Present: Bacon, Hefner, Miller, Engle, Marsters, Ring. Also present: City Ettorney Rourke, Planning Advisor Remland, Bldg. Insp. Brook. Moved by Hefner, seconded by Engle tb~t Minutes of December 30th meeting be approved as roiled. Carried. Moved by Ring, seconded by Engle that Minutes of December 9th meeting be clarified to read meeting post- poned and striking lack of quorum. Carried by roll call - all members voting Aye. Hearing ooened at 7:35 P.M. on Zone Change 63-133 of Ralohs Industries (continued from November 26th). Location and property described by Mr. Remland and corres~oondence from the County Planning Deoartment read. Mr. Adsit, Planning Consultant, described land use and zoning of all surrounding area and presented alternate plans for development of this parcel and adjoining properties. Those present .speaking against this zone change: A. Theurich - soeaking for T~stin Area Home ~n~ rs Association Q. Flem~,~ing - presenting petitions with names of approximately 445 homeowners. T. Lenhart - Doll ~.ane Those speaking in favor of change: Norman Smedegard - attorney reoresenting Ralohs Indus trie s. There being no further objections or corn ents, the hearing w~s closed at 8:12 P.M. Moved by Ring that it be reco~',,ended to the Council that ZC 63-133 be denied and further recom.:e~ded that the pro:'~erty owners get together with Ralohs and make a developed plan for both properties. Motion withdrawn. Moved by Ring, seconded by Engle that it be recom:-.er'~ded to the Council that ZC 63-133 be denied - Carried by roll call- Ayes: Mill.er, Engle, Hefner, RinE, Bacon. Noes: Marsters. Mr. Hefner recom_mended tEzt owners get together with concerned parties and come up wi~.h a more feasible development in keeolng with Exhibit "B" as recommended by Mr. Adsit. Hearing o'~ened at 8:45 P.M on UP 63-155 of Newport Colonial to permit construction of a Planned Develop- ment at Southwest corner of Main and Williams Streets (continued from Dec. 30th) . Location, building coverage, ooen area and streets exolained aud 15 conditions presented by Mr. Remland~ J. J. Wall, attorney representing applicant asked t~at some action be taken those present with com~.ents: Mr. E. McKowan There being no further com~.~ents or objections, the hearing was closed at 9:05 P.M. Moved by Engle that UP 63-155 be denied and that the comm. ission by Minute order request the City Council to initiate a study and consider rezoning under a.mended PD zoning with the PD 3500 limitation. Motion died for lack of a second. Moved by Hefner, seconded by Marsters that U~ 63-155 be granted. Motion failed Ayes: Marsters, Hefner, Bacon, Noes: Miller, Engle, Ring. A0plication will go to the Council with no recommendations. Hearing opened at 9:25 P.M. on ZC 64-134 of Pete Myer to rezone the rear 50' of property at First and Pacific Streets from R-3 to C-1. Mr. Marsters asked to be allowed to abstain from participation. Location and reasons for request explained by Mr. Remland. Those present with comments: F. Colgan J. Stafford, representing applicant. There being no further comments or objections, the hearing was closed at 9:30 P.M. Moved by Miller, seconded by Hefner that Resolution 696 be passed and adooted recommending to the Council tb~t ZC 64-134 be granted. Motion carried. Ayes: Bacon, Hefner, Miller, Engle, Ring. Abstained: Marsters. Hearing opened at 9:33 P.M. on Zone Change 64-135 of J. Siegel and C Greenwood to rezone property on s ~uth side of Fourth Street, co rner of Prosoect Avenue, from R-4 to C-1. Location and surrounding area explained by Mr. Remland. Those present soeaking agaimst change: Dave ~ook - one of the owners of Prosoect Park M Mr. Ballison- Olive Tree Circle Mr. M. DeMong Those speaking in fa~r of change: John Siegel Bob Windolph C. Greenwood There being no further comments or objections, the heari.L~g w~s closed at 9:53 P.M. Moved by Engle, seconded by Hefner that ZC 64-135 be recom- mended to the Council for aoproval subject to restriction of lO0-C~?-15,000 and subject to a minimum 25' setback from Fourth And Prospect. Motion failed. Ayes: Engle, Hefner, Noes: Miller, Marsters, Ring, Bacon. Moved by Marsters, seconded by Miller that it be recom- mended to the Council that Z. C. 64-135 be denied. Mr. MiLler withdrew his second and motion died. ZC 64-I°,4 ,.' · ~.) : . Moved by Miller, seconded by Ring that Resolution 698 be oassed and adooted initiating rezoning procedure on the westerly 130' of subject property in Z.C. ao"~lica%ion 64-135 from R-4 to "U" zone. Carried by roll call: Ayes: Miller, Marsters, Engle, Ring, Bacon. Noes: Hefner. Hearing opened at 10:40 P.M. on UP 6~-156 of Tustin Elementary School District for the c~.nstruction of addition to C. E. Utt School· Mr. A. Currie sooke on behalf of applicant. There being no further co~nents or objections, the hearing was dlosed at 10:42 P.N. McQuaid Moved by Miller, seconded by Marsters that Re~olution 700 be passed and adooted granting Variance 64-139, Carried by roll call. Ayes: Miller, M~rsters, Hefner, Ring, Bacon. Abstained: Engle. Noes: None. Correspondence from County Planning Department regarding Case 757 read. Mr. Kelly, Lifetime Homes, spoke against this zone change. Moved by Engle, seconded by Marsters that City Clerk be directed to write the County Planning Department requesting that they withhold action on Case 757 (Sectional District Map 16-5-9 Exhibit M) until such time as a joint study session between the County and City can be held reKardi ~ this property and adjacent property. Carried. Moved by Engle that we inform the County Planning that we have reviewed CP 1078 and have no reco~nendations at this time. Died for lack of second. Moved by Ring, seconded by Miller that County be informed that we disapprove of CF 1078 and that property should be zoned R-1. Motion failed in tie vote. Ayes: Miller, Engle, Ring. Noes: Marsters, Hefner, Bacon. Moved by Hefner, seconded by Ring that Mr. Remland be reguested to present proposed olans and zoning study findings of area South of Tustin at ne~t study session . Motion carried. Mr. W. Moses spoke requesting Planning Co~.~issioners consider the Irvine P~nch as well as the County ?la~ng when considering zoning. Secretary directed to request the City Council to authorize the services of Mr. Remland for extra study sessions. There being no further business, the meeting was declared adjourned· Ruth~-.
