Present: Hefner, Marsters, Bacon, Halus, Brand Sharo. Absent: Enderle. City Attorney Rourke, present. Moved by Marsters, seconded by Halus that Minutes of January llth Regular Meeting and January 18th Special Meeting be a.oproved as mailed and received. Carried. ZONE CHANGE Hearing opened at 7:31 P.M. to consider Zone Change 65-142 65-142, City of Tustln, to rezone 95' strio of property located 535' North of 17th Street. and 590' West of Yorba St. from R-1 to C-1-P. Staff report as to location, zoning, land use, acreage and history presented with recommendation for approval of reauest to this zone change. Mr. Bob Wild, reoresentin~ owuaers, spoke in favor of zone chanqe and in agreement with continuation of proposed street North of commercial development to the East. There being no further Comments and no objections, the Hearino~ was declared closed .st 7:38 P.M. RESOL. 762 PASSED ADOPTED ZC 65-142 Moved by Brand, seconded by Marsters that Resolution 762 be passed and adooted recommending approval of Zone Change aopllcation 65-142 to the City Council. Carried - roll call - Ayes: Hefner, Marsters, Bacon, Hslus, Brand, Sharp. Noes: None. Absent: Enderle. PUBLIC Hearing opened at 7:40 P.M. to consider amending the UTILITIES Tustln City Code to require olaclnE of Public Utilities UNDERGROUND underground in new subdivisions. Mr. Haworth exolained economic feasibility and that at this time ordinance would apply only to land being subdivided. City Attorney Rourke oresented a revision to paragraoh 2, subsection (J) to read as folIows: "For the purpose of th~s sect ion apourtenances anU associate ecuipment such as, but not limited to, surface-mounted transformers, pedestal- mounted terminal boxes, and meter cabinets, and concealed ducts in underground systems may be placed shove Mrou~d." Mr. J.A. Lono~, District Manager for Southern California Edison Co. spoke in favor of orooosed ordinance as revised. After discussion regardin~ decision making power for enforcement of ordinance, it was the oolnlon of the Commission that as this would come under the jurisdiction of the Building Department, no one perso~ need be designated. There being no further comments and no objections, the Hearing was declared closed at 8:09 P.M. RESOL. 763 Moved by Halus, seconded by Marsters that Resolution PASSED No. 763 be passed and adooted recommendin~ to the City ADOPTED Council the adoption of O~dinances No. 27~ as amended by the attorney. UNDERWOOD Site Plans for Underwood ~uality Food Coro. on proposed QUALITY Del Amc Ave. South of Edinger presented and explained FOOD CORP. by Planning Staff. Mr. Rourke explained that according to the Zoning Ordinance only parking and landscaoing need be considered by this Commlsslon. Staff stated that parking shown is actually less than required minimum but that area is available to provide required soaces. Following Staff recommendations oresented: 1. Parking reoulrements to be as per minimum standards. 2. Landscaping to be maintained. 3. Fire hydrants placed according to Fire Dept· re commend a t i OhS. Mr. Harry Martin representing owner and development of facility, stated they would be ~lad to work with the Fire Deoartmemt regarding hydrants and agreeable to any oarkln~ or l~dscaoi~ reouirements Mr Martin stated that in this ty~.e of facility, sorinkler system is prohibitive. Moved by Bacon, seconded by Halus that site clan be aoproved with recommendations of Planning Staff regarding parking and landscapin~ and trees be orovided as set forth by the Parks and Recreation Commission Carried unanimously· Correspondence from Newport Colonial Coro. requesting a one-year extension of UP 63-155 oresented by Staff with exclamation of cast history of the zoning of property and Use Permit. CORR. FROM NEWPORT COLONIAL ~ ,.0RP Mr. Jerry Brown spoke on behalf of Newoort Colonial Corp. Mr. Rourke exolalned th'-~t the Commissio~ may grant extension of ori~inal Use Permit but only on original olans a~.d conditions. Moved by Sharo, seconded by Brand that Use Permit 63-155 be extended to next regular meetin.~ and attorney and Planning Staff review both old and new sets of plans and reoort as to chan~es and make recommendations at that time. - Carried. Mr. Hsworth presented County UV5448 with explanation of letter sent to County re~ar~inM parkin~ inadequacy. UV is now going before the Board of Suoervisors and Staff recommendations are that this Commission recommends to the Board that density be reduced to be compatible to adjoining City Planned Development zoned property. COUNTY uv5448 Moved by Halus, seconded by Brand that letter be sent to County Board of Suoervisors st~tlng that this Commission recommends that the density as shown in UV5448 be reduced and be no hiMher than that allowed in adjacent City P.D. Zone. Carried. In answer to questionin~ Mr. H~worth informed the Commission that a study o£ signs is in the process and the County sn~ other Cities have been contacted.
