HUSTON, INTERIM CITY MANAGER FROM: CITY MANAGER'S OFFICE & PUBLIC WORKS DEPARTMENT SUBJECT: APPROVE AMENDMENT NO. 3 TO A CONSULTANT SERVICES AGREEMENT BETWEEN THE CITY AND PSEC, INC. FOR TUSTIN LEGACY ENVIRONMENTAL SERVICES SUMMARY Approval is requested of Amendment No. 3 to a Consultant Services Agreement between the City and Pacific States Environmental Contractors, Inc. ("PSEC"} for additional environmental assessment services at Tustin Legacy. The Amendment will provide additional services related to groundwater modeling within the ~IFOC area requested by the Navy for underground storm drain and sewer installations as well as work required for existing Navy well modifications in the work area for the Tustin Ranch Road Extension Project. RECOMMENDATION It is recommended that the City Council: 1. Approve Amendment No. 3 to a Consultant Services Agreement between the City and PSEC for additional environmental support services, increasing the not to exceed amount by $68,$00 to $221,585, and authorize the City Manager andlor Assistant City Manager to execute the Amendment; and 2. Appropriate $68,800 from unappropriated funds in CFD 06-01 Fund (434) to the Tustin Ranch Road Extension CIP No. 70206 to cover associated expenses. FISCAL IMPACT The additional consulting services will be compensated on a time and material basis with a not to exceed cost of $68,800. Approval of the proposed contract amendment will require appropriation of $68,800 from unappropriated funds in CFD 06-01 Fund (434). Out of this amount, it is expected that $31,500 would be reimbursable from IRWD for groundwater modeling of their capital facilities pursuant to a future Capital Facilities Reimbursement Agreement between the City and IRWD which will be brought back to the City Council at a future meeting. .~ DISCUSSION On November 16, 2010, the City Council approved a Consultant Services Agreement with PSEC to provide environmental support services related to assessing various Pacific States Environmental Contractors, Inc. Contract Amendment No. 3 September 6, 2411 Page 2 environmentally-related tasks at Tustin Legacy previously started by the former master developer, Tustin Legacy Community Partners, LLC ("TLCP"). A number of subsequent amendments have been necessary and unforeseen as follows: • On April 5, 2011 Amendment No. 1 to the Agreement was approved for additional environmental support services related to bid specification language and investigations for the Tustin Ranch Road rough-graded area as well as technical support for completion of reports related to previously completed TLCP clean-up efforts in Neighborhood E. • On June 21, 2011 Amendment No. 2 to the Agreement was approved for additional environmental support services from PSEC related to bid specification language for underground utility installation work, soil sampling, and groundwater modeling for the Tustin Ranch Road Project and technical support for soil import criteria and Navy PERF approvals. In response to the submittal of construction plans and documents for the Tustin Ranch Road project affecting current property at Tustin Legacy still owned by the Navy and leased to the City under a Lease In Furtherance of Conveyance ("LIFOC), the Navy has imposed conditions as part of the approvals of work within the LIFOC limits which required the City to undertake additional ground water modeling as environmental remediation well modifications and protections. Subsequently, additional environmental support services from PSEC was requested related to groundwater modeling for underground storm drain and sewer installations as well as work required for existing Navy well modifications in the work area for the Tustin Ranch Road Extension Project. Based upon its familiarity and experience with the work required, its vast knowledge of the project, and its current working relationship on the Tustin Ranch Road Project, PSEC was determined to be the most qualified to provide the required services at this time. An itemized list of approved Tustin Legacy agreements for professional consulting services, including pending approvals, is attached for reference. ~; Christine A. WHEREAS, City and Consultant entered into a Consultant Services Agreement on November 16, 2010, to provide consulting services to the City for environmental assessment services at Tustin Legacy, and WHEREAS, the City requested certain additional environmental assessment services related to groundwater modeling for underground utility installations as well as work required for existing Navy well extensions in the work area for the Tustin Ranch Road Extension Project; and WHEREAS, Consultant submitted an authorization request for additional environmental support services dated July 29, 2011, attached hereto as Exhibit "A"; NOW, THEREFORE, it is agreed that the Original Agreement be amended as follows to reflect the modifications requested by Consultant and authorized by the City of Tustin: Modification of Compensation. Section 2 entitled "Compensation" is amended to provide additional environmental assessment services as identified in Exhibit "A" of this Amendment No. 2 up to an additional amount not to exceed $68,800. 