Bryant City Engineer Carlsen, present City Planning Advisor Remland, present Moved by Mue ,ler, seconded by Gibbons that Minutes of Seotember 30th be ao.~.roved as mailed. Mr. Remland explained application and use and zoning of surrounding area. Corresoondence from County Planning re'id. Mr. Max Reynolds spoke on behof of applicant. There being no objections or furti~er com.':ents, the Hearing was declared closed at 7:45 P.M. Moved by Hefner, seconded by Giobons that decision on Z.C. Application 63-131 be continued to next regular meeting. Motion ended in tie vote. Noes: Mueller, Bacon Ayes: Hefner, Gibbons. Moved by Mueiler that Z. C. 63-131 be disapproved as applied for with R-3 and C-1 endS/E corner and with permission of applicant entire oarcel be approved for P.D. subject to architectural control and any controls the Plan.~ing Co~.ission or Council set forth regarding density. Motion died for lack of second. Hearing on Z.C. 63-132 of the City of Tustin to oermit rezoning of certain properties between First, Fourth, Prospect & Newport from the "U" zone to C-1. Property location and present zonLng explained by Mr. Remland. Those uresent objecting: B. Gillman D. Hook C. Engle Those speaking in favor of change: Ted Gildred Lee Caroenter D. Hi].l~ard There being no further objections or co~.,~ents, the Hearing was declared closed at 8:37 P.M. Moved b. Hefner, seconded by Gibbons that Resolution No. 677 be passed and adoo~ed reco~ending ~o the City Council that Z.C. 63-132 be approved as presented and said property be rezoned C-1. Carried by roll call. Ayes: Bacon, Hefner, Gibbons. No: Mueller. Chairman ca..led a five .'~inute recess. Meeting reconvened at 8:52 P.M and Hearing on Variance application No. 63-133 of Harold Davis for the construction of a Drive-In Restaurant at 18332 Fourth Street was i~._medLately opened. Variance application exoiained and recommended conditions presented by Mr. Remland. Those speaking in favor: H. Moved by Mueiler, seconded by Hefner that UP ap ,lic~tion 63-153 be conti~ued to the first regular meeting in November and Hearing be re- ooened at that time, providing the City Council has taken action on Z.C. 63-132. Carried. Mr. B. Gibbons informed the Com:':'ssion that he is tendering his resignation effective immediavely due to health reasons. Moved by Hefner, seconded by Mueller th'~t the County Planning Co~mission be notifed that this Commission objects unequivocally to soot zoning and t~erefore requests tl.at Case No. 730 (Sectional District Map 10-5-9 Eshibit K) be denied. Carried. Moved by Hefner, seconded by Gibbons that recommendations of the study group for Amendments to Ordinance No. 157 as presented by Mr. Remland be set for public hearing at earliest possiole date. Carried. Moved by Mueller, seconded by Gibbons that correspondence be received and filed. Carried. Mr. Bacon ai)pointed Don Hefner and himself to fill vacancies on the Architectural Committee.
