Present: Bacon, Marsters, Hefner, Engle, Lawrence Mr. Ring arrived at 8:12 P.M. Absent: Miller Also Present: Rourke, Wheelock, Brook. Moved by Marsters, seconded by Hefner th.3t Minutes of MIN. APPROV. March 23rd be aoproved with following correction: voting WITH CORRECT. on Minute Order regarding Case 726, show Mr. Lawrence voted "No" - Mr. Marsters voted "Yes". Discussion on ZC64-137 of A. Stutsman commenced. Those present with comments: DISCUSSION ZC64-137 A. STUTSMAN Mr. A. Stutsman Mr. C. Stutsman Mr. B. Windolph Mr. A. Charlton Mr. Wm. Henderson Moved by Lawrence that it be recommended to the Council that Stutsman property applied for in ZC64-137 be zoned lO0-C-1-P-lO,O00. Motion died for lack of second. Mr. Ring arrived (8:12"P.M.) Moved by Lawrence, seconded by Hefner that Resolution 714 recommendinE that property as applied for in ZC. 64-137 be zoned 100-C-l-P-10,000. Carried by roll call Ayes: Bacon, Hefner, Lawrence, Marsters. Abstained: Engle, Ring. Noes: None. Absent: Miller. ZC64-137 CARRIED BY ROLL Hearing ooened at 8:20 P.M. on UP64-162 of Foster & Klelser UP64-162 to permit erection of outdoor advertlsln~ structure at FOSTER & 171 E. First Street, Tustin. KLEISER Location and two sugEested conditions exolained by Mr. Wheelock. LOCATION & CONDITIONS Those present speaking in favor of application: Don Davis of Foster & Kleiser John Prescott There being no further comments or objections, the Hearing was closed at 8:35 P.M. Moved by Engle that UP64-162 be granted as aoplled for subject to sign ordinance and issuance of building permit and that Use Permit be for two years and that it either be r~newed by the Commission at that time or sign be removed within 60 days. Motion died for lack of second. Moved by Hefner, seconded by Ring that UP64-162 be denied. UP64-162 Carried by roll call - Ayes: Ring, Marsters, Lawrence, DENIED Hefner, Bacon. Noes: Engle. Absent: Miller. Hearing opened at 8:53 P.M. on UP64-163 of Foster & Kleiser UP64-163 to permit the erection of one outdoor advertising structure FOSTER & on east side of "D" Street, 150' north of Sixth Street. KLEISER Application explained and two recommended conditions 'explained by Mr. Wheelock. CONDITIONS Those oresent soeaking in favor of application: Don Davis John Prescott There being no objections or further comments, the Hearing was closed at 9 P.M. UP 64-163 TWO CONDIT. Moved by Engle that UP64-163 be approved subject to two recommended conditions and permit be for two years and that'it either be renewed at that time by the Commission or sign be removed within 60 days. UP64-164 KENNEDY & HAUSE CONDITIONS Hearing opened at 9:06 P.M. on UP application No. 64-164 of Kennedy & Hause to permit the erection of a directional sign on north side of 17th Street, 632' west of Yorba St. Application explained ~nd si× recommended conditions submitted by Mr. Wheelock. Mr. D. Hayden spoke on behalf of aoplicant. There being no objections or further comments, the Hearing was closed at 9:10 P.M. RESOL. 715 Moved by Marsters, seconded by Lawrence that Resolution APPROV. 715 approvinE UP6~-164 subject to si× recommended conditions UP64-164 be passed and adopted. Carried by roll call - Ayes: Bacon, PASSED & Marsters, Hefner, En~le, Lawrence, Ring. Noes: None. ADOPTED Absent: Miller. UP64-165 KENNEDY & HAUSE HearinE ooened at 9:11 P.M. on UP6a-165 of Kennedy & Hause to permit an 8' x 12' directional sign at front and side prooerty line at Northeast corner of Yorba and Fourth Streets. RESOL. 716 APPROV. UP64-165 PASSED & ADOPTED There being no comments or objections, the Hearing was closed at 9:12 P.M. Moved by Marsters, seconded by Lawrence that Resolution 716 approving UP64-165 subject to the si× recommended conditions be passed and adooted. Carried by roll call Ayes: Bacon, Marsters, Hefner, Engle, Ring, Lawrence. Noes: None. Absent: Miller. Five minute recess called. Meeting reconvened at 9:20 P.M. APPLICATION Application explained by Wheelock. EXPLAINED Those speaking in favor of aoplicatlon: V. Meeks A. Drocco. There being no objections or further comments, the Hearing was declared closed at 9:30 P.M. RESOL. 717 APPRO VI NG V.64-141 PASSED & ADOPTED Moved by "'ngle, seconded by Hefner thgt Eesolutlon 717 approving Variance No. 64-141 be oassed ~nd adooted- Carried by roll call. Ayes: Bacon, Hefner, nngle, Rin~, Marsters, Lawrence. Noes: None': Absent: Miller Consideration of request of the City Council for further recommendations as to setbacks on Fourth Street ooened for discussion and explained by Mr. Wheelock. Those present with comments were Frank Morris and Bob Hall. Moved by Lawrence that it be recommended to the Council thst a lO' setback be established on both sides of Fourth Street within the City limits. Motion died for lack of a second. Moved by En~le that the City Engineer contact the County goad Dept. for their opinion and present said opinions to the Council with the Engineer's recommendation and the Council make decision based on these findings whether set back should be changed on entire Fourth Street in the City or give this Commission time for further study. Motion died for lack of second. Moved by Marsters, seconded by Ring that this Commission ask the Council to continue hearing on Appeal of decision of the Commission denying Variance 64-140 of Westmont Development until the Commissioners can meet with the City Engineer and continue discussion at the next regular commission meeting, motion carried Mr. Lawrence vot lng No. Moved by Hefner, seconded by Marsters th~.~t the County be contacted for their opinion prior to the next regular meeting so that this Commission can have their oplnlOn'as to the future of Fourth Street at that time. Carried. Mr. Wheelock requested to prepare a Zoning Map of "U" zoned 0roperty located N/W of Laguna Road and Red Hill Avenue - S/E of school property. Moved by Lawrence, seconded by Ring that this Commission advise the County Planning Commission that there are no objections to Case 795. Carried. Moved by Marsters, seconded by Lawrence that the County Planning Commission be advised that this Commission has no objections to UV5220. Carried.