2. (PSEC) is pleased to submit this contract addendum proposal to conduct selected environmental tasks at the former Marine Corps Air Station (MCAS) Tustin. SCOPE OF WORK AND BUDGET The following is a task listing of the scope of services that PSEC will provide to the City of Tustin, atime- and-material, not-to-exceed budget, and schedule for the City's approval. Task 1 -Response to 2D Groundwater Model Comments During a conference call on July 12, 2011 involving the City, PSEC, Avocet Environmental {Avocet) and the Navy's representatives regarding a review of the 2D Groundwater Modeling Report by Avocet dated June 10, 2011, the Navy requested additional modeling effort to assess impacts to the IRP-5S(a) (CO-9) plume as well as the IRP-3 {CO-6) plume that is under active remedial action. The Navy is concerned that construction dewatering could disrupt its hydraulic control efforts in IRP-3 and possibly cause contaminant migration toward dewatering extraction points and possibly unimpacted areas. To address this new request, the modeling team will evaluate the capability of the 2D model and also the 3D MODFLOW mode( to answer the Navy's concerns for both trichloroethene (TCE) plumes. The output from the 2D model using a range of hydraulic conductivity reported in Navy reports will be reinterpreted to estimate whether construction dewatering from the storm water box may impact the CO-6 groundwater extraction system. This effort will also include 3D groundwater modeling to assess impacts to both TCE plumes and preliminary contaminant transport modeling. Results and a revised draft report will be available in less than two weeks following authorization to proceed. The estimated budget for this additional monitoring work is atime-and-materials not-ta-exceed without authorization cost of $8,640. This budget includes the subcontractor construction of the 2D and 3D models, modeling of different groundwater hydraulic and contaminant scenarios, and drafting and reporting efforts. No professional time from PSEC is included in this task. City of Tustin July 29, 2011 Page 2 of 4 Task 2 - 3D Groundwater Modeling for Sewer Installation The installation of sewers and utilities along Tustin Ranch Road (TRR) will involve construction dewatering from the shallow aquifers that have been identified in numerous investigations by the Department of the Navy (DON). DON has stated in a Project Environmental Review Farm (PEKE} letter that the City shall include an evaluation of the potential adverse impacts from dewatering activities near groundwater contamination in Operable Unit {OU) 1 B (Carve Out-6) and OU 4B (CO-9) in the dewatering plans supported by groundwater modeling. Groundwater is found in the area near TRR and Warner Avenue at approximately 7 feet below ground surface (bgs) in a low permeability silty-clay layer. The subject sewers will be installed approximately 16-18 feet bgs and possibly extend into a mare permeable, silty sand second water bearing zone. The decision regarding how to dewater will be left up to the selected contractor. Regardless of the method, evaluation of the construction dewatering for the deeper sewer trench requires a more complex, three- dimensiona( (3D) modeling approach. PSEC and its subcontractor, Avocet Environmental, will develop a Visual MODFLOW 2010.1 3D model to evaluate short-term construction dewatering for the sewers focused on two water-bearing zones with different hydraulic characteristics. The model will cover approximately the first 350 feet of the TRR installation, north of Warner Avenue. The hydraulic characteristics of the aquifer will be based on parameters used in the assessment of CO-6 by DON (ERRG,2007). Avocet has evaluated the model provided on a disc earlier this week for OU-1 B from the DON and found that it was not useful. The model used was a 1990s outdated version and some data files were missing such that construction for MODF~OW inputs are still necessary. After the model is created, it will be calibrated using DON data to simulate groundwater extraction for an extended period of time, greater than two years, using average pumping rates to replicate steady-state drawdown conditions in the two water-bearing zones. The model is considered calibrated when the predicted capture zones and drawdowns approximate the DON results published by their remediation contractor {ECS, 2010). Once calibrated, the model will be run to simulate rate and duration of dewatering. MODFLOW can simulate extraction from either a linear feature or a series of extraction wells. The construction dewatering duration will be based an a conservative estimate of the time required to dewater, excavate and backfill approximately 350 linear feet of the sewer trench starting from TRR and Warner through the Special Construction Zone. For this model, 30, 60 and 90-day dewatering