Mr. W. Gray spoke in behalf of the applicants,
Moved by Mueller, seconded by Sheridan that since subject
property covered by Z.C. 63-127 is in same vicinity as
that property in Z.C. 63-126 this Hearing be cnntinued
to the first meeting in August. Carried.
Moved by Mueller, seconded by Gibbons that County Planning
Commission be notified that this commission has no
objections to UV 5189. Carried. Mr. Morris abstained.
Moved by Morris, seconded by Mueller that County Planning
C~mission be advised that this commission has no objections
to UV 5191. Carried.

Mr. Rourke arrived at 9:40 P.M.
Moved by Mueller, seconded by Sheridan that the County
Planning Commission be advised that as this commission
is making plans for a study with the county of all
multiple zoning in the city and surrounding coun%y area,
we request that caee 676 Sectional District Map LRS-11
Exhibit U be deferred until ccmpletion of said study.
Carried.
Chairman Bacon appointed a new architectural committee
consisting of the following three members: Mr. Remland
Mr. Hurd and Mr. Morris.
Moved by Sheridan, seconded by Hurd that correspondence
be received and filed. C~rried.
Moved by Sheridan, seconded by Hurd that Resolution No.
661 approving Tentative Tract Map No. 5203 be read by
title only. Carried unanimously.
Moved by Sheridan, seconded by Mueller that Resolution
No. 661 be passed and adopted. Carried by roll call.
Ayes: Bacon, Sheridan, Mueller, Hurd, Gibbons.
Abstained: Morris, Hefner.
Moved by Sheridan, seconded by Mueller that Resolution
No. 662 approving Tentative Tract Map 4234 be read by
title only. Carried unanimously.
Moved by Mueller, seconded by Sheridan that Resolution
No. 662 be passed and adopted. Carried by roll call.
Ayes: Bacon, Sheridan, Mueller, Hurd, Gibbons, Morris.
Abstained: Hefner
City Attorney Rourke ruled that roll call vote on
Resolution No. 660 approving UP 63-147 resulted in a tie
vote and that a new motion was in order.
Moved by Hurd, seconded by Mueller that Resolution No.
660 granting UP 63-147 be passed and adopted. Carried
by roll call: Ayes: Mueller, hurd, Bacon. Noes:
Gibbons, Sheridan. Abstained: Morris, Hefner.
Moved by Mueller, seconded by Sheridan that meeting be
adjourned. Carried.
