2 AN EMERGENCY INTERIM ORDINANCE OF THE CITY OF
TUSTIN, CALIFORNIA, RELATIVE TO SET BACK
8 REQUIREMENTS OF SWIMMING POOLS.
~ 4 The City of Tustin, California ordains as follows:
5 1. The City Council finds and determines:
6 (a) That the City is studying the matter of
proper set backs from property lines of
~ swimming pools.
8 (b) That when such studies have been completed
appropriate amendments to the zoning and other
~ ordinances of the City of Tustin will be
9 considered for adoption.
10 (c) Pending the completion of such studies, it
11 is in the best interests of, and for the
protection of, the public safety, health
1~ and welfare that an urgency measure be
adopted as an interim ordinance for four (4)
1~ months to allow, permit, restrict and prevent
the construction of swimming pools other
14 than as in this ordinance permitted.
15 2. Swimming pools in the Residential Districts shall
not be located closer than three (3) feet to any side
"~-~ 1~ or rear property line nor in any portion of a lot not
permitted to construct an enclosing wall or fence
I ~? six feet~ eight inches (6~8") in height as specified
in the District Regulations.

3. The Planning Commission is requested and directed
19 to make appropriate study of the matter of the location
of the swimming pools and make its report and recom-
Z0 mendations thereon to the City Council.
21 4. This ordinance shall become effective immediately
upon its passage by a four-fifths (4/5) vote of the
2~ City Council and shall remain in force and effect
for four (4) months.