periods will be assumed. The output from the 3D model will be interpreted to estimate whether, and to what extent, construction dewatering from the deep sewer trench may influence the CO-6 groundwater extraction system and either of the trichloroethene plumes, CO-6 and CO-9. Results will be available in three weeks following authorization to proceed and a draft report issued within 2 weeks later. The estimated budget for this work is atime-and-materials not-ta-exceed without authorization cost of $31,50Q. This budget includes the subcontractor construction and calibration of Visual MODFLOW model, modeling of different groundwater extraction scenarios, and reporting efforts, and 224 hours of senior professional time from PSEC and our subcontractor to provide technical expertise and respond to City and DON reviews and comments. Task 3 -Well Extensions in CO-9 Area The City of Tustin`s grading contractor will overexcavate and recampact the top 5-feet of soil in the CO-9 area, north of blamer Avenue between Tustin Ranch Road and Park Avenue, and then bring the whole area up to rough grade. This action will increase the soil elevations approximately 4- to 7- feet above existing grade except for some bermed areas along the perimeter to the east and south. The scope of work has been developed to identify and protect the groundwater monitoring wells within the planned PSEC:BD/Tustin/Adden3 Prp 7-11 City of Tustin July 29, 2011 Page 3 of 4 overexcavation and grading area in the CO-9 area. There are six monitoring wells and two piezometers within the work area. The wells are labeled 1005MW01 S, 1005MW03S, 1005MW05SR, 1005MW07S, 1005MW115, and 1005MW12S. The two piezometers are named 1005-EX025 and 1005-PZ01-EX025. The following tasks will be completed to protect the existing well features within this area: • Prepare a Work Plan to provide the steps and procedures to adjust the elevations of the existing wells and piezometers within the construction area. • Existing concrete pads and other surface features at each monitoring well or piezometer will be demolished and the well pipe will be cut below former depth of concrete. • Add a PVC coupling and a 2-inch, schedule 40 PVC riser to a height greater than the planned finished rough grade. No glue shall be used. • Protect the wells with K-rail guards. • Upon completion of rough grade fill, return to site and install a 12-inch flush mounted well box in a 2-foot by 2-foot concrete pad • Survey the well to the nearest 0.01 feet from mean sea level using a licensed land surveyor or registered civil engineer. • Prepare an installation report to summarize field activities and well construction information. This work will be scheduled fallowing completion by the DON of the third quarter 2011 groundwater monitoring for this remedial site and before the start of the field soil overexcavation step. The estimated budget for this work is atime-and-materials not-to-exceed without authorization cost of $22,900. This budget includes the drilling subcontractor's two site visits far two days each during well demolition with debris removal and then well finishing. The project elapsed time will be separated by the field time to averexcavate the site and then finish the rough grading of the site. PSEC will provide the planning, agency and DON communication, and reporting efforts. In addition to the costs far the well subcontractor, 72 hours of project professional and 74 hours of senior professional time from PSEC is included to provide technical expertise and field supervision to prepare an approved Work Plan, install the extensions then the flush-mounted well boxes, prepare a well installation report, and assist the City's surveying contractor, RBF Consulting, in the final survey of the elevations for the finished wells. Task 4: Technical Support As the planning for the design and construction of TRR and the subsurface utilities continues under City direction, PSEC staff has been asked to become involved in several technical tasks requiring input from senior professional staff. These tasks include: 1.) Design Review Meetings, 2.} Project Conference Calls, 3.) Development of Soil Import Criteria, 4.) Technical evaluation and contribution for insurance and agency comment and 5.) Plan reviews, such as, grading, utility installation, and dewatering issues. The estimated budget for this work is atime-and-materials not-ta-exceed without authorization cost of $7,800. This budget includes 60 hours of senior professional time to provide technical expertise and direct project support. Activities and costs will be collected an a specific Task Basis. Charges and fees will be invoiced on a Time and Materials basis, not to exceed the total authorized amount. Vendors, supplies, and subcontractors will be billed at actual cost plus an administrative cost as agreed in a negotiated contract. PSEC wili invoice the City of Tustin monthly based on the amount of work completed. Insurance and Payments terms shall be in accordance with the contract.
